(1) Save as otherwise provided in the following paragraphs, legislation and execution in the field of schooling and in the field of education in matters pertaining to pupil hostels are the business of the Federation. The matters settled in Art. 14a do not belong to schooling and education within the meaning of this Article.

(5a) Democracy, humanity, solidarity, peace and justice as well as openness and tolerance towards people are the elementary values of the school, based on which it secures for the whole population, independent from origin, social situation and financial background a maximum of educational level, permanently safeguarding and developing optimal quality. In a partnership - like cooperation between pupils, parents and teachers, children and juveniles are to be allowed the optimal intellectual, mental and physical development to let them become healthy, self-confident, happy, performance-oriented, dutiful, talented and creative humans capable to take over responsibility for themselves, fellow human beings, environment and following generations, oriented in social, religious and moral values. Any juvenile shall in accordance with his development and educational course be led to independent judgement and social understanding, be open to political, religious and ideological thinking of others and become capable to participate in the cultural and economic life of Austria, Europe and the world and participate in the common tasks of mankind, in love for freedom and peace.
(6) Schools are institutions in which pupils shall be educated together according to a comprehensive fixed curriculum and in which, in connection with the imparting of knowledge and skills, a comprehensive educational goal is strived for. ... Admission to public school is open to all without distinction of birth, sex, race, estate, class, language and religion, and in other respects within the limits of the statutory requirements. The same shall apply accordingly to kindergartens, day homes and student hostels.

(7a) The compulsory school attendance is at least nine years and also compulsory vocational school attendance exists.

(1) Bundessache ist die Gesetzgebung und die Vollziehung auf dem Gebiet des Schulwesens sowie auf dem Gebiet des Erziehungswesens in den Angelegenheiten der Schülerheime, soweit in den folgenden Absätzen nicht anderes bestimmt ist. Zum Schul- und Erziehungswesen im Sinne dieses Artikels zählen nicht die im Art. 14a geregelten Angelegenheiten.

5a) Demokratie, Humanität, Solidarität, Friede und Gerechtigkeit sowie Offenheit und Toleranz gegenüber den Menschen sind Grundwerte der Schule, auf deren Grundlage sie der gesamten Bevölkerung, unabhängig von Herkunft, sozialer Lage und finanziellem Hintergrund, unter steter Sicherung und Weiterentwicklung bestmöglicher Qualität ein höchstmögliches Bildungsniveau sichert. Im partnerschaftlichen Zusammenwirken von Schülern, Eltern und Lehrern ist Kindern und Jugendlichen die bestmögliche geistige, seelische und körperliche Entwicklung zu ermöglichen, damit sie zu gesunden, selbstbewussten, glücklichen, leistungsorientierten, pflichttreuen, musischen und kreativen Menschen werden, die befähigt sind, an den sozialen, religiösen und moralischen Werten orientiert Verantwortung für sich selbst, Mitmenschen, Umwelt und nachfolgende Generationen zu übernehmen. Jeder Jugendliche soll seiner Entwicklung und seinem Bildungsweg entsprechend zu selbständigem Urteil und sozialem Verständnis geführt werden, dem politischen, religiösen und weltanschaulichen Denken anderer aufgeschlossen sein sowie befähigt werden, am Kultur- und Wirtschaftsleben Österreichs, Europas und der Welt teilzunehmen und in Freiheits- und Friedensliebe an den gemeinsamen Aufgaben der Menschheit mitzuwirken.
(6) Schulen sind Einrichtungen, in denen Schüler gemeinsam nach einem umfassenden, festen Lehrplan unterrichtet werden und im Zusammenhang mit der Vermittlung von allgemeinen oder allgemeinen und beruflichen Kenntnissen und Fertigkeiten ein umfassendes erzieherisches Ziel angestrebt wird. ... Öffentliche Schulen sind allgemein ohne Unterschied der Geburt, des Geschlechtes, der Rasse, des Standes, der Klasse, der Sprache und des Bekenntnisses, im Übrigen im Rahmen der gesetzlichen Voraussetzungen zugänglich. Das Gleiche gilt sinngemäß für Kindergärten, Horte und Schülerheime.

(7a) Die Schulpflicht beträgt zumindest neun Jahre und es besteht auch Berufsschulpflicht.

- English1 The Cantons are responsible for the system of school education.
2 They shall ensure the provision of an adequate basic education that is available to all children. Basic education is mandatory and is managed or supervised by the state. At state schools it is free of charge.
3 The Cantons shall ensure that adequate special needs education is provided to all children and young people with disabilities up to the age of 20.
4 Where harmonisation of school education is not achieved by means of coordination in the areas of school entry age and compulsory school attendance, the duration and objectives of levels of education, and the transition for one level to another, as well as the recognition of qualifications, the Confederation shall issue regulations to achieve such harmonisation.

6 The Cantons shall participate in the drafting of federal legislation on school education that affects cantonal responsibilities, and special account shall be taken of their opinions. (Art. 62) - French1 L’instruction publique est du ressort des cantons.

4 Si les efforts de coordination n’aboutissent pas à une harmonisation de l’instruction publique concernant la scolarité obligatoire, l’âge de l’entrée à l’école, la durée et les objectifs des niveaux d’enseignement et le passage de l’un à l’autre, ainsi que la reconnaissance des diplômes, la Confédération légifère dans la mesure nécessaire.

6 Les cantons sont associés à la préparation des actes de la Confédération qui affectent leurs compétences; leur avis revêt un poids particulier. (Art. 62) - German1 Für das Schulwesen sind die Kantone zuständig.
2 Sie sorgen für einen ausreichenden Grundschulunterricht, der allen Kindern offen steht. Der Grundschulunterricht ist obligatorisch und untersteht staatlicher Leitung oder Aufsicht. An öffentlichen Schulen ist er unentgeltlich.
3 Die Kantone sorgen für eine ausreichende Sonderschulung aller behinderten Kinder und Jugendlichen bis längstens zum vollendeten 20. Altersjahr.
4 Kommt auf dem Koordinationsweg keine Harmonisierung des Schulwesens im Bereich des Schuleintrittsalters und der Schulpflicht, der Dauer und Ziele der Bildungsstufen und von deren Übergängen sowie der Anerkennung von Abschlüssen zustande, so erlässt der Bund die notwendigen Vorschriften.

6 Bei der Vorbereitung von Erlassen des Bundes, welche die Zuständigkeit der Kantone betreffen, kommt der Mitwirkung der Kantone besonderes Gewicht zu. (Art. 62) - Italian1 Il settore scolastico compete ai Cantoni.
2 I Cantoni provvedono a una sufficiente istruzione scolastica di base, accessibile a tutti i giovani. L’istruzione di base è obbligatoria e sottostà alla direzione o vigilanza dello Stato. Nelle scuole pubbliche è gratuita.
3 I Cantoni provvedono altresì a una sufficiente istruzione scolastica speciale per tutti i fanciulli e giovani disabili, fino al massimo al compimento del ventesimo anno di età.
4 Se gli sforzi di coordinamento non sfociano in un’armonizzazione del settore scolastico per quanto riguarda l’età d’inizio della scolarità e la scuola dell’obbligo, la durata e gli obiettivi delle fasi della formazione e il passaggio dall’una all’altra fase, nonché il riconoscimento dei diplomi, la Confederazione emana le norme necessarie.

6 È attribuita particolare importanza alla partecipazione dei Cantoni all’elaborazione degli atti legislativi federali che concernono le loro competenze. (Art. 62)
