Obligations of the State
  • English
    I. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
    II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
    III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
    IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13)

    I. The international treaties and instruments in matters of human rights that have been signed and/or ratified, or those that have been joined by the State, which declare rights more favorable than those contained in the Constitution, shall have preferential application over those in this Constitution.
    II. The rights recognized in the Constitution shall be interpreted in agreement with international human rights treaties when the latter provide more favorable norms. (Art. 256)

    I. Los tratados e instrumentos internacionales en materia de derechos humanos que hayan sido firmados, ratificados o a los que se hubiera adherido el Estado, que declaren derechos más favorables a los contenidos en la Constitución, se aplicarán de manera preferente sobre ésta.

Obligations of Private Parties

    I. Persons who violate constitutional rights are subject to the jurisdiction and competence of the Bolivian authorities.
    II. The intellectual and material perpetrators of violations of constitutional rights are to be held responsible.
    III. The immediate perpetrators of attacks against personal security are to be held liable, and are not excused from liability for having committed them under orders of superiors. (Art. 110)

    I. Victims of violations of their rights are granted the right to timely indemnification, reparation and compensation for damages and prejudices.
    II. In the event that a sentence requires the State to repair damages and prejudices, it shall interpose the same action against the authority or public servant responsible for the act or omission that caused the damage. (Art. 113)

    I. The Popular Action shall be filed during the period in which the violation or threat to the rights and collective interests continues. To file this action it is not necessary to exhaust the judicial or administrative processes that might exist.
    II. Any person, in his or her individual name or on behalf of a collective, may file this action, and it shall be filed obligatorily by the Public Ministry and the Public Defender (Ministerio Público y el Defensor del Pueblo) when, in the exercise of their functions, they have knowledge of these acts. The procedure for the Action for Constitutional Protection shall be applied. (Art. 136)

    I. The Public Defender (Defensor del Pueblo) shall oversee the enforcement, promotion, dissemination of and compliance with human rights, both individual and collective, that are established in the Constitution, laws and international instruments. The function of the Public Defender shall extend to the administrative activity of the entire public sector and the activity of private institutions that provide public services.
    II. The Public Defender shall also promote the defense of the rights of the nations and rural native indigenous peoples, of urban and intercultural communities, and of Bolivians who are abroad.
    III. The Public Defender is an institution with operational, financial and administrative autonomy, in accordance with the law. Its functions shall be governed by the principles of free services, accessibility, swiftness and solidarity. In the exercise of its functions it does not receive instructions from the organs of the State. (Art. 218)

La Defensoría del Pueblo velará por la vigencia, promoción, difusión y cumplimiento de los derechos humanos, individuales y colectivos, que se establecen en la Constitución, las leyes y los instrumentos internacionales. La función de la Defensoría alcanzará a la actividad administrativa de todo el sector público y a la actividad de las instituciones privadas que presten servicios públicos.
    II. Corresponderá asimismo a la Defensoría del Pueblo la promoción de la defensa de los derechos de las naciones y pueblos indígena originario campesinos, de las comunidades urbanas e interculturales, y de las bolivianas y los bolivianos en el exterior.
    III. La Defensoría del Pueblo es una institución con autonomía funcional, financiera y administrativa, en el marco de la ley. Sus funciones se regirán bajo los principios de gratuidad, accesibilidad, celeridad y solidaridad. En el ejercicio de sus funciones no recibe instrucciones de los órganos del Estado. (Art. 218)

    The powers of the Office of the Public Defender, in addition to those established in the Constitution and the law, are the following:
    1. To file actions of Unconstitutionality, of Liberty, of Constitutional Protection, of Protection of Privacy, Popular actions, actions for Compliance and the direct appeal of nullity, without the requirement of having a mandate.
    2. To present bills and modifications of laws, decrees and non-judicial resolutions in matters of its competence.
    3. To investigate, on its own or at the request of a party, the acts or omissions that imply violations of rights, individual and collective, that are established in the Constitution, laws and international instruments, and request that the Public Ministry initiate the corresponding legal actions.
    4. To request information from the authorities and public servants with respect to the investigations that the Public Defender is carrying out, to which no objection may be posed.
    5. To formulate recommendations, reminders of legal duties, and suggestions for the immediate adoption of corrective measures for all the organs and institutions of the State, and to issue public censure for acts or behavior contrary to these formulations.
    6. To have free access to the center of detention and prisons, to which no one may pose an objection.
    7. To exercise its functions without interruption of any kind, even in the case of a declaration of a state of emergency.
    8. To attend to the persons who request its services promptly and without discrimination.
    9. To draft the regulations needed for the exercise of its functions. (Art. 222)

    Son atribuciones de la Defensoría del Pueblo, además de las que establecen la Constitución y la ley:
    1. Interponer las acciones de Inconstitucionalidad, de Libertad, de Amparo Constitucional, de Protección de Privacidad, Popular, de Cumplimiento y el recurso directo de nulidad, sin necesidad de mandato.
    2. Presentar proyectos de ley y proponer modificaciones a leyes, decretos y resoluciones no judiciales en materia de su competencia.
    3. Investigar, de oficio o a solicitud de parte, los actos u omisiones que impliquen violación de los derechos, individuales y colectivos, que se establecen en la Constitución, las leyes y los instrumentos internacionales, e instar al Ministerio Público al inicio de las acciones legales que correspondan.
    4. Solicitar a las autoridades y servidores públicos información respecto a las investigaciones que realice la Defensoría del Pueblo, sin que puedan oponer reserva alguna.
    5. Formular recomendaciones, recordatorios de deberes legales, y sugerencias para la inmediata adopción de correctivos y medidas a todos los órganos e instituciones del Estado, y emitir censura pública por actos o comportamientos contrarios a dichas formulaciones.
    6. Acceder libremente a los centros de detención e internación, sin que pueda oponerse objeción alguna.
    7. Ejercer sus funciones sin interrupción de ninguna naturaleza, aun en caso de declaratoria de estado de excepción.
    8. Asistir con prontitud y sin discriminación a las personas que soliciten sus servicios.
    9. Elaborar los reglamentos necesarios para el ejercicio de sus funciones. (Art. 222)
