(3) In this section the expression “discriminatory” means affording different treatment to different persons attributable wholly or mainly to their respective descriptions by race, tribe, sex, place of origin, political opinions, colour or creed whereby persons of one such description are subjected to disabilities or restrictions to which persons of another such description are not made subject, or are accorded privileges or advantages which are not accorded to persons of another such description.
(4) Subsection (1) shall not apply to any law so far as that law makes provision—

1. The Republic of Kazakhstan shall recognize and protect state and private property equally.
2. Property shall impose obligations, and its use must simultaneously benefit the society. Subjects and objects of ownership, the scope, and limits of the rights of proprietors, and guarantees of their protection shall be determined by law.
3. The land and its subsoil, water, flora and fauna, and other natural resources belong to the people. On behalf of the people, the right to property is exercised by the state. Land may also be in private ownership on the grounds, conditions and within the limits established by law. (Art. 6) - Kazak
