- English(1) The fundamental rights and freedoms recognized in this Chapter4 shall always be respected in the making and application of the law. Likewise, they must be respected by all individuals and private organisations, as well as by every state institution and state official as they carry out their official functions.
(2) It is the responsibility of the state not only to ensure it does not violate rights through its actions, but also to take reasonable steps to protect the rights of the people from abuse by others.
(3) The rights recognized in this Chapter may be limited only by a law as provided for in Article 38. - EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. 2. The law may only restrict rights, freedoms and guarantees in cases expressly provided for in the Constitution, and such restrictions must be limited to those needed to safeguard other constitutionally protected rights and interests.
3. Laws that restrict rights, freedoms and guarantees must have a general and abstract nature and may not have a retroactive effect or reduce the extent or scope of the essential content of the constitutional precepts. (Art. 18) - Portuguese1. Os preceitos constitucionais respeitantes aos direitos, liberdades e garantias são directamente aplicáveis e vinculam as entidades públicas e privadas.
2. A lei só pode restringir os direitos, liberdades e garantias nos casos expressamente previstos na Constituição, devendo as restrições limitar-se ao necessário para salvaguardar outros direitos ou interesses constitucionalmente protegidos.
3. As leis restritivas de direitos, liberdades e garantias têm de revestir carácter geral e abstracto e não podem ter efeito retroactivo nem diminuir a extensão e o alcance do conteúdo essencial dos preceitos constitucionais. (Art. 18)
