They are formed by legal, de facto, or emotional ties, and are based on the equality of rights, duties, and opportunities of its members.

Marriage and stable common law unions are protected by the State; they rest on the voluntary agreement of the man and the woman and may be dissolved by the mutual consent or by the will of one of the parties. The law will regulate this matter. (Art. 72)

- English1. Everyone has the right to form a family and to marry under conditions of full equality.
2. The law shall regulate the requisites for and the effects of marriage and its dissolution by death or divorce, regardless of the form in which it was entered into.
3. Spouses have equal rights and duties in relation to their civil and political capacity and to the maintenance and education of their children.
4. Children born outside wedlock may not be the object of any discrimination for that reason, and neither the law, nor official departments or services may employ discriminatory terms in relation to filiation.
5. Parents have the right and the duty to educate and maintain their children.
6. Children may not be separated from their parents, save when the latter do not fulfil their fundamental duties towards them, and then always by judicial decision.
7. Adoption shall be regulated and protected in accordance with the law, which must lay down swift forms for completion of the respective procedural requirements. (Art. 36) - Portuguese1. Todos têm o direito de constituir família e de contrair casamento em condições de plena igualdade.
2. A lei regula os requisitos e os efeitos do casamento e da sua dissolução, por morte ou divórcio, independentemente da forma de celebração.

- EnglishTo protect the rights of persons who are members of a family:
1. Responsible motherhood and fatherhood shall be fostered; and the mother and father shall be obliged to take care, raise, educate, feed, and provide for the integral development and protection of the rights of their children, especially when they are separated from them for any reason.
2. Unseizable family assets are recognized in terms of amount and on the basis of the conditions and limitations provided for by law. The right to give in legacy and inherit is recognized.
3. The State shall guarantee the equality of rights in decision making for the administration of the marital partnership and the joint ownership of assets.
4. The State shall protect mothers, fathers and those who are the heads of family, in the exercise of their obligations and shall pay special attention to families who have broken up for whatever reason.
5. The State shall promote the joint responsibility of both mother and father and shall monitor fulfillment of the mutual duties and rights between mothers, fathers, and children.
6. Daughters and sons shall have the same rights, without any consideration given to kinship or adoption background.
7. No declaration of the quality of the kinship shall be required at the time of registering the birth and no identity document shall refer to the type of kinship. (Art. 69) - SpanishPara proteger los derechos de las personas integrantes de la familia:

- EnglishMotherhood of the working woman is protected. The pregnant woman may not be separated from her public or private employment for this reason. For a minimum of six weeks prior to confinement and eight weeks thereafter, she is entitled to rest with the same remuneration that she was receiving, and her job shall be kept for her, as well as all the rights inherent to her contract. Upon returning to work, the mother may not be dismissed for one year, except in special cases prescribed by law, which shall in addition, regulate the special working conditions of the pregnant woman. Durante un mínimo de seis semanas precedentes al parto y las ocho que le siguen, gozará de descanso forzoso retribuido del mismo modo que su trabajo y conservará el empleo y todos los derechos correspondientes a su contrato. It shall equally protect the life of the mother and the life of the unborn from conception.
