- EnglishAny person may file an initiative to start the procedure for the assessment of constitutionality and legality.
The procedure before the Constitutional Court for the assessment of constitutionality and legality may be initiated by the court, other state authority, local self-government authority and five Members of the Parliament.
The Constitutional Court itself may also initiate the procedure for the assessment of constitutionality and legality.
During the procedure, the Constitutional Court may order to stop the enforcement of an individual act or actions that have been taken on the basis of the law, other regulation or general act, the constitutionality, i.e. legality of which is being assessed, if the enforcement thereof could cause irreparable damage. Postupak pred Ustavnim sudom za ocjenu ustavnosti i zakonitosti može da pokrene sud, drugi državni organ, organ lokalne samouprave i pet poslanika.
Ustavni sud može i sâm pokrenuti postupak za ocjenu ustavnosti i zakonitosti.

- EnglishThe Constitutional Court is the judge of the exceptions of unconstitutionality raised before or by a jurisdiction.
Any person may refer the Constitution Court to [a matter concerning] the unconstitutionality of any legislative or regulatory act.
In addition, he may refer the Constitutional Court to [a matter], by the procedure of the exception of unconstitutionality invoked in a matter concerning him before a jurisdiction.
That [jurisdiction] stays [its] decision and refers the Constitutional Court to [it], all [other] matters ceasing. (Art. 162) - FrenchLa Cour constitutionnelle est juge de l’exception d’inconstitutionnalité soulevée devant ou par une juridiction.

4. The Constitutional Court of Georgia shall in accordance with the procedures established by the organic law:
a) review the constitutionality of a normative act with respect to the fundamental human rights enshrined in Chapter Two of the Constitution on the basis of a claim submitted by a natural person, a legal person or the Public Defender;
b) make decisions on the constitutionality of a normative act on the basis of a claim submitted by the President of Georgia, by at least one fifth of the Members of Parliament, or by the Government;
c) on the basis of a submission by a common court, review the constitutionality of a normative act to be applied by the common court when hearing a particular case, and which may contravene the Constitution according to a reasonable assumption of the court;
d) review disputes about the competences of a respective body on the basis of a claim submitted by the President of Georgia, Parliament, the Government, the High Council of Justice, the General Prosecutor, the Board of National Bank, the General Auditor, the Public Defender or the supreme representative or executive body of an autonomous republic;
e) review the constitutionality of international treaties on the basis of a claim submitted by the President of Georgia, the Government, or by at least one fifth of the Members of Parliament;
f) review the constitutionality of activities of a political party, or of the termination of powers of a member of the representative body elected upon nomination by this political party, on the basis of a claim submitted by the President of Georgia, the Government, or by at least one fifth of the Members of Parliament;
g) review the constitutionality of Parliament's decision to acknowledge or prematurely terminate the powers of a Member of Parliament, on the basis of a claim submitted by at least one fifth of the Members of Parliament or the respective individual;
h) review disputes related to norms regulating referendums or elections, and the constitutionality of referendums and elections held or to be held based on these norms, on the basis of a claim submitted by the President of Georgia, by at least one fifth of the Members of Parliament, or by the Public Defender;
i) review the constitutionality of a normative act with respect to Chapter Nine of the Constitution on the basis of a claim submitted by the representative body of a local self-government;
j) exercise other powers determined by the Constitution.

გ) საერთო სასამართლოს წარდგინების საფუძველზე იხილავს იმ ნორმატიული აქტის კონსტიტუციურობის საკითხს, რომელიც კონკრეტული საქმის განხილვისას უნდა გამოიყენოს საერთო სასამართლომ და რომელიც მისი საფუძვლიანი ვარაუდით შეიძლება ეწინააღმდეგებოდეს კონსტიტუციას;
დ) საქართველოს პრეზიდენტის, პარლამენტის, მთავრობის, იუსტიციის უმაღლესი საბჭოს, გენერალური პროკურორის, ეროვნული ბანკის საბჭოს, გენერალური აუდიტორის, სახალხო დამცველის ან ავტონომიური რესპუბლიკის უმაღლესი წარმომადგენლობითი ან აღმასრულებელი ორგანოს სარჩელის საფუძველზე იხილავს დავას შესაბამისი ორგანოს უფლებამოსილების შესახებ;
ე) საქართველოს პრეზიდენტის ან მთავრობის სარჩელის, პარლამენტის წევრთა არანაკლებ ერთი მეხუთედის სარჩელის ან წარდგინების საფუძველზე იხილავს საერთაშორისო ხელშეკრულების კონსტიტუციურობის საკითხს;
ვ) საქართველოს პრეზიდენტის, პარლამენტის წევრთა არანაკლებ ერთი მეხუთედის ან მთავრობის სარჩელის საფუძველზე იხილავს პოლიტიკური პარტიის საქმიანობის კონსტიტუციურობისა და ამ პოლიტიკური პარტიის წარდგენით არჩეული წარმომადგენლობითი ორგანოს წევრის უფლებამოსილების შეწყვეტის საკითხს;
ზ) პარლამენტის წევრთა არანაკლებ ერთი მეხუთედის ან შესაბამისი პირის სარჩელის საფუძველზე იხილავს პარლამენტის წევრის უფლებამოსილების ცნობის ან ვადამდე შეწყვეტის შესახებ პარლამენტის გადაწყვეტილების კონსტიტუციურობის საკითხს;
თ) საქართველოს პრეზიდენტის, პარლამენტის წევრთა არანაკლებ ერთი მეხუთედის ან სახალხო დამცველის სარჩელის საფუძველზე იხილავს რეფერენდუმის ან არჩევნების მომწესრიგებელი ნორმისა და ამ ნორმის საფუძველზე ჩასატარებელი ან ჩატარებული რეფერენდუმის ან არჩევნების კონსტიტუციურობასთან დაკავშირებულ დავას;
ი) ადგილობრივი თვითმმართველობის წარმომადგენლობითი ორგანოს სარჩელის საფუძველზე იხილავს ნორმატიული აქტის კონსტიტუციურობას კონსტიტუციის მეცხრე თავთან მიმართებით;
კ) ახორციელებს კონსტიტუციით განსაზღვრულ სხვა უფლებამოსილებებს.

- EnglishThe Constitutional Court is the jurisdiction given the charge of seeing to respect for the provisions of the Constitution.
The Constitutional Court judges the regularity of the referendum consultations, [and] of the presidential, legislative and senatorial elections. It decides on the challenges to these consultations and elections.
It is the judge of the constitutionality of the laws.
The laws may, before their promulgation, be deferred to the Constitutional Court by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate, the President of High Authority of Audiovisuals and of Communications [Haute Autorité de l'Audiovisuel et de la Communication], the President of the Economic and Social Council, the President of the National Commission of the Rights of Man, the President of the Superior Council of the Magistrature, the Mediator of the Republic, the presidents of the parliamentary groups or one-fifth (1/5) of the members of the National Assembly or of the Senate.
To the same ends, the organic laws, before their promulgation, the internal regulations of the National Assembly and of the Senate, those of the High Authority of Audiovisuals and of Communications, [those] of the Economic and Social Council [those] of the National Commission of the Rights of Man, [and those] of the Superior Council of the Magistrature must be submitted to it before their application.
The Constitutional Court may be referred to [the matter] of a demand for [its] opinion on the meaning of the constitutional provisions by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate, the President of High Authority of Audiovisuals and of Communications, the President of the Economic and Social Council, the President of the National Commission of the Rights of Man, the President of the Superior Council of the Magistrature, the Mediator of the Republic and the presidents of the parliamentary groups.
An organic law determines the other authorities and juridical [morale] persons who can refer the Constitutional Court [to matters], in matters of protection of fundamental rights.
In the course of a judicial instance, any physical or juridical person may, in limine litis, before the courts and tribunals, raise the pleadings [exception] of the unconstitutionality of a law. In this case, the jurisdiction suspends its decision and refers [the matter] to the constitutional court. … (Art. 104) - FrenchLa Cour constitutionnelle est la juridiction chargée de veiller au respect des dispositions de la Constitution.
La Cour constitutionnelle juge de la régularité des consultations référendaires, des élections présidentielles, législatives et sénatoriales. Elle statue sur le contentieux de ces consultations et élections.

- EnglishThe Constitutional Court shall have the following powers:
a) to adjudicate on the constitutionality of laws, before the promulgation thereof upon notification by the President of Romania, one of the presidents of the two Chambers, the Government, the High Court of Cassation and Justice, the Advocate of the People, a number of at least 50 deputies or at least 25 senators, as well as ex officio, on initiatives to revise the Constitution;
b) to adjudicate on the constitutionality of treaties or other international agreements, upon notification by one of the presidents of the two Chambers, a number of at least 50 deputies or at least 25 senators;
c) to adjudicate on the constitutionality of the Standing Orders of Parliament, upon notification, by the president of either Chamber, by a parliamentary group or a number of at least 50 Deputies or at least 25 Senators;
d) to decide on objections as to the unconstitutionality of laws and ordinances, brought up before courts of law or commercial arbitration; the objection as to the unconstitutionality may also be brought up directly by the Advocate of the People;
e) to solve legal disputes of a constitutional nature between public authorities, at the request of the President of Romania, one of the presidents of the two Chambers, the Prime Minister, or of the president of the Superior Council of Magistracy;
f) to guard the observance of the procedure for the election of the President of Romania and to confirm the ballot returns;
g) to ascertain the circumstances which justify the interim in the exercise of the office of President of Romania, and to report its findings to Parliament and the Government; h) to give advisory opinion on the proposal to suspend from office the President of Romania;
l) to guard the observance of the procedure for the organization and holding of a referendum, and to confirm its returns;
j) to check on compliance with the conditions for the exercise of the legislative initiative by citizens;
k) to decide on the objections of unconstitutionality of a political party;
l) to carry out also other duties stipulated by the organic law of the Court. (Art. 146) - RomanianCurtea Constituţională are următoarele atribuţii:
a) se pronunţă asupra constituţionalităţii legilor, înainte de promulgarea acestora, la sesizarea Preşedintelui României, a unuia dintre preşedinţii celor două Camere, a Guvernului, a Înaltei Curţi de Casaţie şi Justiţie, a Avocatului Poporului, a unui număr de cel puţin 50 de deputaţi sau de cel puţin 25 de senatori, precum şi, din oficiu, asupra iniţiativelor de revizuire a Constituţiei;
b) se pronunţă asupra constituţionalităţii tratatelor sau altor acorduri internaţionale, la sesizarea unuia dintre preşedinţii celor două Camere, a unui număr de cel puţin 50 de deputaţi sau de cel puţin 25 de senatori;
c) se pronunţă asupra constituţionalităţii regulamentelor Parlamentului, la sesizarea unuia dintre preşedinţii celor două Camere, a unui grup parlamentar sau a unui număr de cel puţin 50 de deputaţi sau de cel puţin 25 de senatori;
d) hotărăşte asupra excepţiilor de neconstituţionalitate privind legile şi ordonanţele, ridicate în faţa instanţelor judecătoreşti sau de arbitraj comercial; excepţia de neconstituţionalitate poate fi ridicată şi direct de Avocatul Poporului;
e) soluţionează conflictele juridice de natură constituţională dintre autorităţile publice, la cererea Preşedintelui României, a unuia dintre preşedinţii celor două Camere, a primului-ministru sau a preşedintelui Consiliului Superior al Magistraturii;
f) veghează la respectarea procedurii pentru alegerea Preşedintelui României şi confirmă rezultatele sufragiului;
g) constată existenţa împrejurărilor care justifică interimatul în exercitarea funcţiei de Preşedinte al României şi comunică cele constatate Parlamentului şi Guvernului;
h) dă aviz consultativ pentru propunerea de suspendare din funcţie a Preşedintelui României;
i) veghează la respectarea procedurii pentru organizarea şi desfăşurarea referendumului şi confirmă rezultatele acestuia;
j) verifică îndeplinirea condiţiilor pentru exercitarea iniţiativei legislative de către cetăţeni;
k) hotărăşte asupra contestaţiilor care au ca obiect constituţionalitatea unui partid politic;
l) îndeplineşte şi alte atribuţii prevăzute de legea organică a Curţii. (Art. 146)

(1) Judges, in the performance of their function, shall be independent and, in decision making shall be bound by the Constitution, by constitutional law, by international treaty pursuant to Art. 7, paras. 2 and 5, and by law.
(2) If a Court assumes that other generally binding legal regulation, its part, or its individual provisions which concern a pending matter contradicts the Constitution, constitutional law, international treaty pursuant to Art. 7, para. 5 or law, it shall suspend the proceedings and shall submit a proposal for the commence of proceedings according to Art. 125, para. 1. Legal opinion of the Constitutional Court of the Slovak Republic contained in the decision shall be binding for the Court. (Art. 144) - Slovak
(1) Sudcovia sú pri výkone svojej funkcie nezávislí a pri rozhodovaní sú viazaní ústavou, ústavným zákonom, medzinárodnou zmluvou podľa čl. 7 ods. 2 a 5 a zákonom.
(2) Ak sa súd domnieva, ţe iný všeobecne záväzný právny predpis, jeho časť alebo jeho jednotlivé ustanovenie, ktoré sa týka prejednávanej veci, odporuje ústave, ústavnému zákonu, medzinárodnej zmluve podľa čl. 7 ods. 5 alebo zákonu, konanie preruší a podá návrh na začatie konania na základe čl. 125 ods. 1. Právny názor ústavného súdu obsiahnutý v rozhodnutí je pre súd záväzný. (Čl. 144)
