- EnglishI. A nation and rural native indigenous people consists of every human collective that shares a cultural identity, language, historic tradition, institutions, territory and world view, whose existence predates the Spanish colonial invasion.
II. In the framework of the unity of the State, and in accordance with this Constitution, the nations and rural native indigenous peoples enjoy the following rights:
1. To be free.
2. To their cultural identity, religious belief, spiritualities, practices and customs, and their own world view.
3. That the cultural identity of each member, if he or she so desires, be inscribed together with Bolivian citizenship in his identity card, passport and other identification documents that have legal validity.
4. To self-determination and territoriality.
5. That its institutions be part of the general structure of the State.
6. To the collective ownership of land and territories.
7. To the protection of their sacred places.
8. To create and administer their own systems, means and networks of communication.
9. That their traditional teachings and knowledge, their traditional medicine, languages, rituals, symbols and dress be valued, respected and promoted.
10. To live in a healthy environment, with appropriate management and exploitation of the ecosystems.
11. To collective ownership of the intellectual property in their knowledge, sciences and learning, as well as to its evaluation, use, promotion and development.
12. To an inter-cultural, intra-cultural and multi-language education in all educational systems.
13. To universal and free health care that respects their world view and traditional practices.
14. To the practice of their political, juridical and economic systems in accord with their world view.
15. To be consulted by appropriate procedures, in particular through their institutions, each time legislative or administrative measures may be foreseen to affect them. In this framework, the right to prior obligatory consultation by the State with respect to the exploitation of nonrenewable natural resources in the territory they inhabit shall be respected and guaranteed, in good faith and upon agreement.
16. To participate in the benefits of the exploitation of natural resources in their territory.
17. To autonomous indigenous territorial management, and to the exclusive use and exploitation of renewable natural resources existing in their territory without prejudice to the legitimate rights acquired by third parties.

III. The State guarantees, respects and protects the rights of the nations and the rural native indigenous peoples consecrated in this Constitution and the law. (Art. 30) - SpanishI. 2. A su identidad cultural, creencia religiosa, espiritualidades, prácticas y costumbres, y a su propia cosmovisión.
3. A que la identidad cultural de cada uno de sus miembros, si así lo desea, se inscriba junto a la ciudadanía boliviana en su cédula de identidad, pasaporte u otros documentos de identificación con validez legal.
4. A la libre determinación y territorialidad.
5. A que sus instituciones sean parte de la estructura general del Estado.
6. A la titulación colectiva de tierras y territorios.
7. A la protección de sus lugares sagrados.
8. A crear y administrar sistemas, medios y redes de comunicación propios.
9. A que sus saberes y conocimientos tradicionales, su medicina tradicional, sus idiomas, sus rituales y sus símbolos y vestimentas sean valorados, respetados y promocionados.
10. A vivir en un medio ambiente sano, con manejo y aprovechamiento adecuado de los ecosistemas.
11. A la propiedad intelectual colectiva de sus saberes, ciencias y conocimientos, así como a su valoración, uso, promoción y desarrollo.
12. A una educación intracultural, intercultural y plurilingüe en todo el Sistema educativo.
13. Al sistema de salud universal y gratuito que respete su cosmovisión y practices tradicionales.
14. Al ejercicio de sus sistemas políticos, jurídicos y económicos acorde a su cosmovisión.
15. A ser consultados mediante procedimientos apropiados, y en particular a través de sus instituciones, cada vez que se prevean medidas legislativas o administrativas susceptibles de afectarles. En este marco, se respetará y garantizará el derecho a la consulta previa obligatoria, realizada por el Estado, de buena fe y concertada, respecto a la explotación de los recursos naturales no renovables en el territorio que habitan.
16. A la participación en los beneficios de la explotación de los recursos naturales en sus territorios.
17. A la gestión territorial indígena autónoma, y al uso y aprovechamiento exclusivo de los recursos naturales renovables existentes en su territorio sin perjuicio de los derechos legítimamente adquiridos por terceros.

The Mexican Nation is one and indivisible.
The Nation has pluri-cultural composition based originally on its indigenous peoples[,] who are those who are descended from populations that inhabited the present territory of the country at the beginning of colonization and who preserve their own social, economic, cultural and political institutions, or part of them.
Consciousness of one's indigenous identity will be a fundamental criterion for determining to whom the provisions concerning indigenous peoples are applied.
Communities composed of an indigenous people, [are] those that form a social, economic and cultural unity, living in a territory and that recognized their own authorities in accordance with their habits [usos] and customs.
The right of the indigenous peoples to self-determination will be exercised within a constitutional framework of autonomy that assures the national unity. The recognition of indigenous peoples and communities will be [included] in the constitutions and laws of the federative entities, which must take into account, in addition to the general principles established in the preceding paragraphs of this article, ethno-linguistic criteria and physical settlement.
A. This Constitution recognizes and guarantees the right of indigenous peoples and communities to self-determination and, consequently, to the autonomy to:
I. Decide on their internal forms of coexistence and social, economic, political and cultural organization.
II. Apply their own normative systems in the regulation and solution of their internal conflicts, subject to the general principles of this Constitution, respecting individual guarantees, human rights and, in relevant manner, the dignity and integrity of women. The law will establish the cases and procedures of validation by the corresponding judges or courts.
III. Elect according to their traditional norms, procedures and practices, the authorities or representatives for the exercise of their own forms of internal government, guaranteeing that indigenous women and men will enjoy and will exercise their right to vote and to be voted for in conditions of equality; as well as to accede to and to hold the public offices [cargos] and [offices] of public election for those that have been elected or designated, in a framework [that] respects the federal pact, the sovereignty of the States and the autonomy of the City of Mexico. In no case may communitarian practices limit the political electoral rights of [masculine and feminine] citizens in the election of their municipal authorities.
V. Preserve and improve the habitat and preserve the integrity of their lands in the terms established in this Constitution.
VI. Accede, with respect to the forms and modalities of ownership and tenancy of the land established in this Constitution and in the laws of the matter, as well as the rights acquired by third parties or by members of the community, to the preferential use and enjoyment of the natural resources of the places [lugares] that the communities inhabit and occupy, except those that correspond to the strategic areas, in terms of this Constitution. For these effects the communities may associate in terms of law.
VII. Elect, in the municipalities with indigenous population, representatives to the ayuntamientos [local or town councils], observing the principle of parity of gender in accordance with the applicable norms.
The constitutions and laws of the federative entities recognize and regulate these rights in the municipalities, with the aim of strengthening the political participation and representation in accordance with their traditions and internal norms.
VIII. Accede fully to jurisdictions of the State. To guarantee this right, in all the trials and proceedings in which they are parties, individually or collectively, their cultural customs and specifications must be taken into account respecting the precepts of this Constitution. The indigenous peoples have at all times the right to be assisted by interpreters and defenders who have knowledge of their language and culture.
The constitutions and laws of the federative entities will establish the characteristics of self-determination and autonomy that best express the situations and aspirations of the indigenous peoples in each entity, as well as the norms for the recognition of the indigenous communities as entities of public interest.
B. The Federation, the federative entities and the Municipalities, to promote the equality of opportunities of the indigenous peoples and to eliminate any discriminatory practice, will establish institutions and determine the policies necessary to guarantee the effectiveness of the rights of the indigenous peoples and the full development of their peoples and communities, which must be designed and operated in conjunction with them.
To reduce the gaps and shortfalls that affect the indigenous peoples and communities, these authorities, have the obligation to:
I. Promote regional development in the indigenous zones with the objective to strengthen the local economies and to improve the living conditions of their peoples, through coordinated actions between the three orders [órdenes] of government, with the participation of the communities. The municipal authorities will determine[,] equitably[,] the budget allocations that the communities administer directly for specific purposes.
II. Guarantee and increase the levels of schooling, favoring bilingual and intercultural education, literacy, completion of basic education, productive training and media superior [high school] and superior [college] education. To establish a system of scholarships for indigenous students at all levels. To define and to develop educational programs of regional content that recognize the cultural heritage of their peoples, in accordance with the laws of the matter and in consultation with the indigenous communities. To promote respect and understanding of the diverse cultures existing in the Nation.
III. Assuring the effective access to health services by the expansion of the coverage of the national system, properly using traditional medicine, as well as to support the nutrition of the indigenous peoples through food [alimentación] programs, especially for the infant population.
IV. Improve the conditions of the indigenous communities and of their spaces for living and recreation, through actions that facilitate the access to public and private financing for the construction and improvement of housing, as well as extending coverage of the basic social services.
V. Facilitate the incorporation of indigenous women to development, through support to productive projects, the protection of their health, the provision of incentives to encourage their education and their participation in decision-making related to community life.
VI. Extend the communications network that enables the integration of the communities, through the construction and expansion of routes of communication [vías de comunicación] and telecommunication. Establish conditions so that the indigenous peoples and communities may acquire, operate and administer the media of communication, in the terms that the laws of the matter determine.
VII. Supporting the productive activities and the sustainable development of the indigenous communities through actions to achieve the sufficiency of their economic income, the application of incentives for public and private investments that promote job creation, the incorporation of technologies to enhance their own productive capacity, as well as to assure equitable access to the systems of supply and commercialization.
VIII. Establish social policies to protect the migrants of the indigenous peoples, both within the national territory and abroad, through actions to guarantee the labor rights of agricultural day laborers; to improve the conditions of health of women; to support with special programs of education and nutrition the children and youth of migrant families; to see to the respect of their human rights and to promote the diffusion of their cultures.
IX. Consult with the indigenous peoples in the elaboration of the National Plan of Development and of the plans of the federative entities, of the municipalities and, where appropriate, of the territorial demarcations of the City of México and, as the case may be, incorporate the recommendations and proposals that are made.
To guarantee the compliance with the obligations specified in this part, the Chamber of Deputies of the Congress of the Union, the legislatures of the federative entities and the ayuntamientos, within the domain [ámbito] of their respective competences, will establish the specific allocations [partidas] designated to fulfill these obligations in the budget of expenditures that approves them, as well as forms and procedures by which the communities participate in the exercise and the monitoring of them.
Without prejudice to the rights established in favor of indigenous [persons], their communities and peoples, every community comparable to them will have in this regard the same rights and [those] as the law establishes.
C. This Constitution recognizes the Afro-Mexican peoples and communities, whatever their self-denomination may be, as part of the multicultural composition of the Nation. They will have in what is conducive [en lo conducente] the rights specified in the previous sections [apartados] of this Article in the terms that the laws establish, in order to guarantee their free determination, autonomy, development and social inclusion. La Nación tiene una composición pluricultural sustentada originalmente en sus pueblos indígenas que son aquellos que descienden de poblaciones que habitaban en el territorio actual del país al iniciarse la colonización y que conservan sus propias instituciones sociales, económicas, culturales y políticas, o parte de ellas.
La conciencia de su identidad indígena deberá ser criterio fundamental para determinar a quiénes se aplican las disposiciones sobre pueblos indígenas.
Son comunidades integrantes de un pueblo indígena, aquellas que formen una unidad social, económica y cultural, asentadas en un territorio y que reconocen autoridades propias de acuerdo con sus usos y costumbres.
El derecho de los pueblos indígenas a la libre determinación se ejercerá en un marco constitucional de autonomía que asegure la unidad nacional. El reconocimiento de los pueblos y comunidades indígenas se hará en las constituciones y leyes de las entidades federativas, las que deberán tomar en cuenta, además de los principios generales establecidos en los párrafos anteriores de este artículo, criterios etnolingüísticos y de asentamiento físico.
A. Esta Constitución reconoce y garantiza el derecho de los pueblos y las comunidades indígenas a la libre determinación y, en consecuencia, a la autonomía para:
I. Decidir sus formas internas de convivencia y organización social, económica, política y cultural.
II. Aplicar sus propios sistemas normativos en la regulación y solución de sus conflictos internos, sujetándose a los principios generales de esta Constitución, respetando las garantías individuales, los derechos humanos y, de manera relevante, la dignidad e integridad de las mujeres. La ley establecerá los casos y procedimientos de validación por los jueces o tribunales correspondientes.
III. Elegir de acuerdo con sus normas, procedimientos y practices tradicionales, a las autoridades o representantes para el ejercicio de sus formas propias de gobierno interno, garantizando que las mujeres y los hombres indígenas disfrutarán y ejercerán su derecho de votar y ser votados en condiciones de igualdad; así como a acceder y desempeñar los cargos públicos y de elección popular para los que hayan sido electos o designados, en un marco que respete el pacto federal, la soberanía de los Estados y la autonomía de la Ciudad de México. En ningún caso las prácticas comunitarias podrán limitar los derechos político-electorales de los y las ciudadanas en la elección de sus autoridades municipales.
IV. Preservar y enriquecer sus lenguas, conocimientos y todos los elementos que constituyan su cultura e identidad.
V. Conservar y mejorar el hábitat y preservar la integridad de sus tierras en los términos establecidos en esta Constitución.
VI. Acceder, con respeto a las formas y modalidades de propiedad y tenencia de la tierra establecidas en esta Constitución y a las leyes de la materia, así como a los derechos adquiridos por terceros o por integrantes de la comunidad, al uso y disfrute preferente de los recursos naturales de los lugares que habitan y ocupan las comunidades, salvo aquellos que corresponden a las áreas estratégicas, en términos de esta Constitución. Para estos efectos las comunidades podrán asociarse en términos de ley.
VII. Elegir, en los municipios con población indígena, representantes ante los ayuntamientos, observando el principio de paridad de género conforme a las normas aplicables.
Las constituciones y leyes de las entidades federativas reconocerán y regularán estos derechos en los municipios, con el propósito de fortalecer la participación y representación política de conformidad con sus tradiciones y normas internas.
VIII. Acceder plenamente a la jurisdicción del Estado. Para garantizar ese derecho, en todos los juicios y procedimientos en que sean parte, individual o colectivamente, se deberán tomar en cuenta sus costumbres y especificidades culturales respetando los preceptos de esta Constitución. Los indígenas tienen en todo tiempo el derecho a ser asistidos por intérpretes y defensores que tengan conocimiento de su lengua y cultura.
Las constituciones y leyes de las entidades federativas establecerán las características de libre determinación y autonomía que mejor expresen las situaciones y aspiraciones de los pueblos indígenas en cada entidad, así como las normas para el reconocimiento de las comunidades indígenas como entidades de interés público.
B. La Federación, las entidades federativas y los Municipios, para promover la igualdad de oportunidades de los indígenas y eliminar cualquier práctica discriminatoria, establecerán las instituciones y determinarán las políticas necesarias para garantizar la vigencia de los derechos de los indígenas y el desarrollo integral de sus pueblos y comunidades, las cuales deberán ser diseñadas y operadas conjuntamente con ellos.
Para abatir las carencias y rezagos que afectan a los pueblos y comunidades indígenas, dichas autoridades, tienen la obligación de:
I. Impulsar el desarrollo regional de las zonas indígenas con el propósito de fortalecer las economías locales y mejorar las condiciones de vida de sus pueblos, mediante acciones coordinadas entre los tres órdenes de gobierno, con la participación de las comunidades. Las autoridades municipales determinarán equitativamente las asignaciones presupuestales que las comunidades administrarán directamente para fines específicos.
II. Garantizar e incrementar los niveles de escolaridad, favoreciendo la educación bilingüe e intercultural, la alfabetización, la conclusión de la educación básica, la capacitación productiva y la educación media superior y superior. Establecer un sistema de becas para los estudiantes indígenas en todos los niveles. Definir y desarrollar programas educativos de contenido regional que reconozcan la herencia cultural de sus pueblos, de acuerdo con las leyes de la materia y en consulta con las comunidades indígenas. Impulsar el respeto y conocimiento de las diversas culturas existentes en la nación.
III. Asegurar el acceso efectivo a los servicios de salud mediante la ampliación de la cobertura del sistema nacional, aprovechando debidamente la medicina tradicional, así como apoyar la nutrición de los indígenas mediante programas de alimentación, en especial para la población infantil.
IV. Mejorar las condiciones de las comunidades indígenas y de sus espacios para la convivencia y recreación, mediante acciones que faciliten el acceso al financiamiento público y privado para la construcción y mejoramiento de vivienda, así como ampliar la cobertura de los servicios sociales básicos.
V. Propiciar la incorporación de las mujeres indígenas al desarrollo, mediante el apoyo a los proyectos productivos, la protección de su salud, el otorgamiento de estímulos para favorecer su educación y su participación en la toma de decisiones relacionadas con la vida comunitaria.
VI. Extender la red de comunicaciones que permita la integración de las comunidades, mediante la construcción y ampliación de vías de comunicación y telecomunicación. Establecer condiciones para que los pueblos y las comunidades indígenas puedan adquirir, operar y administrar medios de comunicación, en los términos que las leyes de la materia determinen.
VII. Apoyar las actividades productivas y el desarrollo sustentable de las comunidades indígenas mediante acciones que permitan alcanzar la suficiencia de sus ingresos económicos, la aplicación de estímulos para las inversiones públicas y privadas que propicien la creación de empleos, la incorporación de tecnologías para incrementar su propia capacidad productiva, así como para asegurar el acceso equitativo a los sistemas de abasto y comercialización.
VIII. Establecer políticas sociales para proteger a los migrantes de los pueblos indígenas, tanto en el territorio nacional como en el extranjero, mediante acciones para garantizar los derechos laborales de los jornaleros agrícolas; mejorar las condiciones de salud de las mujeres; apoyar con programas especiales de educación y nutrición a niños y jóvenes de familias migrantes; velar por el respeto de sus derechos humanos y promover la difusión de sus culturas.
IX. Consultar a los pueblos indígenas en la elaboración del Plan Nacional de Desarrollo y de los planes de las entidades federativas, de los Municipios y, cuando proceda, de las demarcaciones territoriales de la Ciudad de México y, en su caso, incorporar las recomendaciones y propuestas que realicen.
Para garantizar el cumplimiento de las obligaciones señaladas en este apartado, la Cámara de Diputados del Congreso de la Unión, las legislaturas de las entidades federativas y los ayuntamientos, en el ámbito de sus respectivas competencias, establecerán las partidas específicas destinadas al cumplimiento de estas obligaciones en los presupuestos de egresos que aprueben, así como las formas y procedimientos para que las comunidades participen en el ejercicio y vigilancia de las mismas.
Sin perjuicio de los derechos aquí establecidos a favor de los indígenas, sus comunidades y pueblos, toda comunidad equiparable a aquéllos tendrá en lo conducente los mismos derechos tal y como lo establezca la ley.
C. Esta Constitución reconoce a los pueblos y comunidades afromexicanas, cualquiera que sea su autodenominación, como parte de la composición pluricultural de la Nación. Tendrán en lo conducente los derechos señalados en los apartados anteriores del presente artículo en los términos que establezcan las leyes, a fin de garantizar su libre determinación, autonomía, desarrollo e inclusión social.
