- EnglishThe minimum social rights that form the basis of the labor legislation and the activity of the tribunals and [the] authorities [are]:
a. The right to the free choice [elección] of work and the satisfactory economic conditions that guarantee a dignified existence for the worker and his [or her] family;
b. That all work be equitably remunerated, except with what the law determines in that regard;
c. The equality of salary for the same rendered work in equality of conditions, productivity, and seniority;
d. The obligation to pay the worker in currency of legal tender. However, the field worker [trabajador de campo] can receive, by choice [a su voluntad], food products until up to thirty percent of his [or her] salary. In this case the employer will provide those products at a price no superior than their cost;
e. The freedom from lien [inembargabilidad] of the salary in the cases determined by the law. The personal work implements may not be subject to a lien for any reason. Nevertheless, for the protection of the family of the worker and by judicial order, part of the salary can be retained and delivered to the corresponding [party];
f. The periodic establishment [fijación] of the minimum salary in accordance with the law;
g. The ordinary effective workday [jornada] can neither exceed eight hours of work per day, nor forty-four hours per week, equivalent to forty-eight hours for the exclusive purpose of the payment of the salary.
The ordinary effective workday on the night shift can neither exceed six hours per day, nor thirty-six hours per week. The mixed ordinary effective workday can neither exceed seven hours per day, nor forty-two hours per week. All work effectively performed outside [of the] ordinary working hours, constitutes an extraordinary workday and must be remunerated as such. The law will determine the very qualified situations of exception where the provisions relative to the workdays are not applicable.
Those that by provision of the law, by custom or by agreement with the employers work less than forty-four hours per week during the day, thirty-six hours during the night, or forty-two hours in mixed-schedule workdays, will have the right to receive the weekly salary in its entirety.
It is understood that effective work means the entire time that the worker remains under the orders or at the disposal of the employer;
h. The right of the worker to a day of remunerated rest for each ordinary work week or for any six consecutive workdays. The holidays [días de asueto] recognized by the law will also be remunerated;
i. The right of the worker to fifteen working days of paid vacation after each year of continuous service, with the exception of agricultural enterprise workers, who will have the right to ten working days [of vacation]. The vacations must be effective and the employer may not compensate such right in a different manner, except when the labor relationship already acquired would cease;
j. The obligation of the employer to grant[,] every year[,] a bonus [aguinaldo] of no less than one hundred percent of the monthly salary, or the one already established if greater, to those workers who may have worked for an uninterrupted year prior to the date of the payment. The law will regulate the form of payment. For those workers with less than one year of service, such bonus will be covered proportionally to the time [of duration] of [the] work;
k. The protection of the working woman and [the] regulation of the conditions under which she must render her services.
There may not be differences established between married and single women in terms of [the] work. The law will regulate the protection of the maternity rights of the working woman, who may not be required to [conduct any] work that may require an effort that puts her pregnancy in jeopardy [gravidez]. The working mother will enjoy a compulsory rest [period] [descanso forzoso] paid on the basis of one hundred percent of her salary, during the thirty days prior to giving birth and [during] the subsequent forty-five days. During the period of lactation she will have the right to two periods of extraordinary rest, during her workday. The prenatal and postnatal rest periods will be expanded according to her physical conditions, by medical prescription;

r. The establishment of economic institutions and of social prevision which, in benefit of the workers, grant benefits of all types, especially for disability, retirement, and survival;

g) La jornada ordinaria de trabajo efectivo diurno no puede exceder de ocho horas diarias de trabajo, ni de cuarenta y cuatro horas a la semana, equivalente a cuarenta y ocho horas para los efectos exclusivos del pago del salario.
La jornada ordinaria de trabajo efectivo nocturno no puede exceder de seis horas diarias, ni de treinta y seis a la semana. La jornada ordinaria de trabajo efectivo mixto no puede exceder de siete horas diarias, ni de cuarenta y dos a la semana. Todo trabajo efectivamente realizado fuera de las jornadas ordinarias, constituye jornada extraordinaria y debe ser remunerada como tal. La ley determinará las situaciones de excepción muy calificadas en las que no son aplicables las disposiciones relativas a las jornadas de trabajo.
Quienes por disposición de la ley, por la costumbre o por acuerdo con los empleadores laboren menos de cuarenta y cuatro horas semanales en jornada diurna, treinta y seis en jornada nocturna, o cuarenta y dos en jornada mixta, tendrán derecho a percibir íntegro el salario semanal.
Se entiende por trabajo efectivo todo el tiempo que el trabajador permanezca a las órdenes o a disposición del empleador.
h) Derecho del trabajador a un día de descanso remunerado por cada semana ordinaria de trabajo o por cada seis días consecutivos de labores. Los días de asueto reconocidos por la ley también serán remunerados;
i) Derecho del trabajador a quince días hábiles de vacaciones anuales pagadas después de cada año de servicios continuos, a excepción de los trabajadores de empresas agropecuarias, quienes tendrán derecho de diez días hábiles. Las vacaciones deberán ser efectivas y no podrá el empleador compensar este derecho en forma distinta, salvo cuando ya adquirido cesare la relación del trabajo;
j) Obligación del empleador de otorgar cada año un aguinaldo no menor del ciento por ciento del salario mensual, o el que ya estuviere establecido si fuere mayor a los trabajadores que hubieren laborado durante un año ininterrumpido y anterior a la fecha del otorgamiento. La ley regulará su forma de pago. A los trabajadores que tuvieren menos del año de servicios, tal aguinaldo les será cubierto proporcionalmente al tiempo laborado;
k) Protección a la mujer trabajadora y regulación de las condiciones en que debe prestar sus servicios.
No deben establecerse diferencias entre casadas y solteras en materia de trabajo. La ley regulará la protección a la maternidad de la mujer trabajadora, a quien no se le debe exigir ningún trabajo que requiera esfuerzo que ponga en peligro su gravidez. La madre trabajadora gozará de un descanso forzoso retribuido con el cinto por ciento de su salario, durante los treinta días que precedan al parto y los cuarenta y cinco días siguientes. En la época de la lactancia tendrá derecho a dos períodos de descanso extraordinarios, dentro de la jornada. Los descansos pre y postnatal serán ampliados según sus condiciones físicas, por prescripción médica;

The workers have the right to conditions of work that assure to them[,] especially:
1. Equal pay [salario] for equal work in identical conditions, adequate to their social responsibility, without discrimination for political, religious, [or] social reasons, [reasons] of sex or of any other type [clase], that assures to them a well being compatible with human dignity.
2. To be remunerated in legal tender at their place [centro] of work.
3. The minimum wage and social security payments [are] not attachable, except for protection of their [su] family and in the terms that the law establishes.

Los trabajadores tienen derecho a condiciones de trabajo que les aseguren en especial:
1) Salario igual por trabajo igual en idénticas condiciones, adecuado a su responsabilidad social, sin discriminaciones por razones políticas, religiosas, sociales, de sexo o de cualquier otra clase, que les asegure un bienestar compatible con la dignidad humana.
2) Ser remunerado en moneda de curso legal en su centro de trabajo.
3) La inembargabilidad del salario mínimo y las prestaciones sociales, excepto para protección de su familia y en los términos que establezca la ley.
4) Condiciones de trabajo que les garanticen la integridad física, la salud, la higiene y la disminución de los riesgos profesionales para hacer efectiva la seguridad ocupacional del trabajador.
5) Jornada laboral de ocho horas, descanso semanal, vacaciones, remuneración por los días feriados nacionales y salario por décimo tercer mes de conformidad con la ley.

- EnglishThe workers of both sexes have the same labor rights and obligations, but maternity will be subject to special protection, that will include the assistance services and the corresponding leaves of absence [descansos], which will not be less than 12 weeks. II. The labor norms shall be interpreted and applied based on the following principles: the protection of workers as the primary productive force of society; the primacy of the labor relation; work continuity and stability; non discrimination and the making of investments in favor of the worker.
III. The recognized rights and benefits in favor of workers cannot be waived, and agreements that are contrary to, or that tend to deride their effects, are null and void.
IV. The salaries or earned pay, labor rights, social benefits and contributions to social security, which are not paid, have a privilege and priority over any other debt and may not be attached or made unenforceable.
V. The State shall promote the incorporation of women into the workforce and shall guarantee them the same remuneration as men for work of equal value, both in the public and private arena.
VI. Women shall not be discriminated against or fired because of their civil status, because of pregnancy, because of their age or physical features, or because of the number of children they have. It is guaranteed that pregnant women and parents cannot be dismissed from employment until the child completes one year of age.

- EnglishLaws governing the relations between employers and workers are matters of public policy. All acts, stipulations or agreements that involve the waiver, diminution or restriction or evasion of the following guarantees shall be void:
1. Regular day work shall not exceed eight hours a day, nor forty-hour hours a week.
Regular nightwork shall not exceed six hours a day or thirty-six hours a week.
Regular combined work shall not exceed seven hours a day or forty-two hours a week.
All work shall be paid for at a rate equivalent to forty-eight hours a week.
Overtime work shall be paid for in the manner specified by law.
These provisions shall not apply in those well-defined exceptional cases indicated by law.
2. No worker shall be required to perform work which covers more than twelve hours in any period of twenty-four consecutive hours, except in those cases specified by law.
3. Equal work shall receive equal pay without discrimination, provided that the position, the working hours, the conditions of efficiency and the time of service are also equal.
Wages must be paid in legal tender.
4. The amount of wages, indemnity compensation, and social benefits shall constitute a preferred credit in accordance with law.
5. Every worker is entitled to minimum wages fixed periodically by participation of the State, employers and workers, sufficient to meet the normal material, moral and cultural needs of his household, in accordance with the standards of each kind of work, the conditions peculiar to each region and type of work, the cost of living, the relative skill of workers, and the pay systems of the enterprises.
A minimum occupational wage shall also be fixed for those activities not wage regulated by a collective contract or agreement.
The minimum wage shall be exempt from attachment, compensation or discount except as prescribed by law governing family and trade union obligations.

In the facilities of his establishments, the employer must observe and enforce the legal provisions concerning hygiene and health and adopt adequate safety measures in work, which help to prevent occupational hazards and ensure the physical and mental integrity of workers. Employers in agricultural enterprises are also subject to the same security system. Special protection shall be given to women and minors.

8. A worker shall be entitled to annual paid vacations. The duration and time of which shall be regulated by law.
In any event, a worker shall be entitled to a cash payment for vacations already earned and for proportional vacations corresponding to the period worked.
Vacations may not be compensated by a cash payment, nor accumulated, and the employer shall be obliged to give them to the worker and the worker must take them.
The law shall regulate this obligation and shall determine the exceptional cases which permit the accumulation and compensation of vacations.
9. Workers shall be entitled to leave with pay for holidays specified by law. The law shall also specify what kind of work shall not be governed by this provision, but in such cases workers shall be entitled to overtime.
10. The right of workers to receive payment for a seventh day is hereby recognized; permanent workers shall receive, in addition, payment for a thirteenth month as a Christmas bonus. The law shall regulate the terms and manner of application of this provision.
11. A woman is entitled to leave before and after childbirth, without loss of employment or wages. During the nursing period she shall be entitled to a rest period each day for nursing her child. The employer may not terminate the employment contract of a pregnant woman, even after childbirth, except for justifiable cause shown before a competent judge, in the cases and conditions indicated by law.
12. Employers shall be required to indemnify their workers for work injuries and occupational diseases, according to law.
… (Art. 128) - SpanishLas leyes que rigen las relaciones entre patronos y trabajadores son de orden público. Son nulos los actos, estipulaciones o convenciones que impliquen renuncia, disminuyan, restrinjan o tergiversen las siguientes garantías:
1. La jornada diurna ordinaria de trabajo no excederá de (8) ocho horas diarias, ni de (44) cuarenta y cuatro a la semana.
La jornada nocturna ordinaria de trabajo no excederá de (6) seis horas diarias, ni de treinta y seis (36) a la semana. La jornada mixta ordinaria de trabajo no excederá de (7) siete horas diarias ni de (42) cuarenta y dos a la semana;
Todas estas jornadas se remunerarán con un salario igual al de (48) cuarenta y ocho horas de trabajo. La remuneración del trabajo realizado en horas extraordinarias se hará conforme a lo que dispone la Ley:
Estas disposiciones no se aplicarán en los casos de excepción, muy calificados, que la Ley señale;
2. A ningún trabajador se podrá exigir el desempeño de labores que se extiendan a más de (12) doce horas en cada período de (24) veinticuatro horas sucesivas, salvo los casos calificados por la Ley;
3. A trabajo igual corresponde salario igual sin discriminación alguna, siempre que el puesto, la jornada y las condiciones de eficiencia y tiempo de servicio sean también iguales.
El salario deberá pagarse con moneda de curso legal.
4. Los créditos a favor de los trabajadores por salarios, indemnización y demás prestaciones sociales, serán singularmente privilegiados, de conformidad con la ley:

Todo trabajador tiene derecho a devengar un salario mínimo, fijado periódicamente con intervención del Estado, los patronos y los trabajadores, suficiente para cubrir las necesidades normales de su hogar, en el orden material y cultural, atendiendo a las modalidades de cada trabajo, a las particulares condiciones de cada región y de cada labor, al costo de la vida, a la aptitud relativa de los trabajadores y a los sistemas de remuneración de las empresas;
Igualmente se señalará un salario mínimo profesional en aquellas actividades en que el mismo no estuviese regulado por un contrato o convención colectiva;
El salario mínimo está exento de embargo, compensación y deducciones, salvo lo dispuesto por la Ley atendiendo a obligaciones familiares y sindicales del trabajador;
6. El patrono está obligado a cumplir y hacer que se cumplan en las instalaciones de sus establecimientos, las disposiciones legales sobre higiene y salubridad, adoptando las medidas de seguridad adecuadas en el trabajo, que permitan prevenir los riesgos profesionales y asegurar la integridad física y mental de los trabajadores.
Bajo el mismo régimen de previsión quedan sujetos los patronos de explotaciones agrícolas, Se establecerá una protección especial para la mujer y los menores.

8. El trabajador tendrá derecho a disfrutar cada año de un período de vacaciones remuneradas, cuya extensión y oportunidad serán reguladas por la Ley:
En todo caso, el trabajador tendrá derecho al pago en efectivo de las vacaciones causadas y de las proporcionales correspondientes al período trabajado;
Las vacaciones no podrán compensarse por dinero, ni acumularse y el patrono esta obligado a otorgarlas al trabajador y éste a disfrutarlas;
La Ley regulará estas obligaciones y señalará los casos de excepción permitidos para acumular y compensar vacaciones;
9. Los trabajadores tendrán derecho a descanso remunerado en los días feriados que señale la Ley. Esta determinará la clase de labores en que no regirá esta disposición pero en estos casos los trabajadores tendrán derecho a remuneración extraordinaria;
10. Se reconoce el derecho de los trabajadores al pago del séptimo día; los trabajadores permanentes recibirán, además, el pago del décimo tercer mes en concepto de aguinaldo. La Ley regulará las modalidades y forma de aplicación de estas disposiciones;
11. La mujer tiene derecho a descanso antes y después del parto, sin pérdida de su trabajo ni de su salario. En el período de lactancia tendrá derecho a un descanso por día para amamantar a sus hijos. El patrono no podrá dar por terminado el contrato de trabajo de la mujer grávida ni después del parto, sin comprobar previamente una causa justa ante juez competente, en los casos y condiciones que señale la Ley.
12. Los patronos están obligados a indemnizar al trabajador por los accidentes de trabajo y las enfermedades profesionales, de conformidad con la Ley;
