- EnglishEvery person has the right to free access to justice and the effective, impartial and expeditious protection of their rights and interests, subject to the principles of immediate and swift enforcement; in no case shall there be lack of proper defense. Failure to abide by legal rulings shall be punishable by law. (Art. 75)
- SpanishToda persona tiene derecho al acceso gratuito a la justicia y a la tutela efectiva, imparcial y expedita de sus derechos e intereses, con sujeción a los principios de inmediación y celeridad; en ningún caso quedará en indefensión. - EnglishThe special proceedings for protection shall be admissible against those rulings or definitive judgments where there has been a violation, by deed or omission, of the rights enshrined in the Constitution, and they shall be filed with the Constitutional Court. This appeal shall be admissible when regular and special appeals have been exhausted within the legal framework, unless the failure to file these resources was not attributable to the negligence of the person bearing the constitutional right that was infringed. (Art. 94)
- SpanishLa acción extraordinaria de protección procederá contra sentencias o autos definitivos en los que se haya violado por acción u omisión derechos reconocidos en la Constitución, y se interpondrá ante la Corte Constitucional. El recurso procederá cuando se hayan agotado los recursos ordinarios y extraordinarios dentro del término legal, a menos que la falta de interposición de estos recursos no fuera atribuible a la negligencia de la persona titular del derecho constitucional vulnerado. - EnglishThe National Equality Councils shall be comprised, on the basis of a parity approach, of representatives of civil society and the State, and they shall be chaired by those who represent the Executive Branch. The structure, functioning and form of membership of their members shall be governed by the principles of rotation of power, democratic participation, inclusion and pluralism. (Art. 157)
- SpanishLos consejos nacionales de igualdad se integrarán de forma paritaria, por representantes de la sociedad civil y del Estado, y estarán presididos por quien represente a la Función Ejecutiva. La estructura, funcionamiento y forma de integración de sus miembros se regulará de acuerdo con los principios de alternabilidad, participación democrática, inclusión y pluralismo. (Art. 157)

- EnglishThe National Equality Councils are bodies responsible for ensuring the full observance and exercise of the rights enshrined in the Constitution and in international human rights instruments. The Councils shall exercise their attributions for the drafting, cross-cutting application, observance, follow-up and evaluation of public policies involving the issues of gender, ethnic groups, generations, interculturalism, and disabilities and human mobility, in accordance with the law. To achieve their objectives, they shall coordinate with leading and executive entities and with specialized organizations for the protection of rights at all levels of government. (Art. 156)
- SpanishLos consejos nacionales para la igualdad son órganos responsables de asegurar la plena vigencia y el ejercicio de los derechos consagrados en la Constitución y en los instrumentos internacionales de derechos humanos. Los consejos ejercerán atribuciones en la formulación, transversalización, observancia, seguimiento y evaluación de las políticas públicas relacionadas con las temáticas de género, étnicas, generacionales, interculturales, y de discapacidades y movilidad humana, de acuerdo con la ley. Para el cumplimiento de sus fines se coordinarán con las entidades rectoras y ejecutoras y con los organismos especializados en la protección de derechos en todos los niveles de gobierno. (Art. 156)

- EnglishThe Office of the Human Rights Ombudsman shall have as its duties the protection and guardianship of the rights of the inhabitants of Ecuador and the defense of the rights of Ecuadorian nationals living abroad. It shall have the following attributions, in addition to those provided for by law:
1. To support, by virtue of its office or at the request of a party, the actions of protection, habeas corpus, access to public information, habeas data, noncompliance, citizen action and complaints for poor quality or improper provision of public or private services.
2. To issue measures of mandatory and immediate compliance for the protection of rights and to request trial and punishment from the competent authority for their violations.
3. To investigate and rule, in the framework of its attributions, on the deeds or omissions of natural persons or legal entities that provide public services.
4. To exercise and promote surveillance of due process of law and to immediately prevent and stop all forms of cruel, inhumane and degrading treatment. (Art. 215) - SpanishLa Defensoría del Pueblo tendrá como funciones la protección y tutela de los derechos de los habitantes del Ecuador y la defensa de los derechos de las ecuatorianas y ecuatorianos que estén fuera del país. Serán sus atribuciones, además de las establecidas en la ley, las siguientes:
1. El patrocinio, de oficio o a petición de parte, de las acciones de protección, hábeas corpus, acceso a la información pública, hábeas data, incumplimiento, acción ciudadana y los reclamos por mala calidad o indebida prestación de los servicios públicos o privados.
2. Emitir medidas de cumplimiento obligatorio e inmediato en materia de protección de los derechos, y solicitar juzgamiento y sanción ante la autoridad competente, por sus incumplimientos.
3. Investigar y resolver, en el marco de sus atribuciones, sobre acciones u omisiones de personas naturales o jurídicas que presten servicios públicos.
4. Ejercer y promover la vigilancia del debido proceso, y prevenir, e impedir de inmediato la tortura, el trato cruel, inhumano y degradante en todas sus formas. (Art. 215)
