- English(1) There shall be a Council of Chiefs which shall be composed of twelve Chiefs drawn from the four regions of the Kingdom appointed by the iNgwenyama on a rotational basis.
(2) There shall be a Chairman of the Council who shall be appointed by the iNgwenyama and a secretary whose office shall be a public office.
(3) The Council of Chiefs shall be responsible for, among other things ...
(a) advising the King on customary issues and any matter relating to or affecting chieftaincy including chieftaincy disputes;
(b) performing the function in terms of section 115; and
(c) performing such other functions as may be assigned by this Constitution or any other law.

- English(1) Subject to subsections (4), (5) and (7), no law shall make any provision that is discriminatory either of itself or in its effect.

(3) In this section the expression “discriminatory” means affording different treatment to different persons attributable wholly or mainly to their respective descriptions by race, place of origin, birth out of wedlock, political opinions or affiliations, colour, sex or creed whereby persons of one such description are subjected to disabilities or restrictions to which persons of another such description are not made subject or are accorded privileges or advantages that are not accorded to persons of another such description.
(4) Subsection (1) shall not apply to any law so far as that law makes provision

(c) for the application, in the case of persons of any such description as is mentioned in subsection (3) (or of persons connected with such persons) of the law with respect to adoption, marriage, divorce, burial, devolution of property on death or other like matters that is the personal law of persons of that description;

(1) In exercising his powers under the foregoing provisions of this Chapter11 in respect of appointments to the offices of Justices of the Supreme court and Justices of the Court of Appeal, the President shall have regard to the need to ensure that there are among the holders of such offices persons learned in Islamic personal law and persons learned in Customary law.
(2) For the purposes of subsection (1) of this section –

(b) a person shall be deemed to be learned in Customary law if he is a legal practitioner in Nigeria and has been so qualified for a period of not less than fifteen years in the case of a Justice of the Supreme Court or not less than twelve years in the case of a Justice of the Court of Appeal and has in either case and in the opinion of the National Judicial Council considerable knowledge of and experience in the practice of Customary law. (2) The National Assembly shall not proceed upon any Bill (including any amendment to a Bill) that, in the opinion of the person presiding, would, if enacted, alter any of the provisions of this Constitution or affect-
(a) the designation, recognition, removal of powers of Dikgosi or Dikgosana

(c) customary law, or the ascertainment or recording of customary law; or
(d) tribal organization or tribal property,
unless-
(i) a copy of the Bill has been referred to the Ntlo ya Dikgosi after it has been introduced in the National Assembly; and

- English1. There is established a House of Chiefs.
2. The House of Chiefs shall consist of five chiefs from each province, elected by the chiefs in a Province, as prescribed.
3. The members of the House of Chiefs shall annually elect a Chairperson and Vice-Chairperson of the House of Chiefs, from amongst themselves.
4. Notwithstanding clause (3), the assumption of office as Chairperson and Vice-Chairperson of the House of Chiefs shall rotate annually amongst the chiefs from each province.
5. The functions of the House of Chiefs are to —
a. consider and discuss a Bill relating to custom or tradition referred to it by the President, before the Bill is introduced into the National Assembly;
b. initiate, discuss and make recommendations to the National Assembly regarding socio-economic development in the Province;
c. initiate, discuss and decide on matters relating to customary law and practice;
d. initiate, discuss and make recommendations to a local authority regarding the welfare of communities in a local authority;
e. make proposals on areas in customary law that require codification;
f. advise the Government on traditional and customary matters; and
g. perform other functions as prescribed. (Art. 169)
