Every person has the right peacefully to assemble and associate and to form or belong to, or not to belong to, political parties, industrial organizations or other associations, except to the extent that the exercise of that right is regulated or restricted by a law-
(a) that makes reasonable provision in respect of the registration of all or any associations; or
(b) that imposes restrictions on non-citizens; or
(c) that complies with Section 38 (general qualifications on qualified rights). (Sec. 47)

Whereas every person in Nauru is entitled to the fundamental rights and freedoms of the individual, that is to say, has the right, whatever his race, place of origin, political opinions, colour, creed or sex, but subject to respect for the rights and freedoms of others and for the public interest, to each and all of the following freedoms, namely:-

(2) For the purposes of this section, freedom of assembly and association includes-
(a) the right to assemble freely and to associate with other persons; and
(b) the right to form or belong to political parties; and
(c) the right, as regulated by law, to form or belong to trade unions or other associations for the protection or advancement of one’s interests.
