Status of the Constitution

All civil, penal, financial, economic, administrative, cultural, military, political, and other laws and regulations must be based on Islamic criteria. This principle applies absolutely and generally to all articles of the Constitution as well as to all other laws and regulations, and the fuqaha' of the Guardian Council shall determine this matter. (Art. 4)

کلیه قوانین و مقررات مدنی، جزایی، مالی، اقتصادی، اداری، فرهنگی، نظامی، سیاسی و غیر اینها باید براساس موازین اسلامی باشد. این اصل بر اطلاق یا عموم همه اصول قانون اساسی و قوانین و مقررات دیگر حاکم است و تشخیص این امر بر عهده فقهاء شورای نگهبان است. (اصل 4)
Status of the Constitution

The Islamic Consultative Assembly cannot enact laws contrary to the official religion of the country or to the Constitution. It is the duty of the Guardian Council to determine whether a violation has occurred, in accordance with Article 96. (Art. 72)

مجلس شورای اسلامی نمی‌تواند قوانینی وضع کند که با اصول و احکام مذهب رسمی کشور یا قانون اساسی مغایرت داشته باشد. تشخیص این امر به ترتیبی که در اصل نود و ششم آمده برعهده شورای نگهبان است. (اصل 72)
