The following may file direct actions of unconstitutionality and declaratory actions of constitutionality:
I – the President of the Republic;
II – the directing board of the Federal Senate;
III – the directing board of the Chamber of Deputies;
IV – the Directing Board of a State Legislative Assembly or of the Federal District Legislative Chamber;
V – a State Governor or the Federal District Governor;
VI – the Attorney-General of the Republic;
VII – the Federal Council of the Brazilian Bar Association;
VIII – a political party represented in the National Congress;
IX – a confederation of labour unions or a professional association of a nationwide nature.

- EnglishIf a court deciding some matter deems a law which it should apply to be unconstitutional, it must stay the proceedings and initiate proceedings before the Constitutional Court. The proceedings in the court may be continued after the Constitutional Court has issued its decision. (Art. 156)

2 For disputes that do not relate to a legal issue of fundamental importance, the law may stipulate a threshold for the amount in dispute.

- EnglishCitizens individually or collectively shall be entitled to file a special petition for protection against judgments, final writs or resolutions that have the force of sentencing. For ruling on the admissibility of this appeal, the court shall check compliance with the following requirements:
1. That the judgments, writs and resolutions are final and fully enforceable.
2. That the complainant shows that, in the judgment, there has been a breach, either by deed or omission, of due process of law or other rights enshrined in the Constitution. - English(1) The Supreme Court shall be a superior court of record, shall consist of a Chief Justice and such number of other judges as may from time to time be prescribed by Act, and shall have appellate jurisdiction, as to both law and fact, with final authority to adjudicate all cases and controversies properly brought before it, in accord with this Constitution and other applicable laws of the Republic of the Marshall Islands.
(2) An appeal shall lie to the Supreme Court:

(b) as of right from any final decision of the High Court in the exercise of any appellate jurisdiction, but only if the High Court certifies that the case involves a substantial question of law as to the interpretation or effect of any provision of the Constitution;

- English(1) An appeal to the Court of Appeal shall lie as of right from decisions of the High Court in the following cases, that is to say -
(a) final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution; and
(b) final decisions given in exercise of the jurisdiction conferred on the High Court by article 153 (which relates to the enforcement of fundamental rights and freedoms).
(2) Nothing in paragraph (1) shall apply to the matters for which provision is made by article 163. (Art. 133)
