Status of the Constitution

The fundamental rights must be respected within the whole [ensemble] of the juridical, administrative and institutional order. The Constitution is the supreme law. The legislative, the executive and the judicial [powers] must have it respected. Any law not in conformity with the Constitution is struck down as null [frappé de nullité]. (Art. 48)

Amateka ngenderwako ategerezwa kwubahirizwa mu bisata vyose vy’ubutungane, vy’intwaro hamwe n’inzego zose z’igihugu. Ibwirizwa shingiro ni ryo risumba ayandi yose kandi urwego nshingamateka, urwego nshikiranganji n’urwego rw’amasentare zitegerezwa kuryisunga. Ibwirizwa ryose riteye kubiri n’iri Bwirizwa shingiro riba imfagusa. (Ingingo ya 48)

Les droits fondamentaux doivent être respectés dans l’ensemble de l’ordre juridique, administratif et institutionnel. La Constitution est la loi suprême. Le législatif, l’exécutif et le judiciaire doivent la faire respecter. Toute loi non conforme à la Constitution est frappée de nullité. (Art. 48)
Status of the Constitution

When the Constitutional Court, referred to [the matter] by the President of the Republic, the President of the National Assembly, the President of the Senate, a quarter of the members of the National Assembly or of the Senate, has declared that an international engagement contains a clause contrary to the Constitution, the authorization to ratify this engagement may only intervene after amendment or revision of the Constitution. (Art. 283)

Lorsque la Cour Constitutionnelle, saisie par le Président de la République, le Président de l’Assemblée Nationale, le Président du Sénat, un quart des membres de l’Assemblée Nationale ou du Sénat, a déclaré qu’un engagement international comporte une clause contraire à la Constitution, l’autorisation de ratifier cet engagement ne peut intervenir qu’après amendement ou révision de la Constitution. (Art. 283)
