(2) Rights shall not be abused, nor shall they be exercised to the detriment of the rights or the legitimate interests of others.
(3) Following a proclamation of war, martial law or a state of emergency the exercise of individual civil rights may be temporarily curtailed by law, except for the rights established by Art. 28, Art. 29, Art. 31 paras 1, 2 and 3, Art. 32 para 1, and Art. 37. 5. A declaration of a state of emergency or any measures undertaken or laws enacted pursuant to it shall not:
a. suspend Articles 14(1) and (2); 16; 17(2); and 19(1) of the Constitution;
b. grant pardon or amnesty to any person or persons who, acting under the authority of the State, have committed illegal acts; or
c. introduce martial law when there is no external invasion or civil disorder. (Art. 27)

(1) Parliament or the legislature of a province may expressly declare in an Act of Parliament or of the legislature, as the case may be, that the Act or a provision thereof shall operate notwithstanding a provision included in section 28 or sections 7 to 159 of this Charter.
(2) An Act or a provision of an Act in respect of which a declaration made under this section is in effect shall have such operation as it would have but for the provision of this Charter referred to in the declaration.
(3) A declaration made under subsection (1) shall cease to have effect five years after it comes into force or on such earlier date as may be specified in the declaration.
(4) Parliament or the legislature of a province may re-enact a declaration made under subsection (1).
(5) Subsection (3) applies in respect of a re-enactment made under subsection (4). (Constitution Act 1982, Sec. 33) - French
