The Constitutional Council may be referred to [a matter] by a recourse seeking to have a law declared unconstitutional:
- by the President of the Republic[,] within the six full days which follow the transmission made to him of the law definitely adopted,
- by a number of Deputies at least equal to one-tenth of the members of the National Assembly, within the six full days which follow its definitive adoption. (Art. 74) - French

The Constitutional Court is referred [to a matter] by the President of the Republic, the President of the Council of the Nation, the President of the National People's Assembly or by the Prime Minister or the Head of the Government, according to the case.
It may equally be referred [to a matter] by forty (40) Deputies or twenty-five (25) members of the Council of the Nation.
The exercise of the referral enunciated in the two preceding paragraphs does not extend to the referral [to a matter] in a pleading [exception] of unconstitutionality enunciated in Article 195 below. (Art. 193) - Arabic
تخطر المحكمة الدستورية من رئيس الجمهورية أو رئيس مجلس األمة أو رئيس المجلس الشعبي الوطني أو من الوزير األول أو رئيس الحكومة، حسب الحالة.
يمكن إخطارها كذلك من أربعين (40) نائبا أو خمسة وعشرين (25) عضوا في مجلس األمة.

La Cour constitutionnelle est saisie par le Président de la République, le Président du Conseil de la Nation, le Président de l’Assemblée Populaire Nationale ou par le Premier ministre ou le Chef du Gouvernement, selon le cas.
Elle peut être également saisie par quarante (40) députés ou vingt-cinq (25) membres du Conseil de la Nation.

– decide on the constitutionality of the laws and of the regulatory acts taken in the matters other than those arising within the domain of the law;
– assure the respect for this Constitution including the Charte des Droits fundamentaux [Charter of Fundamental Rights], by the organs of the State, [and] the other institutions;
– interpret the Constitution, at the demand of the President of the Republic, of the President of the National Assembly, of the President of the Senate, of one-quarter of the Deputies or of one-quarter of the Senators;
– decide on the regularity of the presidential elections, legislative [elections] and of the referenda and to proclaim the definitive results of them;
– receive the oath of the President of the Republic, of the Vice President of the Republic, of the Prime Minister and of the other Ministers before their entry into [their] functions;
– declare the vacancy of the post of President of the Republic.
– declare the vacancy of the seats of the parliamentarians.
The organic laws before their promulgation, the international treaties before submitting them to the vote of the Assemblies, the internal regulations of the National Assembly and of the Senate before their application, are submitted obligatory to the control of constitutionality. - EnglishThe international engagements specified in Articles 114 to 116 must be deferred before their ratification to the Constitutional Court, either by the President of the Republic, or by the Prime Minister, or by the President of the National Assembly or by one-tenth of the Deputies, or by the President of the High Council of the Collectivities or by one-tenth of the National Councilors.
The Constitutional Court verifies, within a time of one month, if these engagements contain a clause contrary to the Constitution.

The Constitutional Court[,]
- decides obligatorily on:
• the constitutionality of the organic laws before their promulgation;
• the Internal Regulations of the National Assembly, of the High Authority for Broadcasting and of Communication and of the Economic and Social Council prior to their implementation, as well their conformity with the Constitution;
• the constitutionality of the laws and of the regulatory acts supposedly infringing the fundamental rights of the human person and the public freedoms and in general, on the violation of the rights of the human person;
• the conflicts of attributions between the institutions of the State.
• the disputes of the election of the duo President of the Republic and Vice President of the Republic and of the members of the National Assembly;
- sees to the regularity of the election of the duo President of the Republic and Vice President of the Republic; examines the complaints, decides on the irregularities that it has found, by itself, [as] arising and proclaims the results of the ballot; decides on the regularity of the referendum and proclaim the results of it;
- decides, in the case of dispute on the regularity of the legislative elections;
- forms [fait], of right, [its] part of the High Court of Justice with the exception of its President. (Art. 117) - French
La Cour constitutionnelle

• la constitutionnalité des lois organiques avant leur promulgation ;
• les règlements intérieurs de l’Assemblée nationale, de la Haute Autorité de l’Audiovisuel et de la Communication et du Conseil économique et social avant leur mise en application, quant à leur conformité à la Constitution ;
• la constitutionnalité des lois et des actes réglementaires censés porter atteinte aux droits fondamentaux de la personne humaine et aux libertés publiques en général, sur la violation des droits de la personne humaines ;
• les conflits d’attributions entre les institutions de l’Etat ;
• le contentieux de l’élection du duo Président de la République et vice-président de la République et des membres de l’Assemblée nationale ;
- veille à la régularité de l’élection du duo Président de la République et vice-président de la république ; examine les réclamations, statue sur les irrégularités qu’elle aurait pu, par ellemême, relever et proclame les résultats du scrutin ; statue sur la régularité du référendum et en proclame les résultats ;
- statue, en cas de contestation, sur la régularité des élections législatives ;
- fait de droit partie de la Haute Cour de justice à l’exception de son président. (Art. 117)

- EnglishThe Constitutional Court is the judge of the exceptions of unconstitutionality raised before or by a jurisdiction.
Any person may refer the Constitution Court to [a matter concerning] the unconstitutionality of any legislative or regulatory act.
In addition, he may refer the Constitutional Court to [a matter], by the procedure of the exception of unconstitutionality invoked in a matter concerning him before a jurisdiction.
That [jurisdiction] stays [its] decision and refers the Constitutional Court to [it], all [other] matters ceasing. (Art. 162) - FrenchLa Cour constitutionnelle est juge de l’exception d’inconstitutionnalité soulevée devant ou par une juridiction.
Toute personne peut saisir la Cour constitutionnelle pour inconstitutionnalité de tout acte législatif ou réglementaire.
Elle peut, en outre, saisir la Cour constitutionnelle, par la procédure de l’exception de l’inconstitutionnalité invoquée dans une affaire qui la concerne devant une juridiction.
