The State recognizes the existence of the indigenous and Afro-descendant Peoples, who enjoy the rights, duties and guarantees consigned in the Constitution[,] and especially, those to maintain and develop their identity and culture, to have their own forms of social organization and to administer their local affairs; as well as to maintain the communal forms of ownership of their lands and the enjoyment, use and yields [disfrute] [of them], all in accordance with the law. ...
The different forms of property: public, private, associative, cooperative, community, communal, familiar and mixed must be guaranteed and stimulated without discrimination to produce wealth and all of these within their free functioning must fulfill a social function.

The right of private ownership [propiedad] of movable and immovable assets [bienes], and of the instruments and means of production[,] is guaranteed.

The State recognizes the communal forms of land ownership of the Communities of the Caribbean Coast. It equally recognizes the enjoyment, use and benefit of the waters and forests of these communal lands. (Art. 89)

The State guarantees the forms of public, private, cooperative, associative, communitarian, communal, family and mixed ownership [propiedad]; all of them form part of the mixed economy, are subordinate to the superior social interests of the nation and fulfill a social function, all [of them] will have the same rights and prerogatives in accordance with the juridical norms[,] and the legal domain and possession of any of these forms of ownership will not be disturbed. Except [in] the cases in which the laws on the matter so provide. (Art. 103)

The Agrarian Reform is the fundamental instrument for the democratization of ownership [propiedad] and the just distribution of the land; it is a means that constitutes an essential part for the global promotion and strategy of the ecological reconstruction and the sustainable economic development of the country. The Agrarian Reform shall take into account the socially necessary land-man relation; also[,] ownerships are guaranteed to the peasants [campesinos] benefiting from it, in accordance with the law. (Art. 106)

The Agrarian Reform will eliminate the idle latifundios [large estates] and will be made by priority with lands of the State. When the expropriation of idle latifundios affects private owners [proprietarios], it will be fulfilled within that stipulated in Article 44 of this Constitution. The Agrarian Reform shall eliminate any form of exploitation of the peasants, and of the indigenous communities of the country and shall promote forms of ownership compatible with the economic and social objectives of the Nation, established in this Constitution. The regime of ownership of the indigenous communities will be regulated in accordance with the law on the matter. (Art. 107)

The ownership of the land to all those holders [proprietarios] who productively and efficiently work it[,] is guaranteed. The law will establish specific [particulares] regulations and exceptions, in accordance with the goals and objectives of agrarian reform. (Art. 108)

The communities of the Caribbean Coast have the inalienable right to live and to develop themselves under the political-administrative, social and cultural form of organization that correspond to their historic and cultural traditions.

The State guarantees to these communities the benefits of their natural resources, the effectiveness of their forms of community ownership and the free election of their authorities and representatives.
