Status of the Constitution
- English1. Sovereignty shall rest with the people who shall exercise it in accordance with the forms and under the terms foreseen in the Constitution.
2. The State shall be subordinate to the Constitution, shall be based on the democratic legality, and shall respect as well as enforce the laws.
3. The laws and other acts of the state, of the local government and of public entities in general shall only be valid if they are in conformity with the Constitution. (Art. 3) - Portuguese1. A soberania pertence ao povo, que a exerce pelas formas e nos termos previstos na Constituição.
2. O Estado subordina-se à Constituição e funda-se na legalidade democrática, devendo respeitar e fazer respeitar as leis.

Status of the Constitution
- English1. The rules and resolutions of a normative or of a specific and concrete content that violate the provisions of the Constitution or the principles therein enshrined shall be unconstitutional.
2. The organic or formal unconstitutionality of international treaties or agreements that deal with matters falling within the jurisdiction reserved to the National Assembly or within the legislative power of the Government shall not impair the application of the rules of such treaties and agreements in the Cabo Verdean legal order, in case they are confirmed by the Government and approved by the National Assembly by a two-third majority of the Deputies present in the first plenary session following the date of the publication of the court’s decision.
3. Once the irregularity is resolved and if, by virtue of it, the international treaty or agreement has not been ratified, the President of the Republic shall be authorized to ratify it. 2. A inconstitucionalidade orgânica ou formal dos tratados ou acordos internacionais que versem matérias da competência reservada da Assembleia Nacional ou da competência legislativa do Governo não impede a aplicação das suas normas na ordem jurídica cabo-verdiana, desde que sejam confirmados pelo Governo e aprovados pela Assembleia Nacional por maioria de dois terços dos deputados presentes, na primeira reunião plenária seguinte à data da publicação da decisão do Tribunal.
3. Sanado o vício e se, em virtude deste, o tratado ou acordo internacional não tiver sido ratificado, o Presidente da República fica autorizado a ratificá-lo. (Art. 277)
Status of the Constitution
- English1. If the Constitutional Court rules in favor of the unconstitutionality of a rule contained in an international treaty or agreement, the latter must not be ratified by the President of the Republic, who shall return it to the organ that had approved it.
2. An international treaty or agreement that contains a rule declared to be unconstitutional may be ratified by the President of the Republic if the National Assembly, in consulting the Government, confirms its approval by a majority of two thirds of the Deputies in full exercise of their functions.
3. If the Constitutional Court rules in favor of the unconstitutionality of a rule contained in any legislative act, the instrument must be vetoed by the President of the Republic and returned to the organ that had approved it.
4. In the case foreseen in paragraph 3, the legislative act may not be promulgated unless the organ that had approved it expurgates therefrom the rule judged unconstitutional or, where appropriate, confirms it by a two-thirds majority of Deputies in full exercise of their functions. Se o Tribunal Constitucional se pronunciar pela inconstitucionalidade da norma constante de tratado ou acordo internacional, este não deve ser ratificado pelo Presidente da República, sendo devolvido ao órgão que o tiver aprovado.
2. O tratado ou acordo internacional de que conste a norma declarada inconstitucional pode ser ratificado pelo Presidente da República se a Assembleia Nacional, ouvido o Governo, confirmar a sua aprovação por maioria de dois terços dos Deputados em efectividade de funções.
3. Se o Tribunal Constitucional se pronunciar pela inconstitucionalidade de norma constante de qualquer acto legislativo, deve o diploma ser vetado pelo Presidente da República e devolvido ao órgão que o tiver aprovado.
4. No caso previsto no número 3 o acto legislativo não pode ser promulgado sem que o órgão que o tiver aprovado o expurgue da norma julgada inconstitucional ou, quando for caso disso, o confirme por maioria de dois terços dos Deputados em efectividade de funções. (Art. 279)
