Status of the Constitution

    If a court finds that a provision conflicts with a rule of fundamental law or other superior statute, the provision shall not be applied. The same applies if a procedure laid down in law has been disregarded in any important respect when the provision was made.
    In the case of review of an act of law under paragraph one, particular attention must be paid to the fact that the Riksdag is the foremost representative of the people and that fundamental law takes precedence over other law. (Instrument of Government, Chapter 11, Art. 14)

    Finner en domstol att en föreskrift står i strid med en bestämmelse i grundlag eller annan överordnad författning får föreskriften inte tillämpas. Detsamma gäller om stadgad ordning i något väsentligt hänseende har åsidosatts vid föreskriftens tillkomst.
    Vid prövning enligt första stycket av en lag ska det särskilt beaktas att riksdagen är folkets främsta företrädare och att grundlag går före lag. (Kungörelse (1974:152) om beslutad ny regeringsform, 11 kap, 14§)

Reference to Chapter 2, Article 22, para. 1 "A draft law under Article 20 shall be held in abeyance, unless rejected by the Riksdag, for a minimum of twelve months from the date on which the first Riksdag committee report on the proposal was submitted to the Chamber, if so moved by at least ten members. The Riksdag may, however, adopt the proposal directly if it has the support of at least five sixths of those voting. ..."
