- EnglishThe Constitutional Court is the jurisdiction competent in constitutional and electoral matters.
It is charged with deciding on the constitutionality of the laws, of the ordinances as well as of the conformity of international treaties and agreements with the Constitution.
It interprets the provisions of the Constitution. It controls the regularity, the transparency and the honesty [sincérité] of the referendum, [and] of the presidential and legislative elections. It is [the] judge of the electoral disputes [contentieux] and proclaims the definitive results of the elections. Elle est chargée de statuer sur la constitutionnalité des lois, des ordonnances ainsi que de la conformité des traités et accords internationaux à la Constitution.

Any citizen can refer [a matter] to the Constitutional Court on the constitutionality of the laws, either directly, or by the procedure of the pleadings [exception] of unconstitutionality invoked in a matter which concerns that citizen before a jurisdiction. The organic laws, before their promulgation, and the Internal Regulations of the parliamentary Chambers and of the Congress, of the Independent National Electoral Commission as well as of the Superior Council for Audiovisual and Communication, before their entry into application, must be submitted to the Constitutional Court which rules on their conformity with the Constitution.
For the same end of examining [the] constitutionality, the laws may be referred to the Constitutional Court, before their promulgation, by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate or a tenth of the Deputies or of the Senators.

The Constitutional Council is referred to [a matter] by:
• the President of Faso;
• the Prime Minister;
• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].
The Constitutional Council can refer itself to any questions relative to its competence, if it judges it necessary. (Art. 157) - French

Celle-ci doit surseoir jusqu’à la décision du Conseil constitutionnel qui doit intervenir dans un délai maximum de trente jours à compter de sa saisine.
Le Conseil constitutionnel peut se saisir de toutes questions relevant de sa compétence s’il le juge nécessaire. (Art. 157)
