- EnglishUpon proclamation of the state of emergency or war, derogations from human and minority rights guaranteed by the Constitution shall be permitted only to the extent deemed necessary.
Measures providing for derogation shall not bring about differences based on race, sex, language, religion, national affiliation or social origin.
Measures providing for derogation from human and minority rights shall cease to be effective upon ending of the state of emergency or war.
Measures providing for derogation shall by no means be permitted in terms of the rights guaranteed pursuant to Articles 23, 24, 25, 26, 28, 32, 34, 37, 38, 43, 45, 47, 49, 62, 63, 64 and 78 of the Constitution. - English(1) At a time of national disaster or during a state of national defence or public emergency threatening the life of the nation or the constitutional order, the President may by Proclamation in the Gazette declare that a state of emergency exists in Namibia or any part thereof.

(5) (a) During a state of emergency in terms of this Article or when a state of national defence prevails, the President shall have the power by Proclamation to make such regulations as in his or her opinion are necessary for the protection of national security, public safety and the maintenance of law and order.
(b) The powers of the President to make such regulations shall include the power to suspend the operation of any rule of the common law or statute or any fundamental right or freedom protected by this Constitution, for such period and subject to such conditions as are reasonably justifiable for the purpose of dealing with the situation which has given rise to the emergency: provided that nothing in this Sub-Article shall enable the President to act contrary to the provisions of Article 24 hereof.

- English(1) The rights recognized in sections 17, 18, subsections 2 and 3, sections 19, sections 21, 28, subsection 2, and section 37, subsection 2, may be suspended when a state of emergency or siege (martial law) is declared under the terms provided in the Constitution. Subsection 3 of section 17 is excepted from the foregoing provisions in the event of the declaration of a state of emergency.
(2) An organic act may determine the manner and the circumstances in which, on an individual basis and with the necessary participation of the courts and proper parliamentary control, the rights recognized in section 17, subsection 2, and 18, subsections 2 and 3, may be suspended for specific persons in connection with investigations of the activities of armed bands or terrorist groups.
Unwarranted or abusive use of the powers recognized in the foregoing organic act shall give rise to criminal liability as a violation of the rights and freedoms recognized by the laws. 20, subsection 1, paragraphs a) and d), and subsection 5. 2. Una ley orgánica podrá determinar la forma y los casos en los que, de forma individual y con la necesaria intervención judicial y el adecuado control parlamentario, los derechos reconocidos en los artículos 17, apartado 2, y 18, apartados 2 y 3, pueden ser suspendidos para personas determinadas, en relación con las investigaciones correspondientes a la actuación de bandas armadas o elementos terroristas.
La utilización injustificada o abusiva de las facultades reconocidas en dicha ley orgánica producirá responsabilidad penal, como violación de los derechos y libertades reconocidos por las leyes. (Art. 55)

(1) A declaration of a state of emergency cannot under any circumstances violate the right to life and physical and mental integrity of the person, the rights granted to people by law in relation to their status, capacity and nationality; the principle of nonretroactivity of criminal law, the right to defence and freedom of thought, conscience and religion.
(2) A declaration of a state of emergency cannot under any circumstances affect powers of the President of the Republic, the Parliament, the Supreme Court and the Prime Minister nor can it modify the principles relating to the responsibility of the State and public servants provided for in this Constitution. (3) When a Proclamation of Emergency has been made and so long as such Proclamation is in force, His Majesty the Sultan and Yang Di-Pertuan may make any Orders whatsoever which he considers desirable in the public interest; ...

(l) modification, amendment, supersession or suspension of all or any of the provisions of any written law;
(m) entry into, and search of, premises or other places, and search and interrogation of persons;
(n) prescribing fees or other payments; and

(j) menubuhkan sebuah pasukan polis khas;
(k) penubuhan tribunal-tribunal dan badan-badan lain bagi maksud memutuskan sebarang perkara yang dinyatakan dalam mana-mana Perintah sedemikian;
(l) pengubahsuaian, pindaan, penggantian atau penggantungan semua atau mana-mana peruntukan sebarang undang-undang bertulis;
(m) memasuki, dan menggeledah, bangunan-bangunan atau tempat-tempat lain, dan memeriksa dan menyoal siasat orang-orang;
(n) menetapkan bayaran atau pembayaran lain; dan
