- English(1) There shall be in and for Malta such Superior Courts having such powers and jurisdiction as may be provided by any law for the time being in force in Malta.
(2) One of the Superior Courts, composed of such three judges as could, in accordance with any law for the time being in force in Malta, compose the Court of Appeal, shall be known as the Constitutional Court and shall have jurisdiction to hear and determine –
(a) such questions as are referred to in article 63 of the Constitution;
(b) any reference made to it in accordance with article 56 of this Constitution and any matter referred to it in accordance with any law relating to the election of members of the House of Representatives;
(c) appeals from decisions of the Civil Court, First Hall, under article 46 of this Constitution;
(d) appeals from decisions of any court of original jurisdiction in Malta as to the interpretation of this Constitution other than those which may fall under article 46 of this Constitution;
(e) appeals from decisions of any court of original jurisdiction in Malta on questions as to the validity of laws other than those which may fall under article 46 of this Constitution; and
(f) any question decided by a court of original jurisdiction in Malta together with any of the questions referred to in the foregoing paragraphs of this sub-article on which an appeal has been made to the Constitutional Court:
Provided that nothing in this paragraph shall preclude an appeal being brought separately before the Court of Appeal in accordance with any law for the time being in force in Malta.

(d) appelli minn deċiżjonijiet ta’ xi qorti ta’ ġurisdizzjoni oriġinali f’Malta fuq kwistjonijiet dwar interpretazzjoni ta’ din il-Kostituzzjoni li ma jkunux dawk li jistgħu jaqgħu taħt l-artikolu 46 ta’ din il- Kostituzzjoni;
(e) appelli minn deċiżjonijiet ta’ xi qorti ta’ ġurisdizzjoni oriġinali f’Malta fuq kwistjonijiet dwar il-validità ta’ liġijiet li ma jkunux dawk li jistgħu jaqgħu taħt l-artikolu 46 ta’ din il-Kostituzzjoni; u
(f) kull kwistjoni deċiża minn qorti ta’ ġurisdizzjoni oriġinali f’Malta flimkien ma’ xi waħda mill-kwistjonijiet imsemmija fil-paragrafi ta’ qabel ta’ dan is-subartikolu li minnha jkun sar appell lill-Qorti Kostituzzjonali:

- English1. The legitimate organs to interpose recourses of unconstitutionality are:
a) The President of the Republic-Head of State.
b) The Vice President of the Republic and the Prime Minister.
c) The Chamber of the Deputies and the Senate with a qualified majority of the three-fourths part of their members.
d) The Attorney General of the Republic.

If the Constitutional Council, referred [to the matter] by the President of the Republic, the President of the National Assembly or of the Senate or by one-tenth at least of the Deputies or of the Senators, has declared that an international treaty or agreement includes a clause contrary to the Constitution, the authorization to ratify it can take place only after revision of the Constitution. 1. The Council of Constitutional Inquiry shall have powers to investigate constitutional disputes. Should the Council, upon consideration of the matter, find it necessary to interpret the Constitution, it shall submit its recommendations thereon to the House of the Federation.
2. Where any Federal or State law is contested as being unconstitutional and such a dispute is submitted to it by any court or interested party, the Council shall consider the matter and submit it to the House of the Federation for a final decision.
3. When issues of constitutional interpretation arise in the courts, the Council shall:
a. Remand the case to the concerned court if it finds there is no need for constitutional interpretation; the interested party, if dissatisfied with the decision of the Council, may appeal to the House of the Federation.
b. Submit its recommendations to the House of the Federation for a final decision if it believes there is a need for constitutional interpretation.

- EnglishThe special proceedings for protection shall be admissible against those rulings or definitive judgments where there has been a violation, by deed or omission, of the rights enshrined in the Constitution, and they shall be filed with the Constitutional Court. This appeal shall be admissible when regular and special appeals have been exhausted within the legal framework, unless the failure to file these resources was not attributable to the negligence of the person bearing the constitutional right that was infringed. Any pleader [plaideur] may raise the exception of unconstitutionality of a law before any jurisdiction.
The jurisdiction referred to [the matter] postpones deciding and remits the exception before the Constitutional Court. In this case, the Constitutional Court decides in the fifteen days of its referral.
The Constitutional Court is the judge of the violations of the fundamental rights and public freedoms committed by the public powers, the agents of the State and the citizens. It can be referred to [the matter] by the National Institution of Human Rights.

2. The Supreme Court shall have the power to make a final review of the constitutionality or legality of administrative decrees, regulations or actions, when their constitutionality or legality is at issue in a trial.
