(1) The Constitutional Court pronounces judgment on the unconstitutionality
1. of laws
a) on application of a court;
b) ex officio in so far as he will have to apply such a law in a suit pending before him;
c) on application by a person who alleges to have infringement of his rights directly by unconstitutionality, if the ordinance has become effective without a judicial decision having been rendered or a ruling having been rendered has become effective for this person;
d) on application by a person who, as a party in a legal matter that has been decided by a court of justice of first instance, alleges infringement of his rights because of the application of an unconstitutional law, on the occasion of an appeal filed against that decision;
(2) of federal laws also on application by a Provincial Government, a third of the members of the National Council or a third of the members of the Federal Council.
(3) of provincial legislation also at the request of the Federal Government or, if the constitutional law of a province so provides, at the request of a third of the members of the Provincial Parliament.

- EnglishThe declaration of the unconstitutionality of a law and the inapplicability of the provisions affected thereby, may be requested by any person who considers that his direct, personal, and legitimate interest is injured:
1. By means of lawsuit, which must be filed before the Supreme Court of Justice;
2. By plea of exception, which may be made in any judicial proceeding.
A judge or court which hears any judicial proceeding, or the Contentious-Administrative Tribunal, as the case may be, may also request the declaration of unconstitutionality of a law and its inapplicability, before rendering a decision.
In this case and in that provided in subparagraph 2 above, the proceedings shall be suspended and the case referred to the Supreme Court of Justice. - sees to the regularity of the election of the duo President of the Republic and Vice President of the Republic; examines the complaints, decides on the irregularities that it has found, by itself, [as] arising and proclaims the results of the ballot; decides on the regularity of the referendum and proclaim the results of it;
- decides, in the case of dispute on the regularity of the legislative elections;

- EnglishThe Constitutional Court is the jurisdiction given the charge of seeing to respect for the provisions of the Constitution.
The Constitutional Court judges the regularity of the referendum consultations, [and] of the presidential, legislative and senatorial elections. It decides on the challenges to these consultations and elections.
It is the judge of the constitutionality of the laws.
The laws may, before their promulgation, be deferred to the Constitutional Court by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate, the President of High Authority of Audiovisuals and of Communications [Haute Autorité de l'Audiovisuel et de la Communication], the President of the Economic and Social Council, the President of the National Commission of the Rights of Man, the President of the Superior Council of the Magistrature, the Mediator of the Republic, the presidents of the parliamentary groups or one-fifth (1/5) of the members of the National Assembly or of the Senate.
To the same ends, the organic laws, before their promulgation, the internal regulations of the National Assembly and of the Senate, those of the High Authority of Audiovisuals and of Communications, [those] of the Economic and Social Council [those] of the National Commission of the Rights of Man, [and those] of the Superior Council of the Magistrature must be submitted to it before their application.
The Constitutional Court may be referred to [the matter] of a demand for [its] opinion on the meaning of the constitutional provisions by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate, the President of High Authority of Audiovisuals and of Communications, the President of the Economic and Social Council, the President of the National Commission of the Rights of Man, the President of the Superior Council of the Magistrature, the Mediator of the Republic and the presidents of the parliamentary groups.
An organic law determines the other authorities and juridical [morale] persons who can refer the Constitutional Court [to matters], in matters of protection of fundamental rights.
In the course of a judicial instance, any physical or juridical person may, in limine litis, before the courts and tribunals, raise the pleadings [exception] of the unconstitutionality of a law. In cases when there are grounds to believe that a law or another legal act that should be applied in a concrete case is in conflict with the Constitution, the judge shall suspend the consideration of the case and shall apply to the Constitutional Court, requesting that it decide whether the law or another legal act in question is in compliance with the Constitution.
