a. equitable access to land and associated resources;
b. security of tenure for lawful land holders;
c. recognition of indigenous cultural rites;
d. sustainable use of land;
e. transparent, effective and efficient administration of land;
f. effective and efficient settlement of land disputes;
g. river frontages, islands, lakeshores and ecologically and culturally sensitive areas—
i. to be accessible to the public;
ii. not to be leased, fenced or sold; and
iii. to be maintained and used for conservation and preservation activities;
h. investments in land to also benefit local communities and their economy; and

(1) There shall be a Land and Titles Court comprising of:
(a) Land and Titles First Court;
(b) Land and Titles High Court; and
(c) Land and Titles Court of Appeal and Review,
and all appointments and with such jurisdiction in relation to matai title and customary lands provided in this 'Part IX Land and Titles Court' of the Constitution, or an Act of Parliament.
(2) The Courts in this Part IX Land and Titles Court has special jurisdiction, it governs a legal system different and separate from that of the Civil and Criminal Courts in Part VI; and has special individual jurisdiction over the subject of Samoan customs and usages in relation to matai titles and customary lands.

- EnglishIn order to redress the unjust and unfair pattern of land ownership that was brought about by colonialism, and to bring about land reform and the equitable access by all Zimbabweans to the country’s natural resources, policies regarding agricultural land must be guided by the following principles—
(a) land is a finite natural resource that forms part of Zimbabweans’ common heritage;
(b) subject to section 72, every Zimbabwean citizen has a right to acquire, hold, occupy, use, transfer, hypothecate, lease or dispose of agricultural land regardless of his or her race or colour;
(c) the allocation and distribution of agricultural land must be fair and equitable, having regard to gender balance and diverse community interests;
(d) the land tenure system must promote increased productivity and investment by Zimbabweans in agricultural land;
(e) the use of agricultural land should promote food security, good health and nutrition and generate employment, while protecting and conserving the environment for future generations;
(f) no person may be deprived arbitrarily of their right to use and occupy agricultural land. (Sec. 289)

- EnglishThe State, subject to the provisions of this Constitution and national development policies and programs, shall protect the rights of indigenous cultural communities to their ancestral lands to ensure their economic, social, and cultural well-being.
