- EnglishAll persons have the right to an action of amparo in order to demand before the courts, for themselves or by those who act in their name, immediate protection of their fundamental rights, not protected by habeas corpus, when they are violated or threatened by the action or omission of any public authority or of individuals, in order put into effect the fulfillment of a law or administrative act and in order to guarantee collective and diffuse rights and interests. In accordance with the law, the proceeding is preferential, summary, oral, public, free, and not subject to formalities.

b. The writ of habeas corpus shall remain available and exercisable at all times and shall not be suspended on account of any state of emergency. However, in case of invasion of the territory, [of] grave disturbance of the peace, of activities against the security of the State or of public calamity, the State can suspend the full force of the rights referred to in Articles 5, 6, 9, 26, 33, paragraph one of Article 35, paragraph two of Article 38 and paragraph two of Article 116.
On determining [concurrir] the existence of any of the cases indicated in the paragraph above, the President of the Republic will make the appropriate declaration by means of a decree dictated by the Council of Ministers and the provisions of the Law of Public Order [Ley de Orden Público] will be applied. In a state of prevention [estado de prevención], this formality will not be necessary.
The decree will specify:
a. The motives that justify it;
b. The rights that may not be fully assured;
c. The territory that it affects; and
d. The time that its validity will last.
Furthermore, within the decree itself, the Congress will be convoked, so that within a term of three days, it may take cognizance of the document, ratify it, amend it, or disapprove it. If the Congress is in session, it must take cognizance of it immediately.
The effects of the decree may not exceed thirty days on each occasion. If before the expiration of this deadline the causes motivating the decree should no longer apply, its effects will be terminated for this reason and any citizen will have the right to seek its revision. Should the 30-day deadline be reached, the full validity of the rights will automatically be reestablished, unless a new decree in the same sense is dictated. When Guatemala faces a real state of war, the decree will not be subject to the time limits mentioned in the previous paragraph.
Once the causes that motivated the decree referred to in this Article should no longer apply, any person will have the right to infer the legal responsibilities that are consequent, for unnecessary acts and measures unauthorized by the Law of Public Order. (Art. 138) - SpanishEs obligación del Estado y de las autoridades, mantener a los habitantes de la Nación, en el pleno goce de los derechos que la Constitución garantiza. Decreto especificará:
a) Los motivos que lo justifiquen;
b) Los derechos que no puedan asegurarse en su plenitud;
c) El territorio que afecte; y
d) El tiempo que durará su vigencia.
Además, en el propio decreto, se convocará al Congreso, para que dentro del término de tres días, lo conozca, lo ratifique, modifique o impruebe. En caso de que el Congreso estuviere reunido, deberá conocerlo inmediatamente.
Los efectos del decreto no podrán exceder de treinta días por cada vez. Si antes de que venza el plazo señalado, hubieren desaparecido las causas que motivaron el decreto, se le hará cesar en sus efectos y para este fin, todo ciudadano tiene derecho a pedir su revisión. Vencido el plazo de treinta días, automáticamente queda reestablecida la vigencia plena de los derechos, salvo que se hubiere dictado nuevo decreto en igual sentido. Cuando Guatemala afronte un estado real de guerra, el decreto no estará sujeto a las limitaciones de tiempo, consideradas en el párrafo anterior.
Desaparecidas las causas que motivaron el decreto a que se refiere este artículo, toda persona tiene derecho a deducir las responsabilidades legales procedentes, por los actos innecesarios y medidas no autorizadas por la Ley de Orden Público. (Art. 138)

- English1. In situations of particular danger, if ordinary constitutional measures are inadequate, any of the following appropriate extraordinary measures may be introduced: martial law, a state of emergency or a state of natural disaster.
2. Extraordinary measures may be introduced only by regulation, issued upon the basis of statute, and which shall additionally require to be publicized.
3. The principles for activity by organs of public authority as well as the degree to which the freedoms and rights of persons and citizens may be subject to limitation for the duration of a period requiring any extraordinary measures shall be established by statute.
4. A statute may specify the principles, scope and manner of compensating for loss of property resulting from limitation of the freedoms and rights of persons and citizens during a period requiring introduction of extraordinary measures.
5. Actions undertaken as a result of the introduction of any extraordinary measure shall be proportionate to the degree of threat and shall be intended to achieve the swiftest restoration of conditions allowing for the normal functioning of the State.
6. During a period of introduction of extraordinary measures, the following shall not be subject to change: the Constitution, the Acts on Elections to the Sejm, the Senate and organs of local self-governments, the Act on Elections to the Presidency, as well as statutes on extraordinary measures.
7. During a period of introduction of extraordinary measures, as well as within the period of 90 days following its termination, the term of office of the Sejm may not be shortened, nor may a nationwide referendum, nor elections to the Sejm, Senate, organs of local self-government nor elections for the Presidency be held, and the term of office of such organs shall be appropriately prolonged. Elections to organs of local self-government shall be possible only in those places where the extraordinary measures have not been introduced. (Art. 228) - Polish1. 2. Stan nadzwyczajny może być wprowadzony tylko na podstawie ustawy, w drodze rozporządzenia, które podlega dodatkowemu podaniu do publicznej wiadomości.
3. Zasady działania organów władzy publicznej oraz zakres, w jakim mogą zostać ograniczone wolności i prawa człowieka i obywatela w czasie poszczególnych stanów nadzwyczajnych, określa ustawa.
4. Ustawa może określić podstawy, zakres i tryb wyrównywania strat majątkowych wynikających z ograniczenia w czasie stanu nadzwyczajnego wolności i praw człowieka i obywatela.
5. Działania podjęte w wyniku wprowadzenia stanu nadzwyczajnego muszą odpowiadać stopniowi zagrożenia i powinny zmierzać do jak najszybszego przywrócenia normalnego funkcjonowania państwa.
6. W czasie stanu nadzwyczajnego nie mogą być zmienione: Konstytucja, ordynacje wyborcze do Sejmu, Senatu i organów samorządu terytorialnego, ustawa o wyborze Prezydenta Rzeczypospolitej oraz ustawy o stanach nadzwyczajnych.
7. W czasie stanu nadzwyczajnego oraz w ciągu 90 dni po jego zakończeniu nie może być skrócona kadencja Sejmu, przeprowadzane referendum ogólnokrajowe, nie mogą być przeprowadzane wybory do Sejmu, Senatu, organów samorządu terytorialnego oraz wybory Prezydenta Rzeczypospolitej, a kadencje tych organów ulegają odpowiedniemu przedłużeniu. Wybory do organów samorządu terytorialnego są możliwe tylko tam, gdzie nie został wprowadzony stan nadzwyczajny. (Art. 228)
