2. The law shall establish effective guarantees against the procurement and use of information relating to individuals and families in a manner which is abusive or offends against human dignity. - English1. Everyone shall have the right to enter into matrimony, in civil or religious form.
2. The law shall regulate the requirements, the civil effects of marriage and its dissolution, irrespective of the form of its celebration.
3. Spouses shall have equal civil and political rights and duties.
4. Children shall only be separated from their parents through judicial decision and strictly in cases foreseen in the law, should the parents not comply with their fundamental duties towards them.
5. The discrimination against children born out of wedlock or the use of any discriminatory designation with respect to parenting shall not be allowed.
6. Adoption shall be allowed, with the law regulating its forms and conditions. (Art. 47) - Portuguese1. Todos têm direito de contrair casamento, sob forma civil ou religiosa.

Every Brazilian in a situation of social vulnerability is entitled to a basic family income, guaranteed by the government in a permanent income transfer program, whose rules and access requirements will be determined by law, in compliance with fiscal and budgetary legislation. 2. The law shall regulate the requisites for and the effects of marriage and its dissolution by death or divorce, regardless of the form in which it was entered into.
3. Spouses have equal rights and duties in relation to their civil and political capacity and to the maintenance and education of their children.
4. Children born outside wedlock may not be the object of any discrimination for that reason, and neither the law, nor official departments or services may employ discriminatory terms in relation to filiation.
5. Parents have the right and the duty to educate and maintain their children.
6. Children may not be separated from their parents, save when the latter do not fulfil their fundamental duties towards them, and then always by judicial decision.

6. Os filhos não podem ser separados dos pais, salvo quando estes não cumpram os seus deveres fundamentais para com eles e sempre mediante decisão judicial.
7. A adopção é regulada e protegida nos termos da lei, a qual deve estabelecer formas céleres para a respectiva tramitação. (Art. 36)

2. Fathers and mothers shall have the right to protection by the society and by the State as regards the realization of their irreplaceable role in relation to children.
