The following recourses and mechanisms of constitutional control are also established:
1) The Recourse of Habeas Data as guarantee of protection [tutela] of personal data established [asentados] in archives, registers, databases or other technical means, of public or private nature, whose publicity constitutes [an] invasion of personal privacy and has relevance to the treatment of sensitive data of the persons in their intimate and familiar domain [ámbito]. The Recourse of Habeas Data proceeds in favor of any person to know in what circumstances, to what ends, when, and who makes contact with their personal data and its improper [indebida] publicity.
2) The conflict of competence and constitutionality between the Powers of the State. The representatives of the Powers of the State will promote the conflict of competence and constitutionality when they consider that a law, decree or regulation, act, resolution or provision of another organ [órgano], invades the domain of their privative constitutional competences.
3) The control of constitutionality in [a] concrete case as incidental mechanism of control. When in a case submitted to the cognizance of [a] judicial authority, it considers that a norm on whose validity the decision [fallo] depends is contrary to the Constitution, it must proceed to declare its unconstitutionality for that specific [en concreto] case. The parties in the process may solicit the unconstitutionality of a norm that is being applied to the case. The judicial authority must pronounce itself on the point, accepting [acogiendo] or rejecting the claim [pretensión].
4) The conflicts of constitutionality between the Central Government and the Municipal Governments and [Governments] of the Autonomous Regions of the Caribbean Coast.

Se establecen también los siguientes recursos y mecanismos de control constitucional:
1) El Recurso de Habeas Data como garantía de tutela de datos personales asentados en archivos, registros, bancos de datos u otros medios técnicos, de naturaleza pública o privada, cuya publicidad constituya invasión a la privacidad personal y tenga relevancia con el tratamiento de datos sensibles de las personas en su ámbito íntimo y familiar. El Recurso de Habeas Data procede a favor de toda persona para saber quién, cuándo, con qué fines y en qué circunstancias toma contacto con sus datos personales y su publicidad indebida.
2) El conflicto de competencia y constitucionalidad entre los Poderes del Estado. Los representantes de los Poderes del Estado promoverán el conflicto de competencia y constitucionalidad cuando consideren que una ley, decreto o reglamento, acto, resolución o disposición de otro órgano, invade el ámbito de sus competencias privativas constitucionales.
3) El control de constitucionalidad en caso concreto como un mecanismo incidental de control. Cuando en un caso sometido al conocimiento de autoridad judicial, ésta considere que una norma de cuya validez depende el fallo es contraria a la Constitución, deberá proceder a declarar su inconstitucionalidad para el caso en concreto. Las partes en el proceso pueden solicitar la inconstitucionalidad de una norma que se esté aplicando al caso. La autoridad judicial deberá pronunciarse sobre el punto, acogiendo o rechazando la pretensión.
4) Los conflictos de constitucionalidad entre el Gobierno Central y los Gobiernos Municipales y de las Regiones Autónomas de la Costa Caribe.
La Ley de Justicia Constitucional regulará los recursos y mecanismos establecidos en este capítulo. (Art. 190)

- EnglishAny person shall file a prompt and summary proceeding regarding constitutional guarantees, provided there is no other legal remedy, against any act or omission of the public authorities or individuals which currently or imminently may damage, limit, modify or threaten rights and guarantees recognized by this Constitution, treaties or laws, with open arbitrariness or illegality. In such case, the judge may declare that the act or omission is based on an unconstitutional rule.
… (Sec. 43) - SpanishToda persona puede interponer acción expedita y rápida de amparo, siempre que no exista otro medio judicial más idóneo, contra todo acto u omisión de autoridades públicas o de particulares, que en forma actual o inminente lesione, restrinja, altere o amenace, con arbitrariedad o ilegalidad manifiesta, derechos y garantías reconocidos por esta Constitución, un tratado o una ley. En el caso, el juez podrá declarar la inconstitucionalidad de la norma en que se funde el acto u omisión lesiva.

- EnglishAny act on the part of the Public Power that violates or encroaches upon the rights guaranteed by this Constitution and by law is null and void, and the public employees ordering or implementing the same shall incur criminal, civil and administrative liability, as applicable in each case, with no defense on grounds of having followed the orders of a superior. - English[The recourse of] amparo is instituted for the purpose of protecting persons against the threats of violations of their rights or to restore the rule of the same when the violation has occurred. There is no area which is not subject to [the recourse of] amparo, and it will always proceed whenever the acts, resolutions, provisions, or laws of [an] authority should imply a threat, restraint, or violation of the rights which the Constitution and the laws guarantee. (Art. 265)

- EnglishEveryone has the right, on the terms established by the human rights treaties, pacts and conventions ratified by the Republic, to address petitions and complaints to the intentional organs created for such purpose, in order to ask for protection of his or her human rights.
The State shall adopt, in accordance with the procedures established under this Constitution and by the law, such measures as may be necessary to enforce the decisions emanating from international organs as provided for under this article. Failure to abide by legal rulings shall be punishable by law. (Art. 75)

National Human Rights Bodies
- EnglishThe Procurator of Human Rights has the following attributions:
a. To promote the adequate [buen] functioning and expediting [agilización] of the government administration, in matters of Human Rights;
b. To investigate and denounce [the] administrative behavior that is detrimental to the interests of persons;
c. To investigate every type of denunciations that may be brought by any person regarding the violations of Human Rights;
d. To recommend privately or publicly to the functionaries the modification of any administrative behavior objected to;
e. To issue public censure for acts or behavior against the Constitutional rights;
f. To promote actions or recourses, judicial or administrative, in those cases in which they proceed; and
g. The other functions and attributions assigned to him [or her] by the law.
The Procurator of Human Rights, of office[,] or at the instance of a person, will act with due diligence so that, during the regime of exception, the fundamental rights whose application may not have been expressly restrained may be fully guaranteed. For the fulfillment of his [or her] functions[,] every day and all hours are considered working [hours]. (Art. 275) - SpanishEl Procurador de los Derechos Humanos tiene las siguientes atribuciones:
a) Promover el buen funcionamiento y la agilización de la gestión administrativa gubernamental, en materia de Derechos Humanos;
b) Investigar y denunciar comportamientos administrativos lesivos a los intereses de las personas;
c) Investigar toda clase de denuncias que le sean planteadas por cualquier persona, sobre violaciones a los Derechos Humanos;
d) Recomendar privada o públicamente a los funcionarios la modificación de un comportamiento administrativo objetado;
e) Emitir censura pública por actos o comportamientos en contra de los derechos constitucionales;
f) Promover acciones o recursos, judiciales o administrativos, en los casos en que sea procedente; y
g) Las otras funciones y atribuciones que le asigne la ley.
El Procurador de los Derechos Humanos, de oficio o a instancia de parte, actuará con la debida diligencia para que, durante el régimen de excepción, se garanticen a plenitud los derechos fundamentales cuya vigencia no hubiere sido expresamente restringida. Para el cumplimiento de sus funciones todos los días y horas son hábiles. (Art. 275)
