Limitations and/or Derogations
- English(1) Apart from the provisions of Article 30(2), any law enacted by Parliament shall not be void for the reason only that it enables measures to be taken during a state of emergency or in normal times in relation to persons who are believed to engage in activities which endanger or prejudice the security of the nation, which measures derogate from the provisions of Articles 14 and 15 of this Constitution.
(2) It is hereby prohibited to take any of the measures referred to in subarticle (1) of this Article in pursuance of any law during a state of emergency or in normal times in relation to any person, save only to the extent that they are necessary and justifiable for dealing with the situation that exists during the state of emergency, or in normal times dealing with the situation created by the conduct of the person concerned.
(3) It is hereby declared that the provisions of this Article shall not authorize the deprivation of a person’s right to live save only for deaths resulting from acts of war.
(4) In this Article and the following Articles of this Part, “state of emergency” means any period during which the Proclamation of State of Emergency made by the President in the exercise of the powers conferred on him by Article 32, is in force. (Art. 31)

- EnglishIndividual constitutionally guaranteed freedoms and rights may be restricted during a state of war or any clear and present danger to the independence and unity of the Republic of Croatia or in the event of any natural disaster. Such restriction shall be decided upon by the Croatian Parliament by a two-thirds majority of all Members of Parliament or, if the Croatian Parliament is unable to convene, at the proposal of the Government and with the countersignature of the Prime Minister, by the President of the Republic.
The extent of such restrictions must be appropriate to the nature of the threat, and may not result in the inequality of citizens with respect to race, colour, sex, language, religion, or national or social origin.
Even in cases of clear and present danger to the existence of the state, no restrictions may be imposed upon the provisions of this Constitution stipulating the right to life, prohibition of torture, cruel or degrading treatment or punishment, and concerning the legal definitions of criminal offences and punishment, and the freedom of thought, conscience and religion. Niti u slučaju neposredne opasnosti za opstanak države ne može se ograničiti primjena odredbi ovoga Ustava o pravu na život, zabrani mučenja, surovog ili ponižavajućeg postupanja ili kažnjavanja, o pravnoj određenosti kažnjivih djela i kazni, te o slobodi misli, savjesti i vjeroispovijedi. - EnglishIn the event of domestic disorder or foreign attack endangering the full enforcement of this Constitution and of the authorities hereby established, the province or territory which is in a turmoil shall be declared in state of siege and the constitutional guarantees shall be suspended therein. But during such a suspension the President of the Republic shall not pronounce judgment or apply penalties on his own. In such case, his power shall be limited, with respect to persons, to their arrest or transfer from one place of the Nation to another, should they not prefer to leave the Argentine territory. 4. a. When a state of emergency is declared, the Council of Ministers shall, in accordance with regulations it issues, have all necessary power to protect the country's peace and sovereignty, and to maintain public security, law and order.
b. The Council of Ministers shall have the power to suspend such political and democratic rights contained in this Constitution to the extent necessary to avert the conditions that required the declaration of a state of emergency.
c. In the exercise of its emergency powers the Council of Ministers cannot, however, suspend or limit the rights provided for in Articles 1, 18, 25, and sub-Articles 1 and 2 of Article 39 of this Constitution.
5. The House of Peoples' Representatives, while declaring a state of emergency, shall simultaneously establish a State of Emergency Inquiry Board, comprising of seven persons to be chosen and assigned by the House from among its members and from legal experts.
6. The State of Emergency Inquiry Board shall have the following powers and responsibilities:
a. To make public within one month the names of all individuals arrested on account of the state of emergency together with the reasons for their arrest.
b. To inspect and follow up that no measure taken during the state of emergency is inhumane.
c. To recommend to the Prime Minister or to the Council of Ministers corrective measures if it finds any case of inhumane treatment.
d. To ensure the prosecution of perpetrators of inhumane acts.
e. To submit its views to the House of Peoples' Representatives on a request to extend the duration of the state of emergency. (Art. 93) - Amharic…
4. ሀ/ የአስቸኳይ ጊዜ አዋጅ በሚታወጅበት ጊዜ የሚኒስትሮች ምክር ቤት በሚያወጣቸው ደንቦች መሰረት የሀገርን ሰላምና ሕልውና፣ የሕዝብን ደህንነት፣ሕግና ሥርዓትን የማስከበር ሥልጣን ይኖረዋል፡፡
ለ/ የሚኒስትሮች ምክር ቤት ሥልጣን በሕገ መንግሥቱ የተቀመጡትን መሰረታዊ የፖለቲካና የዴሞክራሲ መብቶችን፣ የአስቸኳይ ጊዜ አዋጁን ለማወጅ ምክንያት የሆነውን ጉዳይ ለማስወገድ ተፈላጊ ሆኖ በተገኘውደረጃ፣ እስከ ማገድ ሊደርስ የሚችል ነው፡፡

6. የአስቸኳይ ጊዜ አዋጅ አፈጻጸም መርማሪ ቦርድ የሚከተሉት ሥልጣንና ኃላፊነቶች አሉት፡፡
ሀ/ በአስቸኳይ ጊዜ አዋጅ ምክንያት የታሰሩትን ግለሰቦች ስም በአንድ ወር ጊዜ ውስጥ ይፋ ማድረግና የታሰሩበትን ምክንያት መግለጽ፣
ለ/ በአስቸኳይ ጊዜ አዋጅ ወቅት የሚወሰዱት እርምጃዎች በማናቸውም ረገድ ኢሰብዓዊ አለመሆናቸውን መቆጣጠርና መከታተል፣
ሐ/ ማናቸውም የአስቸኳይ ጊዜ አዋጅ እርምጃ ኢሰብዓዊ መሆኑን ሲያምንበት ጠቅላይ ሚኒስትሩ ወይም የሚኒስሮች ምክር ቤት እርምጃውን እንዲያስተካክል ሐሳብ መስጠት፣

- EnglishThe rights of persons set out in Articles ninety-six, ninety-seven, ninety-eight, one hundred, one hundred and two, one hundred and three, one hundred and six, and one hundred and eight of the Constitution may be subject to restrictions in circumstances provided for by law in order to protect the rights of other people, the democratic structure of the State, and public safety, welfare and morals. On the basis of the conditions set forth in this Article, restrictions may also be imposed on the expression of religious beliefs. (Art. 116)

(1) Parliament or the legislature of a province may expressly declare in an Act of Parliament or of the legislature, as the case may be, that the Act or a provision thereof shall operate notwithstanding a provision included in section 28 or sections 7 to 159 of this Charter.
(2) An Act or a provision of an Act in respect of which a declaration made under this section is in effect shall have such operation as it would have but for the provision of this Charter referred to in the declaration.
(3) A declaration made under subsection (1) shall cease to have effect five years after it comes into force or on such earlier date as may be specified in the declaration.
(4) Parliament or the legislature of a province may re-enact a declaration made under subsection (1).
(5) Subsection (3) applies in respect of a re-enactment made under subsection (4). (Constitution Act 1982, Sec. 33) - French
(1) Le Parlement ou la législature d’une province peut adopter une loi où il est expressément déclaré que celle-ci ou une de ses dispositions a effet indépendamment d’une disposition donnée de l’article 2 ou des articles 7 à 15 de la présente charte.
(2) La loi ou la disposition qui fait l’objet d’une déclaration conforme au présent article et en vigueur a l’effet qu’elle aurait sauf la disposition en cause de la charte.
(3) La déclaration visée au paragraphe (1) cesse d’avoir effet à la date qui y est précisée ou, au plus tard, cinq ans après son entrée en vigueur.
(4) Le Parlement ou une législature peut adopter de nouveau une déclaration visée au paragraphe (1).
