- EnglishAny act on the part of the Public Power that violates or encroaches upon the rights guaranteed by this Constitution and by law is null and void, and the public employees ordering or implementing the same shall incur criminal, civil and administrative liability, as applicable in each case, with no defense on grounds of having followed the orders of a superior. (Art. 25)

- EnglishThe state recognizes the guarantee of amparo.
Consequently, any aggrieved person, or any other in his name, has the right to interpose the recourse of amparo:
1) so that the enjoyment and benefit [goce y disfrute] of the rights and guarantees that the Constitution, the treaties, conventions and other international instruments establish[,] are maintained or restituted; and
2) so that in specific [concretos] cases that a regulation, act [hecho], act [acto] or resolution of authority is declared to not obligate the petitioner [recurrente] or is not applicable to contravene, diminish or distort any of the rights recognized by this Constitution.
When the action of amparo is interposed before a non-competent Jurisdictional Organ, the written original must be remitted to the competent Jurisdictional Organ.
The recourse of amparo must be interposed in conformity with the law. (Art. 183) - SpanishEl Estado reconoce la garantía de amparo.
En consecuencia toda persona agraviada o cualquiera en nombre de ésta, tiene derecho a interponer recurso de amparo:
1) Para que se le mantenga o restituya en el goce y disfrute de los derechos o garantías que la Constitución, los tratados, convenciones y otros instrumentos internacionales establecen; y,
2) Para que se declare en casos concretos que un reglamento, hecho, acto o resolución de autoridad, no obliga, al recurrente ni es aplicable por contravenir, disminuir o tergiversar cualesquiera de los derechos reconocidos por esta Constitución.
Cuando la acción de amparo se interrumpiese ante un órgano Jurisdiccional incompetente éste debe remitir el escrito original al órgano Jurisdiccional competente.
El recurso de Amparo se debe interponer de conformidad con la Ley. (Art. 183)

The following recourses and mechanisms of constitutional control are also established:
1) The Recourse of Habeas Data as guarantee of protection [tutela] of personal data established [asentados] in archives, registers, databases or other technical means, of public or private nature, whose publicity constitutes [an] invasion of personal privacy and has relevance to the treatment of sensitive data of the persons in their intimate and familiar domain [ámbito]. The Recourse of Habeas Data proceeds in favor of any person to know in what circumstances, to what ends, when, and who makes contact with their personal data and its improper [indebida] publicity.
2) The conflict of competence and constitutionality between the Powers of the State. The representatives of the Powers of the State will promote the conflict of competence and constitutionality when they consider that a law, decree or regulation, act, resolution or provision of another organ [órgano], invades the domain of their privative constitutional competences.
3) The control of constitutionality in [a] concrete case as incidental mechanism of control. When in a case submitted to the cognizance of [a] judicial authority, it considers that a norm on whose validity the decision [fallo] depends is contrary to the Constitution, it must proceed to declare its unconstitutionality for that specific [en concreto] case. The parties in the process may solicit the unconstitutionality of a norm that is being applied to the case. The judicial authority must pronounce itself on the point, accepting [acogiendo] or rejecting the claim [pretensión].
4) The conflicts of constitutionality between the Central Government and the Municipal Governments and [Governments] of the Autonomous Regions of the Caribbean Coast.

Se establecen también los siguientes recursos y mecanismos de control constitucional:
1) El Recurso de Habeas Data como garantía de tutela de datos personales asentados en archivos, registros, bancos de datos u otros medios técnicos, de naturaleza pública o privada, cuya publicidad constituya invasión a la privacidad personal y tenga relevancia con el tratamiento de datos sensibles de las personas en su ámbito íntimo y familiar. El Recurso de Habeas Data procede a favor de toda persona para saber quién, cuándo, con qué fines y en qué circunstancias toma contacto con sus datos personales y su publicidad indebida.
2) El conflicto de competencia y constitucionalidad entre los Poderes del Estado. Los representantes de los Poderes del Estado promoverán el conflicto de competencia y constitucionalidad cuando consideren que una ley, decreto o reglamento, acto, resolución o disposición de otro órgano, invade el ámbito de sus competencias privativas constitucionales.
3) El control de constitucionalidad en caso concreto como un mecanismo incidental de control. Cuando en un caso sometido al conocimiento de autoridad judicial, ésta considere que una norma de cuya validez depende el fallo es contraria a la Constitución, deberá proceder a declarar su inconstitucionalidad para el caso en concreto. Las partes en el proceso pueden solicitar la inconstitucionalidad de una norma que se esté aplicando al caso. La autoridad judicial deberá pronunciarse sobre el punto, acogiendo o rechazando la pretensión.
4) Los conflictos de constitucionalidad entre el Gobierno Central y los Gobiernos Municipales y de las Regiones Autónomas de la Costa Caribe.
La Ley de Justicia Constitucional regulará los recursos y mecanismos establecidos en este capítulo. (Art. 190)

The State shall adopt, in accordance with the procedures established under this Constitution and by the law, such measures as may be necessary to enforce the decisions emanating from international organs as provided for under this article. - English[The recourse of] amparo is instituted for the purpose of protecting persons against the threats of violations of their rights or to restore the rule of the same when the violation has occurred. There is no area which is not subject to [the recourse of] amparo, and it will always proceed whenever the acts, resolutions, provisions, or laws of [an] authority should imply a threat, restraint, or violation of the rights which the Constitution and the laws guarantee. - SpanishSe instituye el amparo con el fin de proteger a las personas contra las amenazas de violaciones a sus derechos o para restaurar el imperio de los mismos cuando la violación hubiere ocurrido. No hay ámbito que no sea susceptible de amparo, y procederá siempre que los actos, resoluciones, disposiciones o leyes de autoridad lleven implícitos una amenaza, restricción o violación a los derechos que la Constitución y las leyes garantizan. 1. To be Panamanian by birth;
2. To fully enjoy one's civil and political rights;
3. To be at least thirty five years of age;
4. Not to have been sentenced to five years in prison or more for a premeditated offense;
5. To have moral integrity and a good reputation;
6. Not to be bound by family ties, within the fourth degree of consanguinity and the second degree of marital relations, to the President of the Republic, any other Cabinet Council member, Justices of the Supreme Court of Justice or a member of the National Assembly. 5. Tener solvencia moral y prestigio reconocido.
6. No tener parentesco, dentro del cuarto grado de consaguinidad y segundo de afinidad, con el Presidente de la República, con ningún otro miembro del Consejo de Gabinete, con Magistrados de la Corte Suprema de Justicia ni con Diputados de la República. (Art. 130)
