1. be of Thai nationality by birth;
2. be not less than thirty-five years of age;
3. have graduated with not lower than a Bachelor’s degree or its equivalent;
4. be of evident integrity;
5. not have behaviour which is a serious violation of or failure to comply with ethical standards;
6. not be under any of the prohibitions under section 98;
7. not be a person sentenced by a judgment to imprisonment, irrespective of the finality of the case or a suspension of the punishment, except for an offence committed through negligence, a petty offence or a defamation offence;
8. not be a person whose office has been vacated on the grounds of committing any prohibited act under section 186 or section 187, for a period of less than two years up to the date of appointment. (Sec. 160) - Thaiรัฐมนตรีต้อง

- English1. There shall be a Prime Minister of Antigua and Barbuda who shall be appointed by the Governor-General.
2. Whenever there is occasion for the appointment of a Prime Minister, the Governor General shall appoint as Prime Minister
a. a member of the House who is the leader in the House of the political party that commands the support of the majority of members of the House; or
b. where it appears to him that such party does not have an undisputed leader in the House or that no party commands the support of such a majority, the member of the House who in his judgement is most likely to command the support of the majority of members of the House,
and is willing to accept the office of Prime Minister.
3. Subject to the provision of section 82 of this Constitution and subsection (4) of this section there shall be, in addition to the office of Prime Minister, such other offices of Minister (including Minister of State) of the Government as may be established by Parliament or, subject to the provisions of any law enacted by Parliament, by the Governor-General, acting in accordance with the advice of the Prime Minister.
4. The Ministers other than the Prime Minister shall be such persons as the Governor-General, acting in accordance with the advice of the Prime Minister, shall appoint from among the members of the House and of the Senate.

(1) The Federal Chancellor and, on his recommendation, the other members of the Federal Government are appointed by the Federal President. No recommendation is requisite to the dismissal of the Federal Chancellor or the whole Federal Government; the dismissal of individual members of the Federal Government ensues on the proposal of the Federal Chancellor. The appointment of the Federal Chancellor or the whole Federal Government is countersigned by the newly appointed Federal Chancellor; dismissal requires no countersignature.
(2) The members of the Federal Government need not belong to the National Council but must be eligible for election to the National Council.

(1) Der Bundeskanzler und auf seinen Vorschlag die übrigen Mitglieder der Bundesregierung werden vom Bundespräsidenten ernannt. Zur Entlassung des Bundeskanzlers oder der gesamten Bundesregierung ist ein Vorschlag nicht erforderlich; die Entlassung einzelner Mitglieder der Bundesregierung erfolgt auf Vorschlag des Bundeskanzlers. Die Gegenzeichnung erfolgt, wenn es sich um die Ernennung des Bundeskanzlers oder der gesamten Bundesregierung handelt, durch den neubestellten Bundeskanzler; die Entlassung bedarf keiner Gegenzeichnung.
