The right to create political parties is recognized and guaranteed.
The political parties may not be founded on a religious, linguistic, racial, gender, corporatist or regional basis.
This right may never be invoked to infringe the fundamental freedoms, the [fundamental] values and the fundamental components of the national identity, of the national unity, the security and the integrity of the national territory, the independence of the country and the sovereignty of the people as well as the democratic and republican character of the State.
The political parties may not resort to partisan propaganda concerning the elements mentioned in the previous paragraph.
The State assures an equitable treatment vis-à-vis all the political parties.
All obedience of political parties, under whatever form it may be, to foreign interests or parties, is proscribed.
No political party may resort to violence or to constraint, whatever the nature or the forms of these.
The administration must abstain from any practice of a nature to contravene this right.
The political parties may only be dissolved by virtue of a decision of justice.
An organic law determines the modalities of creation of the political parties and must not include provisions of a nature to question the freedom of their creation. (Art. 57) - Arabic
حقّ إنشاء الأحزاب السّياسيّة معترَف به ومضمون.
لا يجوز تأسيس الأحزاب السّياسيّة على أساس دينيّ أو لغويّ أو عرقيّ أو جنسيّ أو مهنيّ أو جهويّ.
لا يمكن التّذرّع بهذا الحقّ لضرب الحرّيّات الأساسيّة، والقيم والمكوّنات الأساسيّة للهوّيّة الوطنيّة، والوحدة الوطنيّة، وأمن التّراب الوطنيّ وسلامته، واستقلال البلاد، وسيادة الشّعب، وكذا الطّابع الدّيمقراطيّ والجمهوريّ للدّولة.
لا يجوز للأحزاب السّياسيّة اللّجوء إلى الدّعاية الحزبيّة الّتي تقوم على العناصر المبيّنة في الفقرة السّابقة.
تضمن الدولة معاملة منصفة تجاه كل الأحزاب السياسية.
يُحظَر على الأحزاب السّياسيّة كلّ شكل من أشكال التّبعيّة للمصالح أو الجهات الأجنبيّة.
لا يجوز أن يلجأ أيّ حزب سياسيّ إلى استعمال العنف أو الإكراه مهما كانت طبيعتهما أوشكلهما.
يجب على الإدارة أن تمتنع عن كل ممارسة تحول بطبيعتها دون ممارسة هذا الحق.
لا تحل الأحزاب السياسية إلاّ بمقتضى قرار قضائي.
يحدد قانون عضوي كيفيات إنشاء الأحزاب السياسية، ويجب أن لا يتضمن أحكاما من شأنها المساس بحرية إنشائها. (المــادة 57) - French
Le droit de créer des partis politiques est reconnu et garanti.
Les partis politiques ne peuvent être fondés sur une base religieuse, linguistique, raciale, de sexe, corporatiste ou régionale.
Ce droit ne peut toutefois être invoqué pour attenter aux libertés fondamentales, aux valeurs et aux composantes fondamentales de l'identité nationale, à l'unité nationale, à la sécurité et à l'intégrité du territoire national, à l'indépendance du pays et à la souveraineté du peuple ainsi qu'au caractère démocratique et républicain de l’Etat.
Les partis politiques ne peuvent recourir à la propagande partisane portant sur les éléments mentionnés à l'alinéa précédent.
L’Etat assure un traitement équitable à l’égard de tous les partis politiques.
Toute obédience des partis politiques, sous quelque forme que ce soit, à des intérêts ou parties étrangers, est proscrite.
Aucun parti politique ne peut recourir à la violence ou à la contrainte, quelles que soient la nature ou les formes de celles-ci.
L’administration doit s’abstenir de toute pratique de nature à entraver ce droit.
Les partis politiques ne peuvent être dissous qu’en vertu d’une décision de justice.
Une loi organique détermine les modalités de création des partis politiques et ne doit pas comporter de dispositions de nature à remettre en cause la liberté de leur création. (Art. 57)
