Limitations and/or Derogations
- EnglishThe human being has [the] right to the free development of his personality. He has [the] right to life and to physical and moral integrity; no one may be subjected to torture, to pain [peines] or to cruel, inhuman or degrading treatments.
No one is required to execute a manifestly illegal order.
The law determines the order manifestly illegal.
No one may take advantage [se prévaloir] of a received order or of an instruction to justify acts of torture, abuse [sévices] or cruel, inhuman or degrading treatments committed in the exercise or on the occasion of the exercise of their functions.
No situation of exception or of emergency should [ne doit] justify the violations of human rights. (Art. 6) - FrenchL'être humain a droit au libre développement de sa personnalité. Il a droit la vie et à l'intégrité physique et morale. Nul ne peut être l'objet de tortures, de peines ou de traitements cruels, inhumains ou dégradants.
Nul n'est tenu d'exécuter un ordre manifestement illégal.
La loi détermine l'ordre manifestement illégal.
Nul ne peut se prévaloir d'un ordre reçu ou d'une instruction pour justifier des actes de tortures, de sévices ou de traitements cruels, inhumains ou dégradants commis dans l'exercice ou à l'occasion de l'exercice de ses fonctions.
Aucune situation d'exception ou d'urgence ne doit justifier les violations des droits humains. (Art. 6)

- EnglishThe law guarantees to all the exercise of the fundamental freedoms and rights. It determines the conditions in which they are exercised.
It may only establish[,] concerning these freedoms and these rights, those limits that are indispensable to maintain the public order and democracy.
… (Art. 24) - FrenchLa loi garantit à tous l'exercice des libertés et des droits fondamentaux. Elle détermine les conditions dans lesquelles ils s'exercent.
Elle ne peut fixer de limites à ces libertés et à ces droits que celles qui sont indispensables au maintien de l'ordre public et de la démocratie.

Limitations and/or Derogations
- EnglishUnder reserve of the provisions of Article 51, the National Assembly alone votes the law and controls the governmental action.
The law establishes the rules concerning:
- the guarantees of the freedoms, [and] of the fundamental rights, the conditions within which they are exercised and the limitations that may be brought [portées] to them;
… (Art. 72) - FrenchSous réserve des dispositions de l'article 51, l'Assemblée nationale vote seule la loi et contrôle l'action gouvernementale.
La loi fixe les règles concernant :
- les garanties des libertés, des droits fondamentaux, les conditions dans lesquelles ils s'exercent et les limitations qui peuvent y être portées ;
