- English1. Martial law or a state of emergency can only be declared, in the whole or part of the national territory, in cases of effective or imminent foreign aggression, grave threat or disturbance of the democratic constitutional order, or political calamity.
2. The declaration of martial law cannot affect the right to life, integrity and identity, civil capacity and citizenship, non-retroactivity of penal laws, right to defense of the accused and liberty of conscience and religion.
3. The declaration of a state of emergency can only result in the partial suspension of rights, liberties and guarantees. - English1. Entities that exercise sovereignty may not jointly or separately suspend the exercise of the rights, freedoms and guarantees, save in the case of a state of siege or a state of emergency declared in the form provided for in the Constitution.

Both the choice between a state of siege and a state of emergency and the declaration and implementation thereof must respect the principle of proportionality and limit themselves, particularly as regards their extent and duration and the means employed, to that which is strictly necessary for the prompt restoration of constitutional normality.
5. Declarations of a state of siege or a state of emergency shall set out adequate grounds therefore and specify the rights, freedoms and guarantees whose exercise is to be suspended. A opção pelo estado de sítio ou pelo estado de emergência, bem como as respectivas declaração e execução, devem respeitar o princípio da proporcionalidade e limitar-se, nomeadamente quanto às suas extensão e duração e aos meios utilizados, ao estritamente necessário ao pronto restabelecimento da normalidade constitucional.

The President of the Republic may, after hearing the Council of the Republic and the National Defense Council, decree a state of defense to preserve or to promptly re-establish, in specific and restricted locations, the public order or the social peace threatened by serious and imminent institutional instability or affected by major natural calamities.
Paragraph 1. The decree instituting the state of defense shall determine the period of its duration, shall specify the areas to be encompassed and shall indicate, within the terms and limitations of the law, the coercive measures to be in force from among the following:
I – restrictions to the rights of:
a) assembly, even if held within associations;
b) secrecy of correspondence;
c) secrecy of telegraph and telephone communication;
