Status of International Law
- EnglishThe Republic of San Marino receives generally recognised rules of international law as integral part of its constitutional order, to which it shall conform its acts and conduct. It recognises the provisions set forth in the international declarations on human rights and fundamental freedoms.
It reasserts the right to political asylum. It rejects war as a means to settle disputes between States and, in its international policy, adheres to the principles enshrined in the Charter of the United Nations.
San Marino constitutional order recognises, guarantees and enforces the rights and fundamental freedoms set forth by the European Convention for the Protection of Human Rights and Fundamental Freedoms.
Regularly signed and implemented international agreements on the protection of human rights and freedoms shall prevail over domestic legislation in case of conflict. (Art. 1) - ItalianLa Repubblica di San Marino riconosce, come parte integrante del proprio ordinamento, le norme di diritto internazionale generalmente riconosciute e conforma ad esse i suoi atti e la condotta. L'ordinamento sammarinese riconosce, garantisce ed attua i diritti e le libertà fondamentali enunciate nella Convenzione Europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali.
Gli accordi internazionali in tema di protezione delle libertà e dei diritti dell'uomo, regolarmente stipulati e resi esecutivi, prevalgono in caso di contrasto sulle norme interne. (Art. 1)

- EnglishThe order of precedence for the application of the regulations shall be as follows: the Constitution; international treaties and conventions; organic laws; regular laws; regional regulations and district ordinances; decrees and regulations; ordinances; agreements and resolutions; and the other actions and decisions taken by public authorities.
In the event of any conflict between regulations from different hierarchical levels, the Constitutional Court, judges, administrative authorities and public servants, it shall be settled by the application of the standard of higher order of precedence.

(1) Judges, in the performance of their function, shall be independent and, in decision making shall be bound by the Constitution, by constitutional law, by international treaty pursuant to Art. 7, paras. 2 and 5, and by law.
(2) If a Court assumes that other generally binding legal regulation, its part, or its individual provisions which concern a pending matter contradicts the Constitution, constitutional law, international treaty pursuant to Art. 7, para. 5 or law, it shall suspend the proceedings and shall submit a proposal for the commence of proceedings according to Art. 125, para. 1. Legal opinion of the Constitutional Court of the Slovak Republic contained in the decision shall be binding for the Court. (Art. 144) - Slovak
(1) Sudcovia sú pri výkone svojej funkcie nezávislí a pri rozhodovaní sú viazaní ústavou, ústavným zákonom, medzinárodnou zmluvou podľa čl. 7 ods. 2 a 5 a zákonom.
(2) Ak sa súd domnieva, ţe iný všeobecne záväzný právny predpis, jeho časť alebo jeho jednotlivé ustanovenie, ktoré sa týka prejednávanej veci, odporuje ústave, ústavnému zákonu, medzinárodnej zmluve podľa čl. 7 ods. 5 alebo zákonu, konanie preruší a podá návrh na začatie konania na základe čl. 125 ods. 1. - EnglishThe State has the duty to assure the diffusion and the teaching of the Constitution, of the Universal Declaration of the Rights of Man of 1948, of the African Charter of the Rights of Man and of Peoples of 1981 as well as of all international instruments duly ratified relative to Human Rights.
The State must integrate the rights of the human person in the programs of literacy [alphabétisation] and of teaching in the different schooling and university cycles and in all the programs of training of the armed forces, the forces of public security and similar forces.
The State must equally assure in the national languages by all means of mass communication, in particular by radio and television, the diffusion and the teaching of these same rights.
