- EnglishThe safeguarding of the integrity and the supremacy of the Constitution is entrusted to the Constitutional Court, in the strict and precise terms of this Article. With this objective it will fulfill the following functions:

10. To decide definitively on the constitutionality [exquibilidad/executability] of the international treaties and on the laws that approve them. To this end, the Government will submit them to the Court, within the six days subsequent to the sanction of the law. Any citizen can intervene to defend or challenge their constitutionality [constitucionalidad]. If the Court declares them constitutional, the Government may effect the exchange of notes; in the contrary case they will not be ratified. When one or several norms of a multilateral treaty are declared unconstitutional [inexquibilidad/unexecutable] by the Constitutional Court, the President of the Republic may only declare consent formulated [with] the corresponding reservation.

Les traités ou accords régulièrement ratifiés ont, dès leur publication, une autorité supérieure à celle des lois sous réserve, pour chaque accord ou traité, de son application par l'autre partie et de sa conformité avec les dispositions pertinentes du droit des traités.

(2) The State shall enact appropriate laws to assure—
(a) the enjoyment of rights of effective participation in development processes including rights of people to form their own associations free from state interference and to use them to promote and protect their interests in relation to development processes, rights of access to agencies and officials of the State necessary in order to realise effective participation in development processes; freedom to form organizations to engage in self-help and income generating projects; and freedom to raise funds to support those activities;
(b) the protection and promotion of all other basic human rights and freedoms, including the rights of the disabled, the aged, children and other vulnerable groups in development processes.
(3) In the discharge of the obligations stated in clause (2) of this article, the State shall be guided by international human rights instruments which recognize and apply particular categories of basic human rights to development processes.
