- EnglishThe exercise of rights shall be governed by the following principles:
1. Rights can be exercised, promoted and enforced individually or collectively before competent authorities; these authorities shall guarantee their enforcement.

3. The rights and guarantees set forth in the Constitution and in international human rights instruments shall be directly and immediately enforced by and before any civil, administrative or judicial servant, either by virtue of their office or at the request of the party.
For the exercise of rights and constitutional guarantees, no conditions or requirements shall be established other than those set forth in the Constitution or by law.
Rights shall be fully actionable. Absence of a legal regulatory framework cannot be alleged to justify their infringement or ignorance thereof, to dismiss proceedings filed as a result of these actions or to deny their recognition.

5. In terms of rights and constitutional guarantees, public, administrative or judicial servants must abide by the most favorable interpretation of their effective force.

8. The contents of rights shall be developed progressively by means of standards, case law, and public policies. The State shall generate and guarantee the conditions needed for their full recognition and exercise.

The State shall immediately exercise the right to file a claim for restoration against those persons responsible for the damage produced, without detriment to civil, criminal and administrative liabilities.
The State shall be held liable for arbitrary arrest and detention, miscarriage of justice, unjustified delay or inadequate administration of justice, violation of the right to effective protection of the court, and any violations of the principles and rules of due process of law.
When a final judgment of conviction is reversed or vacated, the State shall provide redress to the person who has sustained damages as a result of this judgment; when the responsibility for such acts by public, administrative or judicial servants is identified, they shall be duly charged to obtain restitution. 1. Los derechos se podrán ejercer, promover y exigir de forma individual o colectiva ante las autoridades competentes; estas autoridades garantizarán su cumplimiento.

El Estado será responsable por detención arbitraria, error judicial, retardo injustificado o inadecuada administración de justicia, violación del derecho a la tutela judicial efectiva, y por las violaciones de los principios y reglas del debido proceso.
Cuando una sentencia condenatoria sea reformada o revocada, el Estado reparará a la persona que haya sufrido pena como resultado de tal sentencia y, declarada la responsabilidad por tales actos de servidoras o servidores públicos, administrativos o judiciales, se repetirá en contra de ellos. - EnglishProceedings for failure to comply shall be aimed at guaranteeing the application of rules and regulations comprising the legal system, as well as compliance with the rulings or reports of international human rights organizations, when the regulation or decision whose enforcement is being pursued contains an obligation to make it clear, express and enforceable. The petition shall be filed with the Constitutional Court. (Art. 93)
- SpanishLa acción por incumplimiento tendrá por objeto garantizar la aplicación de las normas que integran el sistema jurídico, así como el cumplimiento de sentencias o informes de organismos internacionales de derechos humanos, cuando la norma o decisión cuyo cumplimiento se persigue contenga una obligación de hacer o no hacer clara, expresa y exigible. La acción se interpondrá ante la Corte Constitucional. (Art. 93)

- EnglishThe National Equality Councils are bodies responsible for ensuring the full observance and exercise of the rights enshrined in the Constitution and in international human rights instruments. The Councils shall exercise their attributions for the drafting, cross-cutting application, observance, follow-up and evaluation of public policies involving the issues of gender, ethnic groups, generations, interculturalism, and disabilities and human mobility, in accordance with the law. To achieve their objectives, they shall coordinate with leading and executive entities and with specialized organizations for the protection of rights at all levels of government. (Art. 156)
- SpanishLos consejos nacionales para la igualdad son órganos responsables de asegurar la plena vigencia y el ejercicio de los derechos consagrados en la Constitución y en los instrumentos internacionales de derechos humanos. Los consejos ejercerán atribuciones en la formulación, transversalización, observancia, seguimiento y evaluación de las políticas públicas relacionadas con las temáticas de género, étnicas, generacionales, interculturales, y de discapacidades y movilidad humana, de acuerdo con la ley. Para el cumplimiento de sus fines se coordinarán con las entidades rectoras y ejecutoras y con los organismos especializados en la protección de derechos en todos los niveles de gobierno. (Art. 156)

- EnglishThe Office of the Human Rights Ombudsman shall have as its duties the protection and guardianship of the rights of the inhabitants of Ecuador and the defense of the rights of Ecuadorian nationals living abroad. It shall have the following attributions, in addition to those provided for by law:
1. To support, by virtue of its office or at the request of a party, the actions of protection, habeas corpus, access to public information, habeas data, noncompliance, citizen action and complaints for poor quality or improper provision of public or private services.
2. To issue measures of mandatory and immediate compliance for the protection of rights and to request trial and punishment from the competent authority for their violations.
3. To investigate and rule, in the framework of its attributions, on the deeds or omissions of natural persons or legal entities that provide public services.
4. To exercise and promote surveillance of due process of law and to immediately prevent and stop all forms of cruel, inhumane and degrading treatment. (Art. 215) - SpanishLa Defensoría del Pueblo tendrá como funciones la protección y tutela de los derechos de los habitantes del Ecuador y la defensa de los derechos de las ecuatorianas y ecuatorianos que estén fuera del país. Serán sus atribuciones, además de las establecidas en la ley, las siguientes:
1. El patrocinio, de oficio o a petición de parte, de las acciones de protección, hábeas corpus, acceso a la información pública, hábeas data, incumplimiento, acción ciudadana y los reclamos por mala calidad o indebida prestación de los servicios públicos o privados.
2. Emitir medidas de cumplimiento obligatorio e inmediato en materia de protección de los derechos, y solicitar juzgamiento y sanción ante la autoridad competente, por sus incumplimientos.
3. Investigar y resolver, en el marco de sus atribuciones, sobre acciones u omisiones de personas naturales o jurídicas que presten servicios públicos.
4. Ejercer y promover la vigilancia del debido proceso, y prevenir, e impedir de inmediato la tortura, el trato cruel, inhumano y degradante en todas sus formas. (Art. 215)
