Judicial Protection
- English1. Anyone who considers that any of the rights guaranteed to him by the Constitution has been, is being or is likely to be infringed may, independently of any other possible legal remedy, apply to the Supreme Court to enforce that right.
2. The Supreme Court may make such orders, issue such writs and give such directions, including the payment of compensation, as it considers appropriate to enforce the right. (Art. 6) - French1) Quiconque estime que l'un des droits que lui garantit la Constitution a été, ou risque d'être enfreint, peut, indépendamment de tout autre recours légal possible, saisir la Cour Suprême pour qu'elle fasse respecter ce droit.
2) La Cour Suprême peut rendre toutes les ordonnances, délivrer toutes les assignations et prendre toutes les dispositions qu'elle estime appropriées pour assurer le respect de ce droit, y compris le paiement de dommages et intérêts. (Art. 6)

- EnglishAny violation of any personal freedom, of the sanctity of the private life of human beings, or of any of the rights or liberties that have been guaranteed by law or by this Basic Law shall be considered a crime. Criminal and civil cases resulting from such violations may not be subject to any statute of limitations. The National Authority shall guarantee a fair remedy to those who suffer from such damage. - EnglishAnyone whose rights as enshrined in this Constitution are violated and who, as a consequence, has suffered harm or prejudice by organs of the State, its leaders, functionaries, or employees while exercising their duties of their position or by undue oversight of these duties, as well as by individuals or by non-State entities, has the right to issue a complaint with the court to obtain restitution of their rights and, in accordance with the law, the corresponding redress or indemnity.
The law establishes the rights protected under this guarantee, and the preferential, expedited, and reduced proceedings to comply with it. (Art. 99) - SpanishLa persona a la que se le vulneren los derechos consagrados en esta Constitución y, como consecuencia sufriere daño o perjuicio por órganos del Estado, sus directivos, funcionarios o empleados, con motivo de la acción u omisión indebida de sus funciones, así como por particulares o por entes no estatales, tiene derecho a reclamar ante los tribunales la restitución de los derechos y obtener, de conformidad con la ley, la correspondiente reparación o indemnización.

There is no area which is not subject to [the recourse of] amparo, and it will always proceed whenever the acts, resolutions, provisions, or laws of [an] authority should imply a threat, restraint, or violation of the rights which the Constitution and the laws guarantee. - SpanishSe instituye el amparo con el fin de proteger a las personas contra las amenazas de violaciones a sus derechos o para restaurar el imperio de los mismos cuando la violación hubiere ocurrido. No hay ámbito que no sea susceptible de amparo, y procederá siempre que los actos, resoluciones, disposiciones o leyes de autoridad lleven implícitos una amenaza, restricción o violación a los derechos que la Constitución y las leyes garantizan.
