Constitution of the Republic of Tunisia 2014
Head of State
- EnglishThe President of the Republic is the Head of State and the symbol of its unity. He guarantees its independence and continuity, and ensures respect of the Constitution. (Art. 72)

Head of State
- EnglishEvery male and female voter who holds Tunisian nationality since birth, whose religion is Islam shall have the right to stand for election to the position of President of the Republic.
On the day of filing the application for candidacy, the candidate must be at least 35 years old.
If the candidate has a nationality other than the Tunisian nationality, he or she must submit an application committing to abandon the other nationality if elected president.
The candidate must have the support of a number of members of the Assembly of the Representatives of the People or heads of elected local authority councils, or of registered voters, as specified by the election law. (Art. 74) - Arabicالترشّح لمنصب رئيس الجمهورية حقّ لكل ناخبة أو ناخب تونسي الجنسية منذ الولادة، دينه الإسلام.
يشترط في المترشّح يوم تقديم ترشحه أن يكون بالغا من العمر خمسا وثلاثين (35) سنة على الأقل.
وإذا كان حاملا لجنسية غير الجنسية التونسية فإنه يقدّم ضمن ملف ترشحه تعهدا بالتخلّي عن الجنسية الأخرى عند التّصريح بانتخابه رئيسا للجمهورية.
تشترط تزكية المترشح من قبل عدد من أعضاء مجلس نواب الشعب أو رؤساء مجالس الجماعات المحلية المنتخبة أو الناخبين المرسمين حسبما يضبطه القانون الانتخابي. (الفصل 74) - FrenchLa candidature à la présidence de la République est un droit pour toute électrice ou tout électeur de nationalité tunisienne par la naissance et de confession musulmane.
Le candidat doit être âgé de 35 ans au moins au jour du dépôt de sa candidature. S’il est titulaire d’une nationalité autre que la nationalité tunisienne, il doit inclure dans son dossier de candidature, un engagement de renoncer à l’autre nationalité dès après la proclamation de son élection en tant que Président de la République.
Le candidat est présenté par un nombre de membres de l’Assemblée des représentants du peuple, de présidents de conseils de collectivités locales élues ou d’électeurs inscrits, et ce, conformément à la loi électorale. (Art. 74)
Head of State

Government
- EnglishThe government shall be composed of a Head of Government, Ministers, and secretaries of state selected by the Head of Government, and in the case of the Ministers of Foreign Affairs and Defence, in consultation with the President of the Republic.
Within one week of the declaration of the definitive election results, the President of the Republic shall ask the candidate of the party or the electoral coalition which won the largest number of seats in the assembly of the Representatives of the People to form a government, within a one month period, extendable once. If two or more parties or coalitions have the same number of seats, then the party or coalition having received the largest number of votes shall be asked to form a government. …
Should the government thus gain the confidence of the Assembly, the President of the Republic shall appoint the Head of Government and the members of the government. … (Art. 89) - Arabicتتكون الحكومة من رئيس ووزراء وكتاب دولة يختارهم رئيس الحكومة وبالتشاور مع رئيس الجمهورية بالنسبة لوزارتيْ الخارجية والدفاع في أجل أسبوع من الإعلان عن النتائج النهائية للانتخابات، يكلف رئيس الجمهورية، مرشح الحزب أو الائتلاف الانتخابي المتحصل على أكبر عدد من المقاعد بمجلس نواب الشعب، بتكوين الحكومة خلال شهر يجدد مرة واحدة. وفي صورة التساوي في عدد المقاعد يُعتمد للتكليف عدد الأصوات المتحصل عليها.
عند تجاوز الأجل المحدد دون تكوين الحكومة، أو في حالة عدم الحصول على ثقة مجلس نواب الشعب، يقوم رئيس الجمهورية في أجل عشرة أيام بإجراء مشاورات مع الأحزاب والائتلافات والكتل النيابية لتكليف الشخصية الأقدر من أجل تكوين حكومة. ... (الفصل 89) - FrenchLe Gouvernement se compose du Chef du Gouvernement, de ministres et de secrétaires d’État choisis par le Chef du Gouvernement, et en concertation avec le Président de la République en ce qui concerne les ministères des Affaires étrangères et de la Défense.
Dans un délai d’une semaine suivant la proclamation des résultats définitifs des élections, le Président de la République charge le candidat du parti politique ou de la coalition électorale ayant obtenu le plus grand nombre de sièges au sein de l’Assemblée des représentants du peuple de former le Gouvernement dans un délai d’un mois renouvelable une seule fois. En cas d’égalité du nombre de sièges, il est tenu compte pour la désignation, du nombre de voix obtenues.
... Dans le cas où le Gouvernement obtient la confiance de l’Assemblée, le Président de la République procède sans délai à la nomination du Chef du Gouvernement et de ses membres. … (Art. 89)
