Status of the Constitution

    There is no excuse of ignorance of the law.
    All persons are required to respect the Constitution and to comply with the laws of the Republic. (Art. 62)

    Toute personne est tenue de respecter la Constitution et de se conformer aux lois de la République. (Art. 62)
Status of the Constitution

    The orders of the Constitutional Court are not susceptible to any recourse and are immediately executory. They are obligatory and [are] imposed on the public powers, on all the administrative, and jurisdictional, [and] civil and military authorities as well as on individuals.
    Any act declared non-conforming to the Constitution is null[,] of right. (Art. 168)

    Les arrêts de la Cour constitutionnelle ne sont susceptibles d’aucun recours et sont immédiatement exécutoires. Ils sont obligatoires et s’imposent aux pouvoirs publics, à toutes les autorités administratives et juridictionnelles, civiles et militaires ainsi qu’aux particuliers.
    Tout acte déclaré non conforme à la Constitution est nul de plein droit. (Art. 168)

    The customary authority is recognized.
    It is devolved conforming to local custom, provided that it is not contrary to the Constitution, to the law, to public order and to good morals.

Status of the Constitution

    If the Constitutional Court consulted by the President of the Republic, by the Prime Minister, the President of the National Assembly or the President of the Senate, by a tenth of the Deputies or a tenth of the Senators, declares that an international treaty or agreement includes a clause contrary to the Constitution, the ratification or approval may only intervene after the revision of the Constitution. (Art. 216)

    Si la Cour constitutionnelle consultée par le Président de la République, par le Premier ministre, le Président de l’Assemblée nationale ou le Président du Sénat, par un dixième des députés ou un dixième des sénateurs, déclare qu’un traité ou accord international comporte une clause contraire à la Constitution, la ratification ou l’approbation ne peut intervenir qu’après la révision de la Constitution. (Art. 216)
Status of the Constitution

    Provided that they are not contrary to this Constitution, the legislative and regulatory texts in force continue to maintain it until their abrogation or their modification. (Art. 221)

    Pour autant qu’ils ne soient pas contraires à la présente Constitution, les textes législatifs et réglementaires en vigueur restent maintenus jusqu’à leur abrogation ou leur modification. (Art. 221)
