Status of the Constitution
- EnglishIf the Constitutional Council, referred to [the matter] by the President of the Republic[,] or by the President of the National Assembly[,] or by one-third (1/3) of the Deputies, has declared that an international engagement includes a clause contrary to the Constitution, the authorization to ratify it or to approve it can only intervene after revision of the Constitution. (Art. 79)
- Arabicإذا أعلن المجلس الدستوري، بناء على طلب من رئيس الجمهورية أو رئيس الجمعية الوطنية أو ثلث (1/3) النواب ، أن التزاما دوليا يتضمن بندا مخالفا للدستور، توقف الترخيص في تصديق هذا البند أو الموافقة عليه ما لم تقع مراجعة للدستور (المادّة 79)
- FrenchSi le Conseil Constitutionnel saisi par le Président de la République ou par le Président de l'Assemblée Nationale ou par le tiers des députés a déclaré qu'un engagement international comporte une clause contraire à la Constitution, l'autorisation de la ratifier ou de l'approuver ne peut intervenir qu'après révision de la Constitution. (Art. 79)
Status of the Constitution
- EnglishA provision declared unconstitutional may not be promulgated or implemented.
The decisions of the Constitutional Council are invested with the authority of a judged matter.
The decisions of the Constitutional Council are not susceptible to any recourse. They impose themselves on the public powers and on all the administrative and jurisdictional authorities. (Art. 87) - Arabicلا يصدر أو ينفذ حكم أقر المجلس الدستوري عدم دستوريته
تتمتع قرارات المجلس الدستوري بسلطة الشيء المقضي به.
لا يقبل أي طعن في قرارات المجلس الدستوري، وهي ملزمة للسلطات العمومية وجميع السلطات الإدارية والقضائية. (المادّة 87) - FrenchUne disposition déclarée inconstitutionnelle ne peut être promulguée ni mise en application.
Les décisions du Conseil Constitutionnel sont revêtues de l'autorité de la chose jugée.
Les décisions du Conseil Constitutionnel ne sont susceptibles d'aucun recours. Elles s'imposent aux pouvoirs publics et à toutes les autorités administratives et juridictionnelles. (Art. 87)
Status of the Constitution
- EnglishThe legislation and the regulations in force in the Islamic Republic of Mauritania continue to be applicable as long as they have not been modified, in the forms specified in the Constitution.
The laws prior to the Constitution must be modified, if it applies, to render them in conformity with the constitutional rights and freedoms within a time period not exceeding three years counting from the date of promulgation of this Constitutional Law.
In case that the modifications provided for in the preceding paragraph are not adopted [apportées] in the prescribed times, any individual can refer [déférer] these laws to the Constitutional Council for examination of their constitutionality. The provisions declared unconstitutional may not be applied. (Art. 102) - Arabicيستمرّ العمل بالقوانين والنظم القائمة بالجمهورية الإسلامية الموريتانية ما لم تعدل طبقا للشكل المنصوص عليه في الدستور.
تعدل القوانين السابقة للدستور عند الاقتضاء من أجل مطابقتها مع الحقوق والحريات الدستورية في أجل لا يتعدى ثلاث (3) سنوات اعتبارا من تاريخ إصدار هذا القانون الدستوري.
وفي حالة عدم إجراء التعديلات المقررة في الفقرة السابقة في الآجال المحددة، يجوز لأي شخص أن يطعن بعدم دستورية هذه القوانين أمام المجلس الدستوري. ولا يمكن تطبيق الترتيبات المحكوم بعدم دستوريتها. (المادّة 102) - FrenchLa législation et la réglementation en vigueur en République islamique de Mauritanie restent applicables tant qu’elles n’ont pas été modifiées, dans les formes prévues par la Constitution.
Les lois antérieures à la Constitution doivent être modifiées, s’il y a lieu, pour les rendre conformes aux droits et libertés constitutionnels, dans un délai n’excédant pas trois (3) ans pour compter de la date de promulgation de la présente loi constitutionnelle.
Au cas où les modifications prévues à l'alinéa précédent ne sont pas apportées dans les délais prescrits, tout individu pourra déférer ces lois au Conseil constitutionnel pour examen de leur constitutionnalité. Les dispositions déclarées inconstitutionnelles ne peuvent être appliquées. (Art. 102)
