- EnglishThe King, Commander of the Faithful [Amir Al Mouminine], sees to the respect for Islam. He is the Guarantor of the free exercise of beliefs [cultes].
He presides over the Superior Council of the Ulema [Conseil superieur des Oulema], charged with the study of questions that He submits to it.
The Council is the sole instance enabled [habilitee] to comment [prononcer] on the religious consultations (Fatwas) before being officially agreed to, on the questions to which it has been referred [saisi] and this, on the basis of the tolerant principles, precepts and designs of Islam.
The attributions, the composition and the modalities of functioning of the Council are established by Dahir [Royal Decree].
The King exercises by Dahirs the religious prerogatives inherent in the institution of the Emirate of the Faithful [Imarat Al Mouminine] which are conferred on Him in exclusive manner by this Article. يرأس الملك، أمير المؤمنين، مجلس العلماء الأعلى، الذي يتولّى دراسة القضايا التي يعرضها عليه.
ويعتبر المجلس الجهة الوحيدة المؤهلة لإصدار الفتاوى التي تعتمد رسميا، في شأن المسائل المحالة إليه، استنادا إلى مبادئ وأحكام الدين الإسلامي الحنيف، ومقاصده السمحة.

Customary Law
- EnglishThe customary and traditional rules governing the matrimonial regimes and inheritance may only be applicable with the consent of the parties concerned.
In default of consent, the national law alone is applicable.
It is the same in case of conflict between two [2] or more customary rules. (Art. 162) - Arabicلا يمكن تطبيق القواعد العرفية والتقليدية التي تحكم أنظمة الزواج والإرث إلا بموافقة الأطراف المعنية.
في غياب الموافقة، يكون القانون الوطني الوحيد الواجب تطبيقه.
يطبق القانون نفسه في حالة وجود تعارض بين قاعدتين [2] عرفيتين أو أكثر. (المادة 162) - FrenchLes règles coutumières et traditionnelles régissant les régimes matrimoniaux et les successions ne peuvent s'appliquer qu'avec le consentement des parties concernées.
A défaut de consentement, la loi nationale est seule applicable.
Il en est de même en cas de conflit entre deux (2) ou plusieurs règles coutumières. (Art. 162)

The members of such groups shall have the right to exercise their beliefs, use their languages, observe their religions or customs, and raise their children in the framework of such cultures and customs. - EnglishUntil their codification, the customary and traditional rules are only applicable in the communities where they are recognized.
However, the customs contrary to the public order or those that promote inequality between citizens are prohibited. (Art. 161) - Arabicلا تنطبق القواعد العرفية والتقليدية في المجتمعات المحلية حيث يُعترف بها إلا عند تدوينها.
لكن تحظر الأعراف المتنافية مع النظام العام أو التي تعزز عدم المساواة بين المواطنين. (المادة 161) - FrenchJusqu'à leur codification, les règles coutumières et traditionnelles ne s'appliquent que dans les communautés où elles sont reconnues.
Toutefois, les coutumes contraires à l'ordre public ou celles qui prônent l'inégalité entre les citoyens sont interdites. (Art. 161)
