- EnglishBy the declaration of a state of assembly, the President of the Republic is enabled to suspend or restrict personal liberty, the right of assembly and the freedom to work. He can, also, restrict the exercise of the right of association, intercept, open, or record documents and all classes of communications, order [disponer] requisition of assets and establish limitations on the exercise of the right of ownership [propiedad].
By the declaration of a state of siege, the President of the Republic can restrict the freedom of movement and detain [arrestar] persons in their own homes or in places and which the laws determines that are neither jails nor those used for the detention or imprisonment of common criminals. He can also suspend or restrict the exercise of the right of assembly.
By the declaration of a state of catastrophe, the President of the Republic can restrict the freedoms of movement and of assembly. He can, also, order the requisition of assets, establish limitations on the exercise of the right of ownership and adopt all the extraordinary measures of administrative character necessary for the prompt re-establishment of normalcy in the affected zone.
By the declaration of a state of emergency, the President of the Republic can restrict the freedoms of movement and of assembly. (Art. 43) - SpanishPor la declaración del estado de asamblea, el Presidente de la República queda facultado para suspender o restringir la libertad personal, el derecho de reunión y la libertad de trabajo. Podrá, también, restringir el ejercicio del derecho de asociación, interceptar, abrir o registrar documentos y toda clase de comunicaciones, disponer requisiciones de bienes y establecer limitaciones al ejercicio del derecho de propiedad.
Por la declaración de estado de sitio, el Presidente de la República podrá restringir la libertad de locomoción y arrestar a las personas en sus propias moradas o en lugares que la ley determine y que no sean cárceles ni estén destinados a la detención o prisión de reos comunes. Podrá, además, suspender o restringir el ejercicio del derecho de reunión.
Por la declaración del estado de catástrofe, el Presidente de la República podrá restringir las libertades de locomoción y de reunión. Podrá, asimismo, disponer requisiciones de bienes, establecer limitaciones al ejercicio del derecho de propiedad y adoptar todas las medidas extraordinarias de carácter administrativo que sean necesarias para el pronto restablecimiento de la normalidad en la zona afectada.
Por la declaración del estado de emergencia, el Presidente de la República podrá restringir las libertades de locomoción y de reunión. (Art. 43)

1. Rights can be exercised, promoted and enforced individually or collectively before competent authorities; these authorities shall guarantee their enforcement.

3. The rights and guarantees set forth in the Constitution and in international human rights instruments shall be directly and immediately enforced by and before any civil, administrative or judicial servant, either by virtue of their office or at the request of the party.
For the exercise of rights and constitutional guarantees, no conditions or requirements shall be established other than those set forth in the Constitution or by law.
Rights shall be fully actionable. Absence of a legal regulatory framework cannot be alleged to justify their infringement or ignorance thereof, to dismiss proceedings filed as a result of these actions or to deny their recognition.
4. No legal regulation can restrict the contents of rights or constitutional guarantees.

- EnglishThe authorities of the Republic are established for the purpose of protecting the lives, honor and property of all nationals, wherever they may be, and of aliens who are under the Republic's jurisdiction, of ensuring the effectiveness of individual and social rights and duties, and of observing and enforcing the Constitution and the Law.
The rights and guarantees recognized by this Constitution must be considered as minimum standards which do not exclude others which are related to fundamental rights and the dignity of the individual. (Art. 17) - SpanishLas autoridades de la República están instituidas para proteger en su vida, honra y bienes a los nacionales dondequiera se encuentren y a los extranjeros que estén bajo su jurisdicción; asegurar la efectividad de los derechos y deberes individuales y sociales, y cumplir y hacer cumplir la Constitución y la Ley.

- EnglishIn the event of domestic disorder or foreign attack endangering the full enforcement of this Constitution and of the authorities hereby established, the province or territory which is in a turmoil shall be declared in state of siege and the constitutional guarantees shall be suspended therein. But during such a suspension the President of the Republic shall not pronounce judgment or apply penalties on his own. In such case, his power shall be limited, with respect to persons, to their arrest or transfer from one place of the Nation to another, should they not prefer to leave the Argentine territory. (Sec. 23)
- SpanishEn caso de conmoción interior o de ataque exterior que pongan en peligro el ejercicio de esta Constitución y de las autoridades creadas por ella, se declarará en estado de sitio la provincia o territorio en donde exista la perturbación del orden, quedando suspensas allí las garantías constitucionales. To suspend by a vote of no less than the two-thirds of the totality of its members, in the case of evident public necesity, the individual rights and guarantees written in Articles 22, 23, 24, 26, 28, 29, 30 and 37 of this Constitution. This suspension may be of all or of some rights and guarantees, for the totality or part of the territory, and [for] up to thirty days; during this, and with regard to persons, the Executive Power may only order their detention in establishments not allocated to common inmates, or decree their confinement to inhabited places. It must also give account to the Assembly at its next meeting on the measures taken to safeguard the public order or to maintain the security of the State.
In no case may individual rights and guarantees not written in this paragraph be suspended;

The validity of the declaration of the state of emergency shall depend on the subsequent approval of the Pluri-National Legislative Assembly, which shall take place as soon as circumstances permit, and in all cases, within seventy two hours following the declaration of the state of emergency. The approval of the declaration shall indicate the powers conferred, and it shall maintain strict relation and proportion to the case of necessity addressed by the state of emergency. In general, the rights consecrated in the Constitution shall not be suspended by the declaration of the state of emergency.
