Status of the Constitution
- EnglishIf the Constitutional Court referred to [the matter] by the President of the Republic or by a Deputy, has declared that an international engagement contains a clause contrary to the Constitution, the authorization to ratify it or to approve it may only intervene after the revision of the Constitution.
A law authorizing the ratification or the approval of an international engagement may not be promulgated and enter into force when it has been declared nonconforming to the Constitution. When the Constitutional Court judges that a treaty, accord or convention is unconstitutional, its ratification may not take place.
When the Constitutional Court judges that a law is unconstitutional, this may not be promulgated.
When a provision of an ordinance or of a regulation is judged unconstitutional, this loses all effect, counting from the day of the decision of the Court.
When the Constitutional Court judges that a legislative or regulatory provision is unconstitutional on the basis of Article 195 above, it loses all effect, counting from the day established by the decision of the Court.
