1. The cases in which a state of emergency, as defined by Act of Parliament, may be declared by Royal Decree in order to maintain internal or external security shall be specified by Act of Parliament. The consequences of such a declaration shall be governed by Act of Parliament.
2. Such a declaration may depart from the provisions of the Constitution relating to the powers of the executive bodies of the provinces, municipalities, public bodies as referred to in Article 132a and water authorities (waterschappen), the basic rights laid down in Article 6, insofar as the exercise of the right contained in this Article other than in buildings and enclosed places is concerned, Articles 7, 8, 9 and 12, paragraphs 2 and 3, Article 13 and Article 113, paragraphs 1 and 3.

The declaration of the state of emergency shall not, in any case, suspend the guarantees of rights, nor the fundamental rights, the right of due process, the right to information and the rights of persons deprived of liberty. (1) Obligations can only be imposed:
a) by the law or on the basis of a law, within its limits and in the respect of fundamental rights and liberties.
b) by international agreement according to art. 7, paragr. 4, which directly determines the rights and obligations of physical and legal persons, or
c) by directive of the Government according to art. 119, paragr. 2.
(2) Limitation of fundamental rights and freedoms shall be imposed only under the conditions set forth in this Constitution.
(3) Restrictions of constitutional rights and freedoms shall be applied equally and consistently in all similar cases.
(4) When imposing restrictions on constitutional rights and freedoms, respect must be given to the essence and meaning of these rights and freedoms and such restrictions shall be used only for specifically defined purposes. (Art. 13) - Slovak

a) zákonom alebo na základe zákona, v jeho medziach a pri zachovaní základných práv a slobôd,
b) medzinárodnou zmluvou podľa čl. 7 ods. 4, ktorá priamo zakladá práva a povinnosti fyzických osôb alebo právnických osôb, alebo
c) nariadením vlády podľa čl. 120 ods. 2.
(2) Medze základných práv a slobôd moţno upraviť za podmienok ustanovených touto ústavou len zákonom.

- English1. Rights and freedoms of an individual and citizen may be limited only by law and only to the extent necessary for the protection of the constitutional system, defense of public order, human rights and freedoms, and the health and morality of the population.
2. Any acts capable of violating inter-ethnic and inter-religious harmony shall be recognized as unconstitutional.
3. Restriction of the rights and freedoms of citizens for political reasons shall not be allowed in any form. The rights and freedoms provided for by articles 11, 13–15, paragraph 1 of article 16, article 17, article 19, article 22, paragraph 2 of article 26 of the Constitution, are not subject to limitation in any case. - EnglishThe President of the Republic shall be entitled to decree a State of Exception throughout the country's territory or in part of this territory in the event of aggression, international or domestic armed conflict, severe domestic unrest, public calamity or natural disaster. The declaration of a State of Exception shall not interrupt the activities of the State's duties.
The State of Exception shall observe the principles of needs, proportionality, legality, temporariness, territoriality and reasonableness. The decree establishing the State of Exception shall indicate its cause and motivation, territorial scope of application, period of duration, measures that must be applied, the rights that can be suspended or restricted and the notifications that correspond, in accordance with the Constitution and international treaties.
