- EnglishAny person may file an initiative to start the procedure for the assessment of constitutionality and legality.
The procedure before the Constitutional Court for the assessment of constitutionality and legality may be initiated by the court, other state authority, local self-government authority and five Members of the Parliament.
The Constitutional Court itself may also initiate the procedure for the assessment of constitutionality and legality.
During the procedure, the Constitutional Court may order to stop the enforcement of an individual act or actions that have been taken on the basis of the law, other regulation or general act, the constitutionality, i.e. legality of which is being assessed, if the enforcement thereof could cause irreparable damage. Postupak pred Ustavnim sudom za ocjenu ustavnosti i zakonitosti može da pokrene sud, drugi državni organ, organ lokalne samouprave i pet poslanika.

- English1. In addition to the right of appeal accorded by section 47 of this Constitution, an appeal shall lie as of right to the Court of Appeal from decisions of the High Court in the following cases, that is to say:
a. subject to section 69 of this Constitution, final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution, including any such decision made on a reference to the High Court under section 128;
b. final decisions of the High Court in the determination of any question in respect of which a right of access to the High Court is guaranteed by section 17 of this Constitution and final decisions of the High Court under section 22 of this Constitution.

- EnglishWhen on the occasion of a pending legal proceeding before a jurisdiction, an exception of unconstitutionality is raised, the Constitutional Council may be referred to the matter on remand from the Court of Cassation.
If the provision is declared unconstitutional, the Constitutional Council returns it to the Parliament which decides sovereignly on the case. The new provision is promulgated. - English(1) An appeal shall lie to the Supreme Court from any judgment, decree or final order of a High Court in the territory of India, whether in a civil, criminal or other proceeding, if the High Court certifies under article 134A that the case involves a substantial question of law as to the interpretation of this Constitution.

The President of the Republic may ask the Constitutional Court to undertake the prior consideration of the constitutionality of any norm contained in an international treaty that is submitted to him for ratification, in any decree that is sent to him for enactment as a law or executive law, or in any international agreement, the decree approving which is sent to him for signature.

The laws prior to the Constitution must be modified, if it applies, to render them in conformity with the constitutional rights and freedoms within a time period not exceeding three years counting from the date of promulgation of this Constitutional Law.

Les lois antérieures à la Constitution doivent être modifiées, s’il y a lieu, pour les rendre conformes aux droits et libertés constitutionnels, dans un délai n’excédant pas trois (3) ans pour compter de la date de promulgation de la présente loi constitutionnelle.

- EnglishAmong the constitutional and legal functions of the Supreme Court of Justice shall be the following:
1. To guard the integrity of the Constitution. For this purpose, and after hearing the opinion of the Attorney General of the Nation or the Solicitor General of the Administration, the Court in plenary session shall try and rule on cases concerning the unconstitutionality of laws, decrees, decisions, resolutions and other acts that for reasons of substance or form are challenged before it, by any person.
When during the proceedings of a case, the public official entrusted with the administration of Justice considers, or it is observed by one of the parties, that the legal or regulatory provision applicable to the case is unconstitutional, he/she shall submit the question to the cognizance of the Court in plenary session, except when the provision has already been the subject of a decision, and shall order a continuance of the case, until the question of constitutionality is decided.
The parties only shall be able to formulate such observations one time during the process of a case;

1. The Constitutional Court is the highest judicial authority exercising constitutional review through constitutional litigation in order to protect the foundations of the constitutional order, fundamental human and civil rights and freedoms, and to ensure the supremacy and direct operation of the Constitution.
2. The Constitutional Court:
1) provides official interpretation of the Constitution;
2) adjudicate cases on the conformity of laws and other normative legal acts of the Kyrgyz Republic with the Constitution;
3) give an opinion on the constitutionality of international treaties to which the Kyrgyz Republic is a party that have not entered into force;
4) resolves disputes over competence between the branches of government;
5) give an opinion on a draft law amending and supplementing this Constitution;
6) give an opinion on the observance of the prescribed procedure for bringing charges against the President.
3. Everyone has the right to challenge the constitutionality of a law and other normative legal acts if he considers that they violate the rights and freedoms recognised by the Constitution.

6. Judicial decisions based on provisions of laws found to be unconstitutional shall be reviewed by the court on a case-by-case basis following complaints by citizens whose rights and freedoms have been affected.

1. Конституционный суд является высшим органом судебной власти, осуществляющим конституционный контроль посредством конституционного судопроизводства в целях защиты основ конституционного строя, основных прав и свобод человека и гражданина, обеспечения верховенства и прямого действия Конституции.

(1) The Constitutional Court shall decide on the conformity of negotiated international treaties to which the assent of the National Council of the Slovak Republic with the Constitution and constitutional law is necessary.
(2) The President of the Slovak Republic or the Government may submit a proposal for a decision pursuant to paragraph 1 to the Constitutional Court prior to the presentation of a negotiated international treaty for discussion of the National Council of the Slovak Republic.
