Status of the Constitution
- English1. If the Constitutional Court rules that a provision of any statute or international agreement is unconstitutional by regular standard, it should be vetoed by the President of the Republic and returned to the body that had approved it.
2. In the case referred to in paragraph 1, the statute may not be promulgated unless the organ that approved it deletes the provision ruled unconstitutional or, as the case may be, it shall confirm by a majority of two thirds of the Deputies present, so long as it is higher than the absolute majority of the sitting Deputies in office.
3. If the law were to be reformulated, the President may request prior review of the constitutionality of any of its provisions.
4. If the Constitutional Court rules that a provision of unconstitutionality agreement or treaty, it may only be ratified if the National Assembly approves it by a majority of two thirds of the Deputies present, provided that that exceeds an absolute majority of the sitting Deputies. The Constitution shall guarantee, and as such, directly implement human and minority rights guaranteed by the generally accepted rules of international law, ratified international treaties and laws. The law may prescribe manner of exercising these rights only if explicitly stipulated in the Constitution or necessary to exercise a specific right owing to its nature, whereby the law may not under any circumstances influence the substance of the relevant guaranteed right.
Provisions on human and minority rights shall be interpreted to the benefit of promoting values of a democratic society, pursuant to valid international standards in human and minority rights, as well as the practice of international institutions which supervise their implementation. Уставом се јемче, и као таква, непосредно се примењују људска и мањинска права зајемчена општеприхваћеним правилима међународног права, потврђеним међународним уговорима и законима. Законом се може прописати начин остваривања ових права само ако је то Уставом изричито предвиђено или ако је то неопходно за остварење појединог права због његове природе, при чему закон ни у ком случају не сме да утиче на суштину зајемченог права.

Status of the Constitution
- English1. If the Constitutional Court rules in favor of the unconstitutionality of a rule contained in an international treaty or agreement, the latter must not be ratified by the President of the Republic, who shall return it to the organ that had approved it.
2. An international treaty or agreement that contains a rule declared to be unconstitutional may be ratified by the President of the Republic if the National Assembly, in consulting the Government, confirms its approval by a majority of two thirds of the Deputies in full exercise of their functions.
3. If the Constitutional Court rules in favor of the unconstitutionality of a rule contained in any legislative act, the instrument must be vetoed by the President of the Republic and returned to the organ that had approved it.
4. In the case foreseen in paragraph 3, the legislative act may not be promulgated unless the organ that had approved it expurgates therefrom the rule judged unconstitutional or, where appropriate, confirms it by a two-thirds majority of Deputies in full exercise of their functions.
