- English1. The following may apply to the Constitutional Court:
1) The National Assembly – in the cases stipulated by Point 12 of Article 168 of the Constitution; in the case stipulated by Point 7 of Article 168 of the Constitution – by a decision adopted by majority vote of the total number of parliamentarians, and in the case stipulated by Point 10 of Article 168 of the Constitution – by a decision adopted by at least a three-fifths majority vote of total number of parliamentarians;
2) At least one fifth of the total number of parliamentarians – in the cases stipulated by Point 1, 4, and 6 of Article 168 of the Constitution;
3) A faction of the National Assembly – for disputes related to decisions adopted with respect to the results of a referendum or the results of election of the President of the Republic;
4) The President of the Republic – in the cases stipulated by Part 1 of Article 129, Part 2 of Article 139, Article 150, or Points 1 and 4 of Article 168 of the Constitution;
5) The Government – in the cases stipulated by Point 1, 4, 8, and 12 of Article 168 of the Constitution;
6) The Supreme Judicial Council – in the cases stipulated by Point 4 of Article 168 of the Constitution;
7) Local self-government bodies – with a question regarding the conformity with the Constitution of normative legal acts stipulated by Point 1 of Article 168 of the Constitution that violate their constitutional rights, as well as in the cases stipulated by Point 4 of Article 168 of the Constitution;
8) Everyone – in a concrete case when there is a final act of court, all judicial remedies have been exhausted, and the person challenges the constitutionality of a provision of a normative legal act applied in relation to him by such act of court, which has led to a violation of his fundamental rights and freedoms enshrined in Chapter 2 of the Constitution, taking into account also the construal of such provision in its practical legal application;
9) The Prosecutor General – concerning the constitutionality of provisions of normative legal acts related to a specific set of proceedings conducted by the prosecution office, as well as in the case stipulated by Ponit 11 of Article 168 of the Constitution;
10) The Human Rights Defender – concerning the conformity of the normative legal acts listed in Point 1 of Article 168 of the Constitution with the provisions of Chapter 2 of the Constitution;
11) Parties or party alliances that participated in the National Assembly election – on disputes connected with decisions taken on the results of the National Assembly election;
12) The candidates for the President of the Republic – on disputes connected with decisions taken on the results of the election of the President of the Republic; and
13) At least three judges of the Constitutional Court – in the case stipulated by Point 9 of Article 168 of the Constitution.
... (Art. 169) - Armenian1. Սահմանադրական դատարան կարող են դիմել՝
1) Ազգային ժողովը՝ Սահմանադրության 168-րդ հոդվածի 12-րդ կետով սահմանված դեպքերում, Սահմանադրության 168-րդ հոդվածի 7-րդ կետով սահմանված դեպքում՝ պատգամավորների ընդհանուր թվի ձայների մեծամասնությամբ ընդունված որոշմամբ, իսկ Սահմանադրության 168-րդ հոդվածի 10-րդ կետով սահմանված դեպքում` պատգամավորների ընդհանուր թվի ձայների առնվազն երեք հինգերորդով ընդունված որոշմամբ.

5) Կառավարությունը՝ Սահմանադրության 168-րդ հոդվածի 1-ին, 4-րդ, 8-րդ և 12-րդ կետերով սահմանված դեպքերում.
6) Բարձրագույն դատական խորհուրդը՝ Սահմանադրության 168-րդ հոդվածի 4-րդ կետով սահմանված դեպքերում.

8) յուրաքանչյուր ոք՝ կոնկրետ գործով, երբ առկա է դատարանի վերջնական ակտը, սպառվել են դատական պաշտպանության բոլոր միջոցները և վիճարկում է այդ ակտով իր նկատմամբ կիրառված նորմատիվ իրավական ակտի դրույթի սահմանադրականությունը, ինչը հանգեցրել է Սահմանադրության 2-րդ գլխում ամրագրված իր հիմնական իրավունքների և ազատությունների խախտման՝ հաշվի առնելով նաև համապատասխան դրույթին իրավակիրառ պրակտիկայում տրված մեկնաբանությունը.
9) գլխավոր դատախազը՝ դատախազության կողմից իրականացվող կոնկրետ վարույթին առնչվող նորմատիվ իրավական ակտերի դրույթների սահմանադրականության հարցերով, ինչպես նաև Սահմանադրության 168-րդ հոդվածի 11-րդ կետով սահմանված դեպքում.
10) Մարդու իրավունքների պաշտպանը՝ Սահմանադրության 168-րդ հոդվածի 1-ին կետում թվարկված նորմատիվ իրավական ակտերի՝ Սահմանադրության 2-րդ գլխի դրույթներին համապատասխանության հարցերով.

- EnglishThe Constitutional Court shall examine the constitutionality, in respect of both form and substance, of laws, presidential decrees and the Rules of Procedure of the Grand National Assembly of Turkey, and decide on individual applications. Constitutional amendments shall be examined and verified only with regard to their form. However, presidential decrees issued during a state of emergency or in time of war shall not be brought before the Constitutional Court alleging their unconstitutionality as to form or substance.
The verification of laws as to form shall be restricted to consideration of whether the requisite majority was obtained in the last ballot; the verification of constitutional amendments shall be restricted to consideration of whether the requisite majorities were obtained for the proposal and in the ballot, and whether the prohibition on debates under expedited procedure was observed. Verification as to form may be requested by the President of the Republic or by one-fifth of the members of the Grand National Assembly of Turkey. Applications for annulment on the grounds of defect in form shall not be made after ten days have elapsed from the date of promulgation of the law; and it shall not be appealed by other courts to the Constitutional Court on the grounds of defect in form.
Everyone may apply to the Constitutional Court on the grounds that one of the fundamental rights and freedoms within the scope of the European Convention on Human Rights which are guaranteed by the Constitution has been violated by public authorities. In order to make an application, ordinary legal remedies must be exhausted.
In the individual application, judicial review shall not be made on matters required to be taken into account during the process of legal remedies.
Procedures and principles concerning the individual application shall be regulated by law.
The Constitutional Court in its capacity as the Supreme Court shall try, for offences relating to their functions, the President of the Republic, the Speaker of the Grand National Assembly of Turkey, members of the Council of Ministers; presidents and members of the Constitutional Court, High Court of Appeals, Council of State, High Military Court of Appeals, High Military Administrative Court, High Council of Judges and Prosecutors, Court of Accounts, and Chief Public Prosecutors and Deputy Public Prosecutors.
The Chief of General Staff, the commanders of the Land, Naval and Air Forces and the General Commander of the Gendarmerie shall be tried in the Supreme Court for offences regarding their duties.
The Chief Public Prosecutor of the High Court of Appeals or Deputy Chief Public Prosecutor of the High Court of Appeals shall act as prosecutor in the Supreme Court.
Application for judicial review may be made against the decisions of the Supreme Court. Decisions taken by the General Assembly regarding the application shall be final.
The Constitutional Court shall also perform the other duties given to it by the Constitution. (Art. 148) - TurkishAnayasa Mahkemesi, kanunların, kanun hükmünde kararnamelerin ve Türkiye Büyük Millet Meclisi İçtüzüğünün Anayasaya şekil ve esas bakımlarından uygunluğunu denetler ve bireysel başvuruları karara bağlar. Kanunların şekil bakımından denetlenmesi, son oylamanın, öngörülen çoğunlukla yapılıp yapılmadığı; Anayasa değişikliklerinde ise, teklif ve oylama çoğunluğuna ve ivedilikle görüşülemeyeceği şartına uyulup uyulmadığı hususları ile sınırlıdır. Şekil bakımından denetleme, Cumhurbaşkanınca veya Türkiye Büyük Millet Meclisi üyelerinin beşte biri tarafından istenebilir. Kanunun yayımlandığı tarihten itibaren on gün geçtikten sonra, şekil bozukluğuna dayalı iptal davası açılamaz; def’i yoluyla da ileri sürülemez.
Herkes, Anayasada güvence altına alınmış temel hak ve özgürlüklerinden, Avrupa İnsan Hakları Sözleşmesi kapsamındaki herhangi birinin kamu gücü tarafından, ihlal edildiği iddiasıyla Anayasa Mahkemesine başvurabilir. Başvuruda bulunabilmek için olağan kanun yollarının tüketilmiş olması şarttır.
Bireysel başvuruda, kanun yolunda gözetilmesi gereken hususlarda inceleme yapılamaz.
Bireysel başvuruya ilişkin usul ve esaslar kanunla düzenlenir.
Anayasa Mahkemesi Cumhurbaşkanını, Türkiye Büyük Millet Meclisi Başkanını, Bakanlar Kurulu üyelerini, Anayasa Mahkemesi, Yargıtay, Danıştay, Askerî Yargıtay, Askerî Yüksek İdare Mahkemesi Başkan ve üyelerini, Başsavcılarını, Cumhuriyet Başsavcıvekilini, Hâkimler ve Savcılar Yüksek Kurulu ve Sayıştay Başkan ve üyelerini görevleriyle ilgili suçlardan dolayı Yüce Divan sıfatıyla yargılar.
Genelkurmay Başkanı, Kara, Deniz ve Hava Kuvvetleri Komutanları ile Jandarma Genel Komutanı da görevleriyle ilgili suçlardan dolayı Yüce Divanda yargılanırlar. Yüce Divanda, savcılık görevini Cumhuriyet Başsavcısı veya Cumhuriyet Başsavcıvekili yapar.
Yüce Divan kararlarına karşı yeniden inceleme başvurusu yapılabilir. Genel Kurulun yeniden inceleme sonucunda verdiği kararlar kesindir.
Anayasa Mahkemesi, Anayasa ile verilen diğer görevleri de yerine getirir. (Madde 148)

The President of the Republic may ask the Constitutional Court to conduct a prior review of the constitutionality of any rule contained in legislation that has been submitted for enactment, any international treaty submitted to him for ratification or any international agreement sent to him for signature.

The Constitutional Council is referred to [a matter] by:
• the President of Faso;
• the Prime Minister;
• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].
The Constitutional Council can refer itself to any questions relative to its competence, if it judges it necessary. (Art. 157) - French
Le Conseil constitutionnel est saisi par :
• le Président du Faso;
• le Premier ministre;
• le Président de l'Assemblée nationale;
• un dixième (1/10) au moins des membres de chaque chambre du Parlement.
En outre, tout citoyen peut saisir le Conseil constitutionnel sur la constitutionnalité des lois, soit directement, soit par la procédure de l’exception d’inconstitutionnalité invoquée dans une affaire qui le concerne devant une juridiction. Celle-ci doit surseoir jusqu’à la décision du Conseil constitutionnel qui doit intervenir dans un délai maximum de trente jours à compter de sa saisine.
Le Conseil constitutionnel peut se saisir de toutes questions relevant de sa compétence s’il le juge nécessaire. (Art. 157)

- EnglishI. The Popular Action shall be filed during the period in which the violation or threat to the rights and collective interests continues. To file this action it is not necessary to exhaust the judicial or administrative processes that might exist.
II. Any person, in his or her individual name or on behalf of a collective, may file this action, and it shall be filed obligatorily by the Public Ministry and the Public Defender (Ministerio Público y el Defensor del Pueblo) when, in the exercise of their functions, they have knowledge of these acts. The procedure for the Action for Constitutional Protection shall be applied. (Art. 136) - SpanishI. La Acción Popular podrá interponerse durante el tiempo que subsista la vulneración o la amenaza a los derechos e intereses colectivos. Para interponer esta acción no será necesario agotar la vía judicial o administrativa que pueda existir.
II. Podrá interponer esta acción cualquier persona, a título individual o en representación de una colectividad y, con carácter obligatorio, el Ministerio Público y el Defensor del Pueblo, cuando por el ejercicio de sus funciones tengan conocimiento de estos actos. Se aplicará el procedimiento de la Acción de Amparo Constitucional. (Art. 136)
