- English[The following] are duties and attributions of the Constitutional Chamber:
1. to take cognizance [conocer] and to decide [resolver] on the unconstitutionality of the laws and of other normative instruments, declaring the inapplicability of the provisions contrary to this Constitution in each concrete case and in decision [fallo] that will only be effective in relation with that case, and
2. to decide on the unconstitutionality of the definitive or interlocutory sentences, declaring the nullity of those that result [as being] contrary to this Constitution.

1. To exercise the control of constitutionality of the laws that interpret any precept of the Constitution, of the constitutional organic laws and of the norms of a treaty which concern matters belonging to the latter, prior to their promulgation;
2. To resolve concerning the questions of constitutionality of the original decisions adopted by the Supreme Court, the Courts of Appeal and the Qualifying Tribunal of Elections;
3. To resolve the questions concerning constitutionality which arise during the processing of the Bills of law or of constitutional reform and of the treaties submitted to the approval of the Congress;
4. To resolve the questions which arise concerning the constitutionality of a decree with the force of law;
5. To resolve the questions which arise concerning the constitutionality [of] the convocation to a plebiscite, without prejudice to the attributions which correspond to the Qualifying Tribunal of Elections;
6. To resolve, by the majority of its members in office, [on] the inapplicability of a legal precept having application in any measure that is taken before an ordinary or special tribunal, [having a] result contrary to the Constitution;
7. To resolve, by the majority of four-fifths of its members in office, [on] the unconstitutionality of a legal precept declared inapplicable in conformity with that provided in the previous Numeral;
8. To resolve the complaints in case the President of the Republic does not promulgate a law when he should do so or [when] he promulgates a text different from that which constitutionally corresponds;
9. To resolve [the questions] concerning the constitutionality of a decree or resolution of the President of the Republic which the Office of the Comptroller General has objected to [representar] as[,] in its opinion [estimar][,] unconstitutional, when it is required by the President in conformity with Article 99;
10. To declare the unconstitutionality of the organizations and of the movements or political parties, as well as the responsibility of the persons who have participated in the acts which motivated the declaration of unconstitutionality, in conformity with that provided in the sixth, seventh and eighth paragraphs of Numeral 15 of Article 19 of this Constitution. However, if the affected person is the President of the Republic or the President-elect, the declaration referred to will require, also, the agreement of the Senate adopted by the majority of its members in office;
11. To report to the Senate in the cases to which Article 53, Numeral 7, of this Constitution, refers;
12. To resolve the conflicts of competence which arise between the political or administrative authorities and the tribunals of justice, which do not correspond to the Senate [to resolve];
13. To resolve concerning the constitutional or legal ineligibilities [inhabilidades] which affect a person [from] being appointed Minister of State, [from] remaining in that post, or [from] performing other functions simultaneously;
14. To decide concerning the ineligibilities, incompatibilities and grounds for cessation [of] the responsibilities of the parliamentarians;
15. To qualify the ineligibility invoked by a parliamentarian in the terms of the final paragraph of Article 60 and decide concerning the renunciation of the responsibilities, and
16. To resolve concerning the constitutionality of the supreme decrees, whatever the alleged defect may be, including those that may be issued in the exercise of the independent regulatory power of the President of the Republic, when they concern matters that may be reserved to the law by mandate of Article 63.
In the case of Numeral 1, the Chamber of origin will forward to the Constitutional Tribunal the respective Bill within the five days following the [day] on which it is totally processed by the Congress.3

1º.- Ejercer el control de constitucionalidad de las leyes que interpreten algún precepto de la Constitución, de las leyes orgánicas constitucionales y de las normas de un tratado que versen sobre materias propias de estas últimas, antes de su promulgación;
2º.- Resolver sobre las cuestiones de constitucionalidad de los autos acordados dictados por la Corte Suprema, las Cortes de Apelaciones y el Tribunal Calificador de Elecciones;

6°.- Resolver, por la mayoría de sus miembros en ejercicio, la inaplicabilidad de un precepto legal cuya aplicación en cualquier gestión que se siga ante un tribunal ordinario o especial, resulte contraria a la Constitución;
7º.- Resolver por la mayoría de los cuatro quintos de sus integrantes en ejercicio, la inconstitucionalidad de un precepto legal declarado inaplicable en conformidad a lo dispuesto en el numeral anterior;
8º.- Resolver los reclamos en caso de que el Presidente de la República no promulgue una ley cuando deba hacerlo o promulgue un texto diverso del que constitucionalmente corresponda;
9º.- Resolver sobre la constitucionalidad de un decreto o resolución del Presidente de la República que la Contraloría General de la República haya representado por estimarlo inconstitucional, cuando sea requerido por el Presidente en conformidad al artículo 99;
10°.- Declarar la inconstitucionalidad de las organizaciones y de los movimientos o partidos políticos, como asimismo la responsabilidad de las personas que hubieran tenido participación en los hechos que motivaron la declaración de inconstitucionalidad, en conformidad a lo dispuesto en los párrafos sexto, séptimo y octavo del Nº 15º del artículo 19 de esta Constitución. Sin embargo, si la persona afectada fuera el Presidente de la República o el Presidente electo, la referida declaración requerirá, además, el acuerdo del Senado adoptado por la mayoría de sus miembros en ejercicio;
11º.- Informar al Senado en los casos a que se refiere el artículo 53 número 7) de esta Constitución;
12º.- Resolver las contiendas de competencia que se susciten entre las autoridades políticas o administrativas y los tribunales de justicia, que no correspondan al Senado;
13º.- Resolver sobre las inhabilidades constitucionales o legales que afecten a una persona para ser designada Ministro de Estado, permanecer en dicho cargo o desempeñar simultáneamente otras funciones;
14º.- Pronunciarse sobre las inhabilidades, incompatibilidades y causales de cesación en el cargo de los parlamentarios;
15º.- Calificar la inhabilidad invocada por un parlamentario en los términos del inciso final del artículo 60 y pronunciarse sobre su renuncia al cargo, y
16°.- Resolver sobre la constitucionalidad de los decretos supremos, cualquiera sea el vicio invocado, incluyendo aquellos que fueren dictados en el ejercicio de la potestad reglamentaria autónoma del Presidente de la República cuando se refieran a materias que pudieran estar reservadas a la ley por mandato del artículo 63.
En el caso del número 1º, la Cámara de origen enviará al Tribunal Constitucional el proyecto respectivo dentro de los cinco días siguientes a aquél en que quede totalmente tramitado por el Congreso.

The Supreme Court of Justice of the Nation will take cognizance of, in the terms that the regulatory law specifies, the following matters:
I. Of the constitutional disputes [controversias] that, concerning the constitutionality of the general norms, acts or omissions, with the exception of those that refer to electoral matters, arise between:
a) The Federation and a federative entity;
b) The Federation and a municipality;
c) The Executive Power and the Congress of the Union; one or either of the Chambers of it or, in such case, the Permanent Commission;
d) One federative entity and another;

g) Two municipalities of different States;
h) Two Powers of one same federative entity;
i) One State and one of its municipalities;
j) One Federative Entity and one Municipality of another or one territorial demarcation of the City of Mexico;
k) Two autonomous constitutional organs [órganos] of one federative entity and between one of these and the Executive Power or the Legislative Power of that federative entity, and
l) Two federal autonomous constitutional organs, and between one of these and the Executive Power of the Union or the Congress of the Union.

II. Of the actions of unconstitutionality that have for their object to establish [plantear] the possible contradiction between a norm of general character and this Constitution.
The actions of unconstitutionality can be exercised, during the thirty natural days following the date of publication of the norm, by:
a) The equivalent of thirty-three percent of the members of the Chamber of Deputies of the Congress of the Union, against federal laws;
b) The equivalent of thirty-three percent of the members of the Senate, against the federal laws or international treaties celebrated by the Mexican State;
c) The Federal Executive, through [por conducto] the Juridical Councilor of the Government, against the general norms of federal character and of the federal entities;
d) The equivalent of thirty-three percent of the members of any of the Legislatures of the federative entities against the laws enacted by that same organ;

f) The political parties with registration before the National Electoral Institute, by [por conducto] their national directorships [dirigencias], against the federal or local electoral laws; and the political parties with registration in a federative entity, by [a través] their directorships, exclusively against the electoral laws enacted by the Legislature of the federative entity that granted the registration to them;
g) The National Commission of Human Rights, against laws of federal character or of the federative entities, as well as international treaties celebrated by the Federal Executive and approved by the Senate of the Republic, that make vulnerable the human rights consecrated in this Constitution and in the international treaties to which Mexico is party. Also the equivalent organs [organismos] of protection of human rights in the federative entities, against laws enacted by the Legislatures.
h) The guarantor organ [organismo] that Article 6 of this Constitution establishes against laws of federal and local character, as well as [against] international treaties celebrated by the Federal Executive and approved by the Senate of the Republic, which infringe [vulneren] the right of the access to public information and the protection of personal data. In the same way, the equivalent guarantor organs [organismos] in the federative entities, against laws enacted [expedidas] by the local Legislatures; and
i) The Attorney General of the Republic regarding federal laws and [laws] of the federative entities, in penal matters and [matters] of penal procedure, as well as those related to the domain [ámbito] of his functions;

La Suprema Corte de Justicia de la Nación conocerá, en los términos que señale la ley reglamentaria, de los asuntos siguientes:
I. De las controversias constitucionales que, sobre la constitucionalidad de las normas generales, actos u omisiones, con excepción de las que se refieran a la materia electoral, se susciten entre:
a) La Federación y una entidad federativa;
b) La Federación y un municipio;
c) El Poder Ejecutivo y el Congreso de la Unión; aquél y cualquiera de las Cámaras de éste o, en su caso, la Comisión Permanente;
d) Una entidad federativa y otra;

h) Dos Poderes de una misma entidad federativa;

l) Dos órganos constitucionales autónomos federales, y entre uno de éstos y el Poder Ejecutivo de la Unión o el Congreso de la Unión.

II. De las acciones de inconstitucionalidad que tengan por objeto plantear la posible contradicción entre una norma de carácter general y esta Constitución.
Las acciones de inconstitucionalidad podrán ejercitarse, dentro de los treinta días naturales siguientes a la fecha de publicación de la norma, por:
a) El equivalente al treinta y tres por ciento de los integrantes de la Cámara de Diputados del Congreso de la Unión, en contra de leyes federales;
b) El equivalente al treinta y tres por ciento de los integrantes del Senado, en contra de las leyes federales o de tratados internacionales celebrados por el Estado Mexicano;
c) El Ejecutivo Federal, por conducto del Consejero Jurídico del Gobierno, en contra de normas generales de carácter federal y de las entidades federativas;
d) El equivalente al treinta y tres por ciento de los integrantes de alguna de las Legislaturas de las entidades federativas en contra de las leyes expedidas por el propio órgano;

f) Los partidos políticos con registro ante el Instituto Nacional Electoral, por conducto de sus dirigencias nacionales, en contra de leyes electorales federales o locales; y los partidos políticos con registro en una entidad federativa, a través de sus dirigencias, exclusivamente en contra de leyes electorales expedidas por la Legislatura de la entidad federativa que les otorgó el registro;
g) La Comisión Nacional de los Derechos Humanos, en contra de leyes de carácter federal o de las entidades federativas, así como de tratados internacionales celebrados por el Ejecutivo Federal y aprobados por el Senado de la República, que vulneren los derechos humanos consagrados en esta Constitución y en los tratados internacionales de los que México sea parte. Asimismo, los organismos de protección de los derechos humanos equivalentes en las entidades federativas, en contra de leyes expedidas por las Legislaturas;
h) El organismo garante que establece el artículo 6° de esta Constitución en contra de leyes de carácter federal y local, así como de tratados internacionales celebrados por el Ejecutivo Federal y aprobados por el Senado de la República, que vulneren el derecho al acceso a la información pública y la protección de datos personales. Asimismo, los organismos garantes equivalentes en las entidades federativas, en contra de leyes expedidas por las Legislaturas locales; e
i) El Fiscal General de la República respect de leyes federales y de las entidades federativas, en materia penal y procesal penal, así como las relacionadas con el ámbito de sus funciones;

- EnglishAny person may seek amparo before the Constitutional Chamber of the Supreme Court of Justice for violation of the rights granted by this Constitution.
The habeas corpus may be sought before the Constitutional Chamber of the Supreme Court of Justice or before the Chambers of Second Instance that do not reside in the capital. The resolution of the Chamber that denies the freedom of the favored person [favorecido] may be the object of review [revisión], at the request of the interested party, by the Constitutional Chamber of the Supreme Court of Justice. (Art. 247) - SpanishToda persona puede pedir amparo ante la Sala de lo Constitucional de la Corte Suprema de Justicia por violación de los derechos que otorga la presente Constitución.
El habeas corpus puede pedirse ante la Sala de lo Constitucional de la Corte Suprema de Justicia o ante las Cámaras de Segunda Instancia que no residen en la capital. La resolución de la Cámara que denegare la libertad del favorecido podrá ser objeto de revisión, a solicitud del interesado, por la Sala de lo Constitucional de la Corte Suprema de Justicia. - EnglishAll of the judges of the Republic, within their respective spheres of competence and in accordance with the provisions of this Constitution and law, are obligated to ensure the integrity of the Constitution.
In the event of incompatibility between the Constitution and a law or other juridical provision, the provisions of the Constitution shall prevail, being the responsibility of the courts to rule accordingly in any case, even ex officio.
The Constitutional Division of the Supreme Tribunal of Justice, as court of constitutional competence, shall have the exclusive power to declare the nullity of laws and other acts of organs exercising Public Power which are issued by way of direct and immediate implementation of the Constitution or have the status of law. (Art. 334) - SpanishTodos los jueces o juezas de la República, en el ámbito de sus competencias y conforme a lo previsto en esta Constitución y en la ley, están en la obligación de asegurar la integridad de esta Constitución.
En caso de incompatibilidad entre esta Constitución y una ley u otra norma jurídica, se aplicarán las disposiciones constitucionales, correspondiendo a los tribunales en cualquier causa, aún de oficio, decidir lo conducente.
Corresponde exclusivamente a la Sala Constitucional del Tribunal Supremo de Justicia como jurisdicción constitucional, declarar la nulidad de las leyes y demás actos de los órganos que ejercen el Poder Público dictados en ejecución directa e inmediata de la Constitución o que tengan rango de ley, cuando colidan con aquella. (Art. 334)
