Status of International Law
- English1. The norms and principles of general or common international law form an integral part of Portuguese law.
2. The norms contained in duly ratified or approved international conventions come into force in Portuguese internal law once they have been officially published, and remain so for as long as they are internationally binding on the Portuguese state.
3. The norms issued by the competent organs of international organisations to which Portugal belongs come directly into force in Portuguese internal law, on condition that this is laid down in the respective constituent treaties.
4. The provisions of the treaties that govern the European Union and the norms issued by its institutions in the exercise of their respective competences are applicable in Portuguese internal law in accordance with Union law and with respect for the fundamental principles of a democratic state based on the rule of law. The international treaties and instruments in matters of human rights that have been signed and/or ratified, or those that have been joined by the State, which declare rights more favorable than those contained in the Constitution, shall have preferential application over those in this Constitution.
II. The rights recognized in the Constitution shall be interpreted in agreement with international human rights treaties when the latter provide more favorable norms. (Art. 256) - SpanishI. Status of International Law
- EnglishThe Republic of San Marino receives generally recognised rules of international law as integral part of its constitutional order, to which it shall conform its acts and conduct. It recognises the provisions set forth in the international declarations on human rights and fundamental freedoms.
It reasserts the right to political asylum. It rejects war as a means to settle disputes between States and, in its international policy, adheres to the principles enshrined in the Charter of the United Nations.
San Marino constitutional order recognises, guarantees and enforces the rights and fundamental freedoms set forth by the European Convention for the Protection of Human Rights and Fundamental Freedoms.
Regularly signed and implemented international agreements on the protection of human rights and freedoms shall prevail over domestic legislation in case of conflict. (Art. 1) - ItalianLa Repubblica di San Marino riconosce, come parte integrante del proprio ordinamento, le norme di diritto internazionale generalmente riconosciute e conforma ad esse i suoi atti e la condotta. Si uniforma alle norme contenute nelle dichiarazioni internazionali in tema di diritti dell'uomo e delle libertà fondamentali.
Riconferma il diritto di asilo politico. Rifiuta la guerra come strumento di risoluzione delle controversie fra Stati e si conforma, nell'azione internazionale, ai principi sanciti dallo Statuto delle Nazioni Unite.
L'ordinamento sammarinese riconosce, garantisce ed attua i diritti e le libertà fondamentali enunciate nella Convenzione Europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali.
Gli accordi internazionali in tema di protezione delle libertà e dei diritti dell'uomo, regolarmente stipulati e resi esecutivi, prevalgono in caso di contrasto sulle norme interne. (Art. 1)

- EnglishAll persons have the right to the recourse of habeas corpus to guarantee their personal freedom and integrity, and to the recourse of amparo to maintain or reestablish the enjoyment of the other rights consecrated in this Constitution, as well as those of a fundamental character established in the international instruments concerning human rights, applicable in the Republic.
