- EnglishThe following are recognized as forms of property:
a. Socialist property of the entire population: in which the State acts as a representative and beneficiary of the people as property owner.
b. Cooperative property: that which is sustained through the collective labor of partner owners and through the effective exercise of the principles of cooperativism.
c. Property of political, social, and mass organizations: ownership that they exercise over their goods designed to fulfill their roles.
d. Private ownership: that which is exercised over specific means of production by natural or legal persons, Cubans or foreigners; with a complementary role in the economy.
e. Mixed property: that which is formed through the combination of two or more forms of ownership.
f. Institutional and associative property: that which these groups exercise over their goods for non-profit purposes.
g. Personal property: that which is exercised over one's belongings that, without constituting means of production, contribute to the satisfaction of the material and spiritual necessities of their owner.
All forms of ownership over means of production interact in similar ways; the State regulates and monitors the way in which they contribute to economic and social development.
The exercise and attainment of these forms of ownership are regulated by the law. (Art. 22) - SpanishSe reconocen como formas de propiedad, las siguientes:
a) socialista de todo el pueblo: en la que el Estado actúa en representación y beneficio de aquel como propietario;
b) cooperativa: la sustentada en el trabajo colectivo de sus socios propietarios y en el ejercicio efectivo de los principios del cooperativismo;
c) de las organizaciones políticas, de masas y sociales: la que ejercen estos sujetos sobre los bienes destinados al cumplimiento de sus fines;
d) privada: la que se ejerce sobre determinados medios de producción por personas naturales o jurídicas cubanas o extranjeras; con un papel complementario en la economía;
e) mixta: la formada por la combinación de dos o más formas de propiedad;
f) de instituciones y formas asociativas: la que ejercen estos sujetos sobre sus bienes para el cumplimiento de fines de carácter no lucrativo;
g) personal: la que se ejerce sobre los bienes que, sin constituir medios de producción, contribuyen a la satisfacción de las necesidades materiales y espirituales de su titular.
Todas las formas de propiedad sobre los medios de producción interactúan en similares condiciones; el Estado regula y controla el modo en que contribuyen al desarrollo económico y social.
La ley regula lo relativo al ejercicio y alcance de las formas de propiedad. (Art. 22)

- EnglishIndigenous communes, communities, peoples and nations are recognized and guaranteed, in conformity with the Constitution and human rights agreements, conventions, declarations and other international instruments, the following collective rights:

4. To keep ownership, without subject to a statute of limitations, of their community lands, which shall be unalienable, immune from seizure and indivisible. These lands shall be exempt from paying fees or taxes.
5. To keep ownership of ancestral lands and territories and to obtain free awarding of these lands.
6. To participate in the use, usufruct, administration and conservation of natural renewable resources located on their lands.

The territories of the peoples living in voluntary isolation are an irreducible and intangible ancestral possession and all forms of extractive activities shall be forbidden there. The State shall adopt measures to guarantee their lives, enforce respect for self-determination and the will to remain in isolation and to ensure observance of their rights. The violation of these rights shall constitute a crime of ethnocide, which shall be classified as such by law.
The State shall guarantee the enforcement of these collective rights without any discrimination, in conditions of equality and equity between men and women. Los territorios de los pueblos en aislamiento voluntario son de posesión ancestral irreductible e intangible, y en ellos estará vedada todo tipo de actividad extractiva. El Estado adoptará medidas para garantizar sus vidas, hacer respetar su autodeterminación y voluntad de permanecer en aislamiento, y precautelar la observancia de sus derechos. La violación de estos derechos constituirá delito de etnocidio, que será tipificado por la ley.
El Estado garantizará la aplicación de estos derechos colectivos sin discriminación alguna, en condiciones de igualdad y equidad entre mujeres y hombres. (Art. 57)

Procedures to be followed for obtaining this purpose, and the definition of boundaries within which private appropriation of land is prohibited, shall be regulated by law. (Art. 127)

- EnglishThe predominance of large land estates is contrary to the interests of society. Appropriate tax law provisions shall be enacted to tax fallow lands and establish the necessary measures to transform them into productive economic units, likewise recovering arable land. Farmers and other agricultural producers are entitled to own land, in the cases and forms specified under the pertinent law. The State shall protect and promote associative and private forms of property in such manner as to guarantee agricultural production. The State shall see to the sustainable ordering of arable land to guarantee its food producing potential. … (Art. 307)

La ley dispondrá lo conducente en materia tributaria para gravar las tierras ociosas y establecerá las medidas necesarias para su transformación en unidades económicas productivas, rescatando igualmente las tierras de vocación agrícola. Los campesinos o campesinas y demás productores o productoras agropecuarios tienen derecho a la propiedad de la tierra, en los casos y formas especificados por la ley respectiva.
